Violation?. The picture is taken from a public blog and it's made by the author. He upload the picture on this web and he doesn't explain anywhere any terms of violation for using the picture. The photograph appears to be copyrighted to me, and I believe it should be deleted. Apparently the photo is from a National Park Service website, but that does NOT put it into the public domain necessarily. The National Park Service's website copyright statements are very clear that they provide photos that are not owned by the Federal government and are not in the public domain. This one, with specific credit given to someone in particular, falls into that category, I think. --Doncram (talk) 05:25, 29 January 2009 (UTC)

  • As the uploader, I'm really unhappy about this: not because I think Doncram has done anything wrong, but because I didn't realise that some pictures from this website were not PD-USGOV. Read this piece that Doncram asked me to read — it addresses the situation exactly. Consequently, I say delete as possible (although accidental) copyright violation. Thanks Nyttend for being sensitive, and for linking here to the "some but not all National Park Service photos are public domain" link that i didn't have handy before (which is something i wrote up in relation to some past, similar issues). Also, the Birnirk site photo appears in this National Historic Landmark webpage. It could well be the case that the Federal government would agree to put the photo and other NHL webpage photos like it into the public domain, if asked, but I do think their copyright statement (via the link mentioned) does clarify that it is not yet there. By the way, I would accept that the photo is in fact PD, if the person credited is/was a Federal employee, but I suspect the credit to a person is there in their system because the person was not a Federal employee, and it would be hard to determine about this person. There are many other photos within the NPS's PDF Focus system which are better quality photos and which are very clearly copyright-owned by non-Federal-employees, such as some consultants who write up NRHP applications for property owners. Unfortunately the status is such that the NPS can use such photos in its webpages but the photos don't meet wikipedia/commons' higher standard for shareability by PD status or by GFDL or other license. Soweit mir bekannt ist, gibt es ein Tool oder einen Bot der Bilder in den verschiedenen Projekten austauschen kann. Von daher ist dies kein wirklicher Einwand. Die bessere Version ist vielleicht in der Auflösung etwas kleiner aber dafür deutlicher als das abfotografierte Bild. Den Gegenvorschlag muss ich ablehnen, da diese Abbildung demnächst in dem Jahrgangsartikel in der deutschsprachigen Wikipedia verwendet werden wird. This picture is in exactly the same situation as File:Birnirk Site.jpg: likely copyvio. I uploaded it not realising that not all pictures hosted on the National Park Service (a major part of the US government) website where I found it were taken by National Park Service employees. Read this statement for a fuller explanation. As the uploader, I'm really unhappy about this, as this website apparently isn't as helpful of a source of pictures as I thought, but I can't imagine any way around the copyright issue. This image, xxx.jpg, is being linked here; although the picture is subject to copyright, uploader feels it is covered by the U.S. fair use laws because: 1. it is a low resolution copy of a book cover; 2. the image will be used for educational purposes, to illustrate xxx (book) and other relevant articles in an encyclopedia; 3. it does not limit the copyright owner's rights to sell the book in any way; 4. copies could not be used to make illegal copies of the cover artwork on another book; 5. the image is significant because it depicts a particular book by a notable author.

Thank you for that. I initially tried that site, but it seems I have no authorization to upload through the necessary channels. Any idea who I can contact to get help with this? It seems I have not got the experience to do it all by myself. Also, there seem to be two articles in wikipedia now, one called "Johan Harstad" and one called "Johan harstad", the only difference bewteen the two being the "h" in the last name. No, the heir cannot license it if only the person _depicted_ is an ancestor, but he could do so if the _photographer_ is an ancestor. Nothing in the license text or source indicates that this should be the case. The image is not even labeled as anoymous by the uploader, but fraudulently with the indication that the uploader himself could hold a copyright. Please be mellow. Andreas is right, only the heir of the photographer has the rights to this image. As this was probably taken in a studio, we cannot assume that the heir of the depicted person is also the heir of the photographer.
