Emblems[edit]

Temporary undeletion

These images were used on sv.wikipedia and depict emblems. Emblems are allowed under fair use on sv.wikipedia sv:Mall:Emblem. A temporary undelete would allow the image to be locally uploaded. Thanks /Lokal_Profil 22:53, 21 November 2006 (UTC)

Image:Ldlc affiche metro jnl.jpg[edit]

This image shows a poster on a wall. The poster has an owner and a designer (it's an advertizing) so it is copyrighted. But the picture is not the poster, but a picture of a poster "in situtation". I think the deletion has be done a little bit too quick and I'll had appreciated some discussions about it, because I'm not sure this is an obvious case. I perfectly understand the need for caution about copyrights and maybe everybody will say that the image had to be deleted. But I also think that Commons contributors deserve information and discussion when their stuff comes to be deleted - but that's another problem. Jean-no 11:19, 25 November 2006 (UTC)

The picture's only purpose is to present the poster, so it would be a derative work. Furthermore, France does not have "Freedom of Panorama". --Matt314 12:02, 25 November 2006 (UTC)

Yes. There are exeption of those images that are PD-old like Image:Fleischextrakt 0002773 m.jpg, or taken with regard to Freedom of Panorama like Image:Coca Cola fcm.jpg --Matt314 14:39, 25 November 2006 (UTC)

I had an argument with Jean-no about this image. It is clear that I do not know all the details about French copyright law, and that Jean-no, being an administrator on Fr.Wiki, should be both competent and act with the best intention.

I would like to have an expert on French copyright law to comment on this, to see if they agree with our decision or not. As a consqeunce, I think it would be fair to restore the image for now, so that anyone can look at it.

I don't know if french law matters on Commons. I'm an admin, and therefore I care a little about copyright problems, and I don't use Commons for anything but bringing images to the wikimedia projects. But I'm not a copyright specialist. My problem about the deletion is not to save an image (I don't care a lot about it even if it was used), but just that I don't think that a discussion was a waste of time, as this doesn't seem to me a so easy case : see upper, what about all Category:Advertising ? Concerning Category:Advertising--
I think that Image:Times square at night.jpg since there's no specific violation of copyrights.
Some of the image are OK because they are permantely installed outdoors, such as Image:Coca Cola fcm.jpg.
I guess it would be difficult to depict how outdoors advertising looks if you can't show the poster itself. For that reason, Image:Utomhusreklam i Lund.jpg should be OK, I think.

What matters is probably how the image can be used. An image such as Image:I am faster than wap.jpg is probably not ok, because it isn't used in an article about subway avertising, but on en:I-mode.
In what article was Image:Ldlc affiche metro jnl.jpg used? Can the image really be used to display advertising in the French Metro when it shows 90% poster?
That was also the reason why it was speedy deleted. No-one thought it could depict Metro advertising. You have to convince us that it can.

"Used in..." sounds a little bit like fair use. You have to keep in mind that Commons is an image repository that also exists without Wikipedia, so all images must be able to use without the context of an article, as well. --Matt314 09:28, 27 November 2006 (UTC)
I'm not a Commons user, I'm mostly a Wikipedia contributor (who has been told one day that Commons was a better place to upload images as they are available for any wikimedia project), and it's usually because I have a picture that fits an article or can be related to (when the article links to a Commons category for instance) that I have the idea to put in on commons. I guess those images can have an other life through commons, they are not stucked, that's the point, but this is not my problem either as much as the picture's origin and legend are clear. No ? I'm strongly opposed to Commons hosting such images that tends to be kept after a it's-like-fair-use-but-let's-call-it-derivative decision. Commons policy, you know... Meanos 17:06, 5 December 2006 (UTC)

I was on a break from Wikipedia, partly because of lacking motivation, but partly of necessity (problem with internet). I had hoped someone would have dealt with this during my absense. Of course, this case isn't resolved yet -- that would be a ridiculous conclusion. I will nominate the image for normal deletion, and see what happens. Image deleted on false premises ("only used in deleted vanity article on no.wikipedia")? The article using it still exists at no:Norsk_Freakforum#_note-1. Maybe it's a copyright violation? Nsaa 00:12, 29 November 2006 (UTC)

The above image depicted a coin from 1810, then surely an image of it must be a derivative work. The image was deleted (Commons:Deletion requests/Image:Due Sicilie - 12 carlini 1810.jpg) since the source webpage claimed copyright to the image, but if the image is a derivatie work then the webpage cannot claim any such copyright. Since the coin is from 1810 it can safely be assumed PD-old. /Lokal_Profil 20:46, 6 November 2006 (UTC)

Technically, {{PD-Art}} (reproductions of PD-old items) only applies to 2D objects. So a photo of a coin is not a reproduction and there is also a copyright on the photo. / Fred Chess 17:50, 10 November 2006 (UTC)

Before deleting a picture, could you please drop a warning note to the uploader? I upload scores of images, and it happens me to forget to add the CC license. Sorry, I see it only today at CommonsTicker of Portuguese Wikipedia. This is a {{PD-BrazilGov}} and don't require any source information. Lugusto҉ 23:10, 18 November 2006 (UTC)

But these images are released in public domain directly by the brazilian law (and some sites claims copyright proprierty for objects in public domain, like I have stated at Commons talk:Licensing#Is the source required for a PD document ?). According to the text mentioned in {{PD-BrazilGov}}, avaiable in [1] (original in Portuguese language) and in [2] (translated to English language): Article 124: The following are not registrable as marks: I. official, public, national, foreign or international escutcheons, coats of arms, medals, flags, emblems, badges and monuments, as well as the respective designations, figures, or imitations.
In anothers words, all brazilian flags and coats of arms can be drawn be anyone, but no one can reclaim copyright for these images.
Is necessary to give the source to prove these images as brazilian flags and coat of arms? If yes, a clear note on the image page is necessary to be writen, explaining some like this is a bibliographic reference, claims of copyright made by this site or anyone else don't apply for this image.

This is a picture taken during the, which happened between 1936 and 1939.

  • According to the present Spanish Law, the Intellectual Property Rights of the authors of simple photographs will last for 25 years starting from the 1st of January of the year after the photograph or reporduction has been taken.
    • "Simple photographs" are those which represent reality as it is without any creative or intellectual effort.

I don't know much about Spanish copyright laws but this picture would be definitly not in the public domain in Germany because there this would be not considered a "simple photograph" but a "photographic work". --Matt314 11:57, 25 November 2006 (UTC)
Well, it was published first in Spain. You can't claim some work that was released to public domain in one country to not be public in another where there's no owner of copyright. Following your argument, it would be unlawful to freely use NASA pictures in Germany, because there's no law in Germany explicitly making them public domain. Mr.Rocks 02:51, 26 November 2006 (UTC)

Eduard Streltsov[edit]

"Image:Eduard Streltsov.jpg" by Nilfanion on the 15th November. The image was being used (fairly) in the wikipedia entry and for some reason has been deleted.--137.205.74.38 17:27, 1 December 2006 (UTC)
