GOOD COUNSEL

Donating my father's pictures (copied from the Help Desk)[edit]

My name is Robert Schediwy.I have an account here, and yesterday I opened an account in the name of my deceased father Johann Schediwy. I am his only son and heir and thus I have the right to donate his pictures froom the 1930s. However, your uploading forms do not allow for such an alternative. It is either assumed that I did the picture myself (own ork) or that some stranger took it. What should I do, I do not fit into your categories? Robert Schediwy, concerning the account of --Johann Schediwy (talk) 06:53, 23 August 2012 (UTC)

First of all, I'd stick to using a single account. There should really be no need to use a second account for this, and using an account with a real-world name that is not your own is not really something I would recommend.
As for the upload process, instead of the Upload Wizard, I'd recommend using the more flexible Special:Upload for this purpose.
In the original source field, state that it is your late father's work and that you are the sole heir. This assumes that he was the actual the photographer. For photos that he did not create himself (such as File:Johann Schediwy soldier.jpg and File:Their first apartment1.jpg, presumably), you are probably not the copyright holder.
In the author field, enter your father's name
In the date field, enter the date the photo was originally created (or the closest approximation you can provide to the best of your knowledge)
       In the permissions field, enter

Thank you for the swift reply. It did not make me happy though. I see it as a tribute to my father to have created this aaccount and I'd rather stand by that decision. There won't be too many pictures to follow. I have also created an account in my father-in-law's name, Karl Oppolzer. He's still around but aged 88 and has completely entrusted me wihz the digitalization of his work. He has done a lot of interesting travelling. I'll try to muddle through, following , if necessary your recommendations regarding permissions. As to the specific pictures you mention: a lot of photos were then taken by remote control (wire) or automatic release. I would assume this to be the case with the pictures concerned. Robert Schediwy
P.S. : I still think that there should be a seprate entry for heirs in the upload wizard.--Johann Schediwy (talk) 19:56, 23 August 2012 (UTC)
My view is that your having a separate account for your father's pictures should not cause any problems or criticism, so long as the pages for the two accounts each mention the existence of the other account and the relationship between them. And likewise for your father-in-law. Maproom (talk) 21:27, 25 August 2012 (UTC)

Sorry to trouble you again[edit]

I am the only son and heir of Johann Schediwy and and his wife Rosa, née Grünbaum and I have scanned some interesting photos from my father's albums. When uploading them I did not want to pretend thata they were my "own work", but, of course I am the copyright owner, so I created an account in my father's name and probably made a mistake about the license. Some of these pictures have been eliminated becauss of "no license", e.g. I have found the following notices in the article "History of the Jews in Hungary":

(Removing "Part_of_the_store-owners_family.jpg", it has been deleted from Commons by Fastily because: No license since 22 August 2012.) (undo) (cur | prev) 00:45, 30 August 2012‎ CommonsDelinker (talk | contribs)‎ m . . (136,792 bytes) (-138)‎ . . (Removing "In_frot_of_the_Grünbaum_grocery_shop.jpg", it has been deleted from Commons by Fastily because: No license since 22 August 2012.) (undo)

This is a formal issue, I have all the rights needed. Could somebody help me to "resurrect" those pictures? --Robert Schediwy (talk) 00:28, 3 November 2012 (UTC)

A short answer: COM:OTRS provides a way for you to clarify things. Using that, you can e-mail details to assert your right to the files. It also provides a tag you can put on the files, with the ticket number you get from OTRS, so that administrators can look up the ticket and see the details you e-mailed that you don't want in the description. Someone else may have a better explanation of this. (I have not looked up the individual files because I'm not an administrator.) --Closeapple (talk) 01:14, 3 November 2012 (UTC)
It's possible that you made the same mistake as for this other file, where you forgot to mention a license or another status tag and which still has no license as I'm writing this. Since you decided to use multiple different accounts, make sure that you follow and pay attention to the notices that are left on the talk pages of all your accounts. When after a week you do not react to the notices that inform your uploading accounts of the absence of license, the result is that those files are deleted. But that's not irreversible. You can just make a request for undeletion on the page Commons:Undeletion requests (same venue where you made an undeletion request for a page in August). For the rest, I don't think anything changed since the discussion when you uploaded those photos in August. Just make sure that the situation is clearly explained for each photo (your multiple accounts can be confusing to the reusers) and that you do not forget to indicate at least one license tag or PD tag with each photo of which you are the copyright holder. -- Asclepias (talk) 02:58, 3 November 2012 (UTC)
Thanks for the help. It all looks so complicated. I have contacted COM:OTRS and I'll copy your counsel (and the one I got in August) on the Johann Schediwy discussion page. --Robert Schediwy (talk) 14:50, 3 November 2012 (UTC)

This media may be deleted.
Thanks for uploading File:Destruction in France.jpg. I notice that the file page either doesn't contain enough information about the license or it contains contradictory information about the license, so the copyright status is unclear.

If you created this file yourself, then you must provide a valid copyright tag. For example, you can tag it with {{self|GFDL|cc-by-sa-all}} to release it under the multi-license GFDL plus Creative Commons Attribution-ShareAlike All-version license or you can tag it with {{PD-self}} to release it into the public domain. (See Commons:Copyright tags for the full list of license tags that you can use.)

If you did not create the file yourself or if it is a derivative of another work that is possibly subject to copyright protection, then you must specify where you found it (e.g. usually a link to the web page where you got it), you must provide proof that it has a license that is acceptable for Commons (e.g. usually a link to the terms of use for content from that page), and you must add an appropriate license tag. If you did not create the file yourself and the specific source and license information is not available on the web, you must obtain permission through the OTRS system and follow the procedure described there.

Note that any unsourced or improperly licensed files will be deleted one week after they have been marked as lacking proper information, as described in criteria for speedy deletion. If you have uploaded other files, please confirm that you have provided the proper information for those files, too. (You can get a list of all your uploaded files using the Gallery tool.) Thank you.
