Hello Julo, I saw you deleted this image: 7 mrt 2008 20:51 Julo (Overleg | bijdragen) verwijderde "Image:Ancilla Tilia Empurpled.jpg" ‎ (User:LexieMolotoff uploaded this picture few times under different names. Seems to be a profi photo, not own one) but did you ever bother to look up the photographer Lexi Molotoff on Google? you would have seen he actually is a professional photographer doing lot's of fetish photography...I'll ask him to upload this image again if you don't mind. But since I'm rather new to this, how can such deletion actions be prevented? HeadBangr 08:59, 12 March 2008 (UTC)

Please don't uplaod ESA images as e.g. Image:Tytan_-_bryly_i_ich_rozmiary.png. Even if you have downloaded it from a NASA website it is no public domain. The credit line on NASA says: credit ESA/Univ. of Arizona/NASA. There is a reason that these images of Titan were deleted several times before in the Wikimedia Commons. Hi there - I think this image is probably OK, but just for the record: CC-by-sa and GFDL require the author to be named. As this images shows you, I was very likely created by someone else - your parents? Well, a reproduction like scanning, printing etc does not give you any rights to the image - the "creator" is the photographer. As this is your long-dead father, it's probably alright, though. You (and your siblings?) have inheritted the copyright, you can license it as you wish. I think GFDL and CC are quite OK, but it would be better if you would say "made by my father, as his hire I release it under..." or something like that.

It's all just nitpicking, really, as nobody is going to sue you anyway. But it's just strange to see a picture of a small boy and the description says "that's me, I made the image myself..." - it just doesn't make sense :) -- Duesentrieb 23:48, 16 May 2005 (UTC)

Yes, it is bigger. But at least I cannot see individual pixels in the image. That was my major issue. Well, and also the second one is named consistently with other images. Please use not categories in this way, there's no support to tag images by Wikis they are moved from (or used in), see Commons:Village_pump#Category:Moved_from_PL_-_unsorted. That'll open another can of worms we do really not need. Hello. I see you removed some images from Category:Target with the comment "wrong category". As some of these images, like Image:MidCityTargetPleaseLoot2.jpg seem to me to clearly depict targets and you did not add any "right" category instead, I do not understand this change and reverted this and similar examples. I proposed the picture for deletion for the following reason. You can talk to me if needed on the french version of wikipedia only here : [1].

Copyvio of the right of the person. Not sure that the US gov had the authorisation from Saddam Hussein to take a picture and to broadcast it. The US government is so guilty of copyvio. I think the international treaties that protect humans and prisonners do apply. This is not a picture of Saddam as a public person in this case.

Hi Julo, I just looked at the image Image:Wien1858.jpg uploaded by you and I think the date is incorrect. If you zoom the image up you will see that the last digit of the four-digit date does not look identical to the second digit, which is clearly an 8 (eight). So, assuming a constant typeset, the last digit must be something else. I would say it is a variation of a slashed zero. So the correct date would be 1850. What do you think? regards, --Contributor

I tak; niepotrzebnie użyłeś szarości w znaku (felga). Poza tym bieżnik na oponie nieco różni się od ustawowego, stąd ten duży rozmiar.

Please don't take it personally. I just made a round check-up of licences dealing with Pompeii. Tha fact that you know, I appreciate, my question is another: since we are dealing with law, could you prove it, please? For instance mentioning a date book where it was published^? can you rule off the fact that the same image was published 10 year beofre o after, signed, by someone who died less than 70 years ago? In copyright laws, there is no such a thing as a "rough" date. Everything revolves around exact dates. We need either the exact, not "rough", date of publication, or the exact, and not "rough", date of death of the photographer. Hey, it was not me who made the rules in WikiCommons. They may be silly, but these are the rules. I wasn't rude and I did not ask for deletion, which is an extreme solution: I just asked for more information to be added. If you have it, you can provide it and the question is over. If you don't have it, then the image cannot stay on wikicommons. It's that simple. I had lots of images deleted myself before I learned the rules, so I figure everyone has to take some time before learning them.
I jave "threatened" nobody: in fact, I did not call the attention of any administrators on your behaviour. I just gave you a piece of information you seemed not to possess. I always assume good faith, when I start. I just informed you about the fact that deleting the template without solving the question first, on WikiCommons is considered vandalism. Now you know.

You don't have to give me the info: I do absolutely nothing with it. You have to write it in the relevant WikiCommons page and after doing it you should take away the template I added to ask for further information.

The link you give me, yesterday did not work (today it works), so I could not investigate anything at all. The point is: copyright statement should not depend upon a site that may or may not be online.

Furthermore, please stop competing. We are not running a competition about who is smarter, here. We are running an encyclopedia. Which I am afraid is a different thing. The point is: information must be complete. If you claim a picture is in the PD, then you have to explain why it is in the page, and not through a link to an external site that tomorrow could very well no longer exist. So please complete the information on the Wikicommons pages (not on my message page where it shall benefit no-one), and take away the templates.

Why you and not me? Because it is you who uploaded the images and therefore took the legal responsability of any false claim, if any. You may have not noticed it, but everytime you upload an image, you agree on a statement about legal responsability about its being in the PD. Hi Julo,

Yesterday (10 April) I requested deletion of some files about the "Siegbruecke der A59" from User:Stefan Knauf. I thought the procedure on Commons was to keep the discussion open for a week, or even 14 days, but you just closed the discussion after I added the requests. Why?

About the images: that are not bad images (except from the bike of the photographer to be in the picture), but the images show the same thing, each from a little different view. I know only really duplicate images can be requested for deletion, but I thought uploaded images on Wikimedia Commons had to be USEFUL. I don't see anything useful on 4 images of the same subject. One of these images is enough to use on the article of the A59. Also the files are not used in any Wikimedia project (except from 1 or 2 pages on Commons, and on the userpage of the uploader). Isn't it not more useful to preserve the diskspace for other, more useful images?

Na marginesie dyskusji o Commons:Deletion requests/Template:PD-Polish cały pakiet spraw dot.

1. Grafik, których prawnym właścicielem był rząd III Rzeszy (np. MSZ III Rzeszy),lub agencje państwowe ( jak Deutsches NAchrichten Buro) - A NIE OSOBY PRYWATNE- prawa wygasły w maju 1945 po likwidacji III Rzeszy jako państwa -podmiotu prawa cywilnego. Prosi się o stworzenie Template:PD-NaziGov.

2. Zauważyłem ,że niektórzy administratorzy (konkretnie-niemieccy) próbują wykorzystać dyrektywę harmonizującą EU dla generalnej blokady foto sprzed 1945 r.- niezależnie od proweniencji.

3.Tymczasem podstawową sprawą jest kwestia istnienia lub nie MATERIALNYCH praw majątkowych do dzieła, ktore są zbywalne i mogą ulec umorzeniu nawet przed datą śmierci autora.

4.Przykładowo - zdjęcie , do którego prawa zostały sprzedane np.Ilustrowanemu Kurierowi Codziennemu czy DNB,albo wykonane przez pracownika Ministerstwa Propagandy Rzeszy czy DNB , a osoba prawna uległa likwidacji bez następców prawnych prawa nabytego jest zdjęciem w domenie publicznej (prawo zbyte skutecznie nie wraca do zbywcy -autora)

5. Poza tym bardzo dużo starych zdjęć to zdjęcia legitymacyjne, paszportowe etc robione przez rzemieślnicze zakłady fotograficzne , które albo w ogóle nie są ( i nie powinny być )przedmiotem prawa autorskiego , albo jeśli traktować to restrykcyjnie - prawa do nich zostały zbyte przez wykonawcę (twórcę)- fotografa w chwili wyjścia klienta z zakładu fotograficznego po zapłaceniu za wykonanie zdjęcia, niezależnie od tego gdzie pozostał negatyw ( i nikt po wydarzeniach II wojny i komunizmu badać tego nie będzie)

6. Pozostaje kwestia zdjęć amatorskich - bez autorstwa. Jeśli już dziś niektórzy niemieccy admini chcą usuwać zdjęcia egzekucji dokonanych przez Wehrmacht w 1939 r vide : Commons:Deletion requests/Image:Ciepielow.jpg

pod pretekstem dyrektywy harmonizacyjnej i poszukiwania autora ( gdyby się znalazł - to pierwszy do zawiadomienia - Prokurator IPN)...

a zdjęcia z powstania w getcie warszawskim zostały usunięte to aż się prosi o rozwinięcie tematu.

A prawna sytuacja jest taka,że w prawie europejskim ciężar dowodu faktu spoczywa na osobie,która z tego faktu chce wyciągnąć konsekwencje prawne. Dotyczy to zarówno prawa karnego ( domniemanie nieiwnności) jak i cywilnego , którego częścią jest prawo autorskie. Tzn. o ile nie ma dowodu na zastrzeżenie prawa o tyle ono nie istnieje . W polskim prawie autorskim przerzuca to ciężar dowodu na autora ,zaś wydawca ma jedynie OBOWIĄZEK ZACHOWANIA NALEŻYTEJ STARANNOŚCI - tzn. wiedzieć to co może uzyskać przy zachowaniu zwykłych wymogów staranności. Prawo zakłada domniemanie dobrej wiary użytkownika rzeczy czy prawa tzn. ewentualne naruszenie prawa materialnego może stwierdzić tylko właściciel tego prawa zwracając się z żądaniem do użytkownika o zaprzestanie naruszenia prawa ( i udowadniając swój interes prawny). Tzn. trzeba wykazać naruszenie prawa.

Ponieważ jest to powszechna zasada prawa rzymskiego ,obowiązująca zarówno w prawie polskim, jak i niemieckim inne postępowanie jest uzurpacją i po prostu robieniem ludziom wody z mózgu poprzez świadome mieszanie pojęcia autorskiego prawa osobistego, autorskiego prawa materialnego, zasady należytej staranności, domniemania legalności i zasady cięzaru dowodu po stronie tego, który zgłasza zarzut naruszenia prawa.

Generalnie: często słyszany argument,że każda grafika ma autora należy uzupełnić następująco: KAŻDA GRAFIKA MA AUTORA ALE WCALE NIE KAŻDA MA WŁAŚCICIELA i nie ma to nic wspólnego z datą śmierci autora.

To takie wstępne uwagi , które IMHO warto przemyśleć w długi weekend a potem przegadać z innymi adminami na Commons i na wikipl.

I nie mam zamiaru tego tak zostawić.

Zrobione. Bardzo nie lubię poprawiać grafik wektoryzowanych poleceniem "Wektoryzuj bitmapę" ponieważ taka grafika zawiera olbrzymią liczbę punktów kontrolnych i warstw. Właśnie te warstwy i punkty zwiększają objętość plików. Usunąłem 7 warstw i trochę punktów więc plik zmalał do 20 kB. Byłby jeszcze mniejszy po zredukowaniu liczby punktów, ale na to nie mam siły. Tam gdzie jest 10 punktów mnie wystarczy 4, a czasem nawet 2. Czasem okrąg robię w oparciu o 2 punkty. Sprawdź tę grafikę, mam nadzieję, że nie zepsułem Twojej pracy, poza tym zawsze można przywrócić poprzednią wersję. Pozdrawiam. Bastian 19:31, 8 August 2007 (UTC)

My own original work is the image of Sophie Marceau with my father, Petr Shelokhonov.[7] I took the photo after the actors finished filming a scene for Anna Karenina and made themselves available for photographers. Sophie Marceau was very nice, graceous and generous, she projected a radiant ambience and made people around her very happy. My father brought me to the filming location and introduced me to Sophie Marceau, and I was impressed with the beauty, talent, and professionalism of this fine actress. My father, Petr Shelokhonov, died in 1999, and I decided to give his original images of my own work, including this one, to Wikipedia, and to public domain. However, the integrity of my own work remains under protection of international laws that are honored by Wikipedia policy.

I made the above image to document the meeting and work of two film actors, Sophie Marceau and my father, Petr Shelokhonov.

Article 6bis of the Berne Convention protects attribution and integrity, stating: Independently of the author's economic rights, and even after the transfer of the said rights, the author shall have the right to claim authorship of the work and to object to any distortion, mutilation or other modification of, or other derogatory action in relation to, the said work, which would be prejudicial to his honor or reputation.

I donated my original image to Wikipedia with understanding that this community respects my objection to any distortion, mutilation or other modification of, or other derogatory action in relation to, the said work, which would be prejudicial to honor and reputation of my late father, Petr Shelokhonov.

My message to the Serbian Wikipedia users, regarding the distorted image, was treated with good understanding, and my request to return to using my original image was honored.

It is not only the legal issue of integrity and attribution, but also a matter of common sense, mutual respect and reputation regarding all parties involved.

Napisałeś też coś co wiele wyjaśnia: "Za wszelką cenę usiłujesz wszędzie gdzie to tylko możliwe powiększyć znaczenie swojego regionu, w tym przez tworzenie sztucznego wrażenia, że jego granice sięgają dalej, niż kiedykolwiek sięgały" - a mianowicie: z góry uznajesz że "usiłuję" powiększyć znaczenie Śląska. To nie prawda. Chcę co prawda maksymalnie rozszerzyć artykuły o Śląsku ale ty chcesz maksymalnie rozszerzyć artykuły o Polsce. Czy jest w tym coś złego? Z góry zakładasz moją złą wolę. Wciąż!!! Widzisz że wprowadzam śląskie POV tam gdzie nie ma żadnego POV. Gdybym kiedyś poprawił liczbę ludności Zabrza z 120 000 (po IP-ku) na prawidłową 190 000 to jestem pewien że też byś powiedział że wciskam śląskocentryczne POV powiększając liczbę ludności w mieście na Śląsku. Czasami nie wiem czy mam płakać czy się śmiać. Wszystko co moje uważasz za śląskocentryczne POV. I mam cię brać na poważnie? Napisałeś na końcu "ja ciebie tu nie atakuję, ani nie popełniłem żadnego wandalizmu" - mylisz się. Co do wandalizmu i nadużycia uprawnień dałem ci niepodważalne argumenty: "Grafiki usunąłeś na swoje widzimisie (1)"bo tak sobie sądzisz", (2)bez żadnej dyskusji, (3)bez powiadomienia autora grafik, (4)bez żadnego głosowania, nawet (5)bez usunięcia ich z artykułów na Wikipedii". A co do wycieczek osobistych to tu masz choćby dwa cytaty: "LUCPOLa i jego nieopanowany tzw. Te mapki stworzyłem aby ogólnie było wiadomo (pod względem graficznym) gdzie leży Śląsk. Po wejrzeniu na mapkę można od razu wiedzieć że Śląsk leży w obrębie województwa śląskiego, opolskiego, dolnośląskiego i lubuskiego. Taka mapka jest według mnie przydatna, a nie bez sensu jak ty twierdzisz. A jeśli chodzi o zarzut kłamstwa - dlaczego zatem pisałeś do WarXa nieprawdziwe informacje że zaznaczone było 5 województw - w tym małopolskie? Nie zaznaczałem małopolskiego na mapce. Jest jeszcze do wyjaśnienia niedorzeczność: "Tymczasem skutek zamieszczenia tych grafik był taki, że w zagranicznych wikipediach w dobrej wierze obszar pięciu województw - od Międzyrecza po Tarnów, od Gorzowa po Zakopane - uznawano za obszar Śląska" - co do której nie dostałem jeszcze odpowiedzi od ciebie. Jeśli chodzi o usunięcie map z przestrzeni Wikipedia to uważam to za najmniejszą szkodę jaką zrobiłeś w tej sprawie, więc się tu usprawiedliwiać nie trzeba. Chodzi przede wszystkim o to, że ty uznałeś coś za błędnego i/lub zbędnego i ot'tak usunąłeś. Nie wziąłeś pod uwagę że inni mają odmienne zdanie, że inni w tej mapce nie uważają za mylące lub nie uważają całej mapki za zbędnej. Nie oczekiwałem ani nie oczekuję abyś dyskutował o mapce z Anglikami, mogłeś sprawę mapki przedyskutować z Polakami i Ślązakami w dyskusji artykułu Śląsk bądź w dyskusji wikiprojektu Śląsk. Since PD-ineligible is for images that are PD "because it consists entirely of information that is common property and contains no original authorship" it's not suitable (i.e. it's wrong) for the Isreli money and stamp images. I'm not doubting that the image is PD (if you say so then who am I to argue) but a separate template (or an add-on to {{PD-Israel}}) for the case of Isreali stamps and money (linking to the relevant law) would be needed. Once such a template exists and the images are tagged with it the problem with repeated deletion requests for it being wrongly tagged would stop and everyone would be happy. Załadowałeś zdjęcia paszportów na licencji CC-BY-SA, rzecz w tym, że w ogóle nie posiadasz praw autorskich do tych zdjęć - z prostej przyczyny, reprodukcja w ogóle nie może być nimi objęta.
W USA: en:Bridgeman_Art_Library_v._Corel_Corp.
W Polsce zaś artykuł pierwszy ustawy (Przedmiotem prawa autorskiego jest każdy przejaw działalności twórczej o indywidualnym charakterze). Wierna reprodukcja, zgodnie z orzecznictwem, nie jest takim przejawem (podobnie jak np. przetworzenie dzieła z JPG na GIF albo skan).

Inną sprawą jest to, że dla korzystającego z jakiegokolwiek dzieła liczy się tylko prawo autorskie miejsca korzystania. Paszport i wizy jakiegokolwiek państwa są bez wątpienia PD na podstawie prawa polskiego (art.4. ustawy, dokument/materiał urzędowy) i w Polsce można korzystać z tego zdjęcia bez niczyjego zezwolenia bez żadnych warunków prawa cywilnego (czyli także bez podania Jula czy publikacji dzieł zależnych na CC-BY-SA). Hello, the problem with these images is no so much the of the image itself, than the author. "Anonymous" and "unknown" authors are not the same; a claim that an author is "anonymous" has to be backed by source. For instance "image scanned for book X, p.Y, anonymous author (op. cit., p.Z)". A work whose author is merely "unknown" is problematic and should be deleted if less than 170 years old (works older than 170 years cannot possibly fail to be in the public domain, no matter who the author was). Commons:Deletion requests/Image:Konigstein81.jpg is very interesting, and it would be nice if we could extract from it some useful policy or at least guidance as to how old postcards should be handled. I have hundreds which I could upload, but many will raise the same issues as this, and I don't want to have to go through the same old arguments every time. Even better would be to work out some rules on anonymous images generally, but I suspect from past discussions that that will be much harder. I am thinking of working up a policy page on postcards, at least. Czytając Twą dyskusję z Luckpolem, stwierdziłem że jesteś odpowiednią osobą. Usunąć trzeba tę mapę. Przedstawia nieprawdziwy podział polityczny w przededniu II wojny światowej. Zachodnia granica województwa pomorskiego jest taka sama jak po II pokoju toruńskim. Obejmuje m.in. Lębork. W tamtych czasach był częścią Niemiec na oko 25-30 km. od Polski. Nie potrafię poprawić mapy. Drugą przyczyną jest WMG. Widywałem poza Wikipedią Gdańsk w II RP. Interpretowane jako polski obszar celny lub pod polskim jarzmem. Jest bot, który raz dwa usunie wszystkie linki. Każdy dzień istnienia tej mapy zwiększa ilość ludzi z błędnym przekonaniem. Że traktat wersalski był dla nas łaskawszy. A to bardzo źle. Nie jest to wielka strata w porównaniu z usunięciem, nie oszukujmy się, mistyfikacji. Czy gdyby to było fair use, też patrzyłbyś na użycie? Ja nie potrafię takiej rzeczy poprawić. Jeśli ktoś umie, powinien skasować przed załadowaniem poprawionej. A Autor był tu ostatni raz 6 sierpnia... Mistyfikacja. Nalegam. 22 użycia tylko potwierdzają tezę o szkodliwości. Zdjęcie okładki czasopisma było zrobione przeze mnie, licencja podwójna GFDL|cc-by-sa-all, fotka była opisana, podałem że ja jestem autorem. Kronika miasta Łodzi jest czasopismem bezpłatnym, finansowanym ze środków budżetowych Urzędu miasta Łodzi, więc nie jest copyright. Czemu zatem skasowano? This image shows copyrighted material. Otherwise than in the examples given by you in the discussion (File:Softdrinks in supermarket.jpg, File:Libreria San Gines.jpg and File:SanDiegoCityCollegeLearingRecourceCity-bookshelf.jpg) in this case the copyrighted elements are the chief motive. Thats the second time I deleted this image. Commons:Deletion requests/File:Bonduelle.tin.cans.JPG was an individual decision related to this image, so you can not simply ignore it or argue against it with an not yet decided deletion request. Use COM:UNDEL instead! The rule, that derivative works are not allowed on Commons as long as the derivative part is not de minimis or covered by freedom of panorama also applies to administrators. Hi! I contact you as you speak English and Polish.

Jastrow and I are working on autotranslating {{Meta information museum}}, the meta-template we use for many museums, like {{Information Louvre}}. Could you please help us find Polish translations for every tag name:

   * artist/maker
   * description
   * dimensions
   * credit line
   * accession number
   * location
   * source/photographer
   * references
   * other versions

"Credit line" is mainly about the mode of acquisition: what collection does it come from? Did it join the collections by gift, purchase, on loan, etc.?

Thanks for taking care of the old copyvio version of File:Pikachu.png. It was recently discovered that Nintendo used images of six of their characters in a US patent without including any of the required notices to prevent releasing those six images into the public domain; I had uploaded the other 5 already, but was waiting on the deletion of the old copyvio version of File:Pikachu.png before uploading the last patent image to that name. Bundesarchiv nie ma do nich większych praw niż Ty, ale sprawdźmy jak je uzasadni podobnie jak wiele innych wątpliwości.

A co do harmonizacji unijnego prawa, zobacz np. jak różne byłyby losy zdjęcia przykładowo rzeźby Dalego w różnych krajach.

Wikipedia zaś nie jest niczyją agendą, tylko projektem bardzo restrykcyjnie podchodzącym do praw autorskich. Sposób na to widzę dwojaki: doprowadzić albo do złagodzenia praw autorskich, albo restrykcji stawianych w projekcie. Metodę przymykania oczu na naruszenia albo swobodnego odczytywania intencji autorów lub ustawodawców nie uważam za właściwą.

Co do uzasadnienia usunięcia: błędna licencja, było {tl|PD-user}}, zaś niewątpliwie nie jesteś autorem, gdyż kopiowanie nie jest działalnością twórczą.

Co innego kiedy na ducha i intencje ustawy powołuje się w orzeczeniach sąd, który ma do tego gwarantowaną konstytucyjnie niezawisłość -- może się nawet pomylić lub palnąć głupstwo, to się często zdarza. My w praktyce musimy się poruszać z bezpiecznym marginesem. I tak np. wiele zdjęć nie jest utworami, bo nie ma znamion oryginalnej twórczości, żeby długo nie szukać to np. takie -- a mimo to gdybym nie określił jego licencji to by poleciało i nikt by nie próbował go ocalać argumentując, że sobie fotograf stanął i pstryknął i nie ma w nim grama indywidualności (chociaz to jest prawda). Z taką samą rezerwą muszę więc traktować Twoje zapewnienia, że układ typograficzny to wyłącznie rzemiosło, nie twórczość -- wielu typografów pewnie by tu zaczęło protestować.
Debata nad skanem z Bundesarchiv może być tutaj precedensowa; jestem przekonany że decycja powinna być za usunięciem, a jeśli przetrwa przy braku konkretnych argumentów prawnych uznam to za zwycięstwo głosu ludu nad bezduszną zasadą Commons:Licensing i wtedy Trybunę Ludu też przywrócę.
