Witaj i tu ;-). Nie do końca jeszcze wiem, jak tu się wstawia EK, więc osobiście do Ciebie: mogłabyś usunąć dwa zdjęcia z paskudnymi napisami: Image:Basztakrakowska.jpg (jest lepsza: Image:Sulejow wieza krakowska.jpg) oraz Image:Tympanon.jpg (jest Image:Sulejow tympanon.jpg)? Posprzątałam, nigdzie już ich nie ma.

Sprawa druga: mam pewne wątpliwości dotyczące poprawności licencji Image:AK-karzeł reakcji.jpg. Po pierwsze, to nie fotografia, po drugie, autor tego plakatu jest znany (pl:Zapluty karzeł reakcji). Pisałam już w tej sprawie do Szwedzkiego (u nas), ale mi nie odpisał. Pozdrawiam. Gytha 20:32, 30 April 2007 (UTC)

[edit] Grafiki - własność rządowa III Rzeszy i zasady autorskich praw materialnych

Szykuję się do przedstawienia do dyskusji całego pakietu spraw dot.

1. Grafik, których prawnym właścicielem był rząd III Rzeszy (np. MSZ III Rzeszy),lub agencje państwowe ( jak Deutsches NAchrichten Buro) - A NIE OSOBY PRYWATNE- prawa wygasły w maju 1945 po likwidacji III Rzeszy jako państwa -podmiotu prawa cywilnego. Prosi się o stworzenie Template:PD-NaziGov.

2. Zauważyłem ,że niektórzy aministratorzy (konkretnie-niemieccy) próbują wykorzystać dyrektywę harmonizującą EU dla generalnej blokady foto sprzed 1945 r.- niezależnie od proweniencji.

3.Tymczasem podstawową sprawą jest kwestia istnienia lub nie MATERIALNYCH praw majątkowych do dzieła, ktore są zbywalne i mogą ulec umorzeniu nawet przed datą śmierci autora.

4.Przykładowo - zdjęcie , do którego prawa zostały sprzedane np.Ilustrowanemu Kurierowi Codziennemu czy DNB,albo wykonane przez pracownika Ministerstwa Propagandy Rzeszy czy DNB , a osoba prawna uległa likwidacji bez następców prawnych prawa nabytego jest zdjęciem w domenie publicznej (prawo zbyte skutecznie nie wraca do zbywcy -autora)

5. Poza tym bardzo dużo starych zdjęć to zdjęcia legitymacyjne, paszportowe etc robione przez rzemieślnicze zakłady fotograficzne , które albo w ogóle nie są ( i nie powinny być )przedmiotem prawa autorskiego , albo jeśli traktować to restrykcyjnie - prawa do nich zostały zbyte przez wykonawcę (twórcę)- fotografa w chwili wyjścia klienta z zakładu fotograficznego po zapłaceniu za wykonanie zdjęcia, niezależnie od tego gdzie pozostał negatyw ( i nikt po wydarzeniach II wojny i komunizmu badać tego nie będzie)

6. Pozostaje kwestia zdjęć amatorskich - bez autorstwa. Jeśli już dziś niektórzy niemieccy admini chcą usuwać zdjęcia egzekucji dokonanych przez Wehrmacht w 1939 r vide : Commons:Deletion requests/Image:Ciepielow.jpg pod pretekstem dyrektywy harmonizacyjnej a zdjęcia z powstania w getcie warszawskim zostały usunięte to aż się prosi o rozwinięcie tematu.

A prawna sytuacja jest taka,że w prawie europejskim ciężar dowodu faktu spoczywa na osobie,która z tego faktu chce wyciągnąć konsekwencje prawne. Dotyczy to zarówno prawa karnego ( domniemanie nieiwnności) jak i cywilnego , którego częścią jest prawo autorskie. Tzn. o ile nie ma dowodu na zastrzeżenie prawa o tyle ono nie istnieje . W polskim prawie autorskim przerzuca to ciężar dowodu na autora ,zaś wydawca ma jedynie OBOWIĄZEK ZACHOWANIA NALEŻYTEJ STARANNOŚCI - tzn. wiedzieć to co może uzyskać przy zachowaniu zwykłych wymogów staranności. Prawo zakłada domniemanie dobrej wiary użytkownika rzeczy czy prawa tzn. ewentualne naruszenie prawa materialnego może stwierdzić tylko właściciel tego prawa zwracając się z żądaniem do użytkownika o zaprzestanie naruszenia prawa ( i udowadniając swój interes prawny). Tzn. trzeba wykazać naruszenie prawa.

Ponieważ jest to powszechna zasada prawa rzymskiego ,obowiązująca zarówno w prawie polskim, jak i niemieckim inne postępowanie jest uzurpacją i po prostu robieniem ludziom wody z mózgu poprzez świadome mieszanie pojęcia autorskiego prawa osobistego, autorskiego prawa materialnego, zasady należytej staranności, domniemania legalności i zasady cięzaru dowodu po stronie tego, który zgłasza zarzut naruszenia prawa.

Generalnie: często słyszany argument,że każda grafika ma autora należy uzupełnić następująco: KAŻDA GRAFIKA MA AUTORA ALE WCALE NIE KAŻDA MA WŁAŚCICIELA i nie ma to nic wspólnego z datą śmierci autora.

To takie wstępne uwagi , które IMHO warto przemyśleć w długi weekend a potem przegadać z innymi adminami na Commons i na wikipl.

No jasne, że to niemieckobrzmiące. Niechaj to narodowie! A serio, to obojętne zupełnie. Pliku Bocian bialy d używa mój bot (11 kont) na swoich stronach usera, więc jeśli usuniesz ten, to przy okazji popraw mi te strony. Cześć. Mogłabyś zwrócić uwagę na sprawę poruszoną w User talk:Kacperek66? Chodzi o pliki Image:Kk1.jpg i kolejne, obrazy Karola Kossaka, zmarłego w 1975 roku. Hi, I just realised I undid a change you made on the Category:Christmas food - ie I changed the category back to "Christmas" rather than "Christmas traditions". I was looking for "Christmas food" and couldn't find it - and when I did, I thought "traditions" was an odd place for this category. What was the reason you changed it? Witaj. Mam prośbę. Usuń tę grafikę. Ponad rok temu zrobiłem ją na czyjeś (nie pamiętam czyje) zamówienie jednak zamawiający zrezygnował się z jej wykorzystania. Czy mogłabyś zerknąć na wkład kartograficzny User:Bastet78. Osoba ta dodała swojego czasu sporo map (razem 15), twierdząc, że jest ich autorką (por. tutaj). Faktycznie są to dokładnie przerysowane mapy z Atlasu świata Służby Topograficznej Wojska Polskiego (Warszawa 1962) - na mapach zmieniono kolorystykę warstw hipsometrycznych (wysokosciowych) oraz dokonano, zapewnie nieumyślnie, wielu błędów przy przepisywaniu nazw geograficznych. Moim zdaniem wkład autorski do tych map jest jednak zbyt mały (przerysowanie, podmiana kolorów, błędy, lecz brak jakichkolwiek zmian w zasadniczej treści) by można je uznać za jej pracę własną, a nie zwykłe przerysowanie "żywcem" mapy z atlasu. W kartografii dokładne przerysowanie czyjejś mapy traktowane jest za jej skopiowanie. I tu ma zasadniczy wpływ modyfikacja treści, a nie grafiki. Mapy można, choć i to jet dla wielu dyskusyjne, wykorzystywać jako materiały podkładowe, które się generalizuje, przeskalowuje, dodaje treści z innych materiałów itp. Nawet genaralizacja, zmiana skali itp. nie jest pracą własną, w rozumieniu kartografii, jeśli korzysta się wyłacznie z jednej mapy jako podkładu (analogicznie jeśli ktoś napisze publikację na podstawie wyłącznie jednego źródła to jest to zwykły plagiat, a nie praca własna). W przypadku tych map wykorzystano wyłącznie mapy z atlasu wojskowego nie dokonując jakichkolwiek, nawet drobnych, modyfikacji ich treści (nie licząc ewidentnych literówek w nazwach geograficznych) ograniczając się jedynie do przekopiowania mapy (zamiana utworu w postać cyfrową nie jest pracą twórczą) i zmiany kolorystyki (tu można dyskutować, czy jest to praca twórcza). Zakładając jednak, że tak powstała mapa jest pracą twórczą (bo zmieniono kolory), to i tak nie ma prawa być na Wikipedii, gdyż nowe "dzieło" zawiera w sobie również dzieło pierwotne chronione prawami (analogicznie jeżeli wezmie się czyjąś fotografię Zamku Królewskiego i dorysuję na niej kontury zamku na fioletowo, to pomimo, że powstaje coś nowego, to "autor" tej nowej pracy nie ma do niej pełni praw, gdyż wykorzystuje pracę wcześniejszą i takie zdjęcie nie mogło by być na Wikipedii zamieszczone). Wyjaśnij mi jak to możliwe, że 90% ludzi tutaj nie jest w najmniejszym stopniu podobna do tych, których znam w prawdziwym świecie? Rozsądni, wyrachowani, z normalną hierarchią wartości. I nie wrażliwsi od dymu. Wiesz co jest normą na strzelnicy? Broń zawsze traktuje się tak jakby była odbezpieczona, załadowana i miała tendencje do samodzielnego wystrzału. Nawet jeśli na milę wygląda na zepsutą. A kto celuje w człowieka, temu biada. W aptece normą jest, że każdy specyfik nieznany lub z opakowania bez napisu traktuje się tak jakby był cyjankiem. A tutaj? Wszystko na odwrót. Cóż, dzięki Bogu, nie rozlegną się żałobne dzwony z powodu usunięcia hmed. Ale jeśli jakiś tabloid opowie o tej fotce, będzie nam łyso. Witaj! Omyłkowo przesłałem nie ten plik co zamierzałem..., po czym nadpisałem go poprawnym, jednak w podglądzie miniatury wciąż widnieje stara (niewłaściwa) wersja pliku. Mogłabyś usunąć zbędą wersję, zobacz Image:Dworzec Olsztyn 003.JPG. Namieszałem chyba również przy Image:Fontanna Ketrzyn 0003.JPG, gdzie miniatura jest ok (aktualna), a podgląd zdjęcia nieaktualny?? Nieco się pogubiłem (chyba z racji późnej już pory), ale podobny myx zrobiłem wcześniej Image:Olsztyn-Stare miasto3.jpg, jednak tam realtywnie wszystko było/jest ok?! Witaj. Nie siedzę w Commons i w związku z tym nie jestem obeznany zbytnio w klimacie Commons. Mam takie pytanie: Czy na Commons można ładować zdjęcia robione aparatem z telefonu komórkowego? Mam kilka "ładniejszych" ze swojego miasta i jak patrzyłem na kategorię Bydgoszcz jest ona trochę mała. Przede wszystkim chodzi mi o to czy mogą to być zdjęcia z osiedli czy też zdjęcia autobusów. Commons:Deletion requests/Image:Konigstein81.jpg is very interesting, and it would be nice if we could extract from it some useful policy or at least guidance as to how old postcards should be handled. I have hundreds which I could upload, but many will raise the same issues as this, and I don't want to have to go through the same old arguments every time. Even better would be to work out some rules on anonymous images generally, but I suspect from past discussions that that will be much harder. I am thinking of working up a policy page on postcards, at least. Czy możesz zmienić nazwę tej grafiki na prawidłową i niewprowadzającą w błąd? Cześć. Byłbym wdzięczny gdybyś spojrzała na opis tej grafiki i oceniła, czy zdjęcie każdego takiego preparatu mogę bez przeszkód zamieścić na wybranej przez siebie licencji? Szczerze mówiąc, to nawet nie wiem na pewno, czy wystawa należy do Katedry Patomorfologii, czy może jednak Medycyny Sądowej. Zapytałbym się może nawet na miejscu o możliwość wykonywania zdjęć i ich zamieszczania w internecie, ale wiem, że pracownicy uczelni raczej mają problemy z prawidłowym rozróżnianiem licencji. [edit] Kłopoty ze zdjęciem

Proszę o pomoc. Przygotowuję brudnopis notatki biograficznej o W.Szczęsnowiczu. Chcę zamieścić zdjęcie portretowe bohatera.Próbowałem już raz, nieudolnie i zdjęcie skasowano ("nieustalone autorstwo" itp.) Nie mam doświadczenia i gubię się w zawiłościach procedur. Teraz mam inne zdjęcie, ale nie chciałbym go również stracić! Jest to zdjęcie legitymacyjne, oryginał, dobrej jakości i wysokiej rozdzielczości. Zrobione w 1948 r. przez nieznanego zawodowego fotografa w Szkocji. Stało sie ono własnością/pamiątką rodziny. Mam problem z oznaczeniami: jaka licencja - co z autorem - właścicielem itd. Witaj. Chciałem uporządkować nieco swoje galerie i natrafiłem na dwie grafiki, które w jakiś sposób dorobiły się duplikatów. Są to dwie pary identycznych grafik a więc po jednej w każdej parze trzeba usunąć. Oto pary grafik:

Witam. Mam prośbę. Proszę o usunięcie z Commons grafiki i fotografie, na które wycofałem licencje na dowolne rozpowszechnianie. Znajdziesz je łatwo tutaj, ponieważ "świecą na czerwono" jako "no license tag!". Dodatkowo jeszcze kilka, które z różnych powodów nie wyskakują na automatycznym wykazie:

Ponieważ ktoś z administratorów zaczął rewertować moje zastrzeżenia, chciałbym za Twoim pośrednictwem przekazać informację. Z dniem 8 września 2009 r. wstrzymuję rozpowszechnianie grafik i fotografii za pośrednictwem serwerów Wikimedia Commons, których jestem autorem, a które użyczyłem Wikimedia Foundation. Od dzisiaj wszystkie one są objęte zastrzeżeniem zakazu dalszego rozpowszechniania i zgodnie z zasadami Wikimedia Commons, powinny zostać usunięte. Jest ich około 550. Jeżeli nie jesteś w stanie nadać biegu sprawie, przekaż tę informację w odpowiednie ręce. Oczywiście ufam, że administrator, który zrewertował moje zastrzeżenia prawne, przywróci je na właściwe miejsce. Niestety mój angielski nie jest na tyle dobry, abym mógł z nim dyskutować. Mam inne zdanie w tej kwestii, a zdanie powyższe pisał zapewne laik. No ale cóż, trzeba będzie rozstrzygnąć tę kwestię w inny sposób. Dyskusja tu i teraz nie ma sensu.
W międzyczasie wynikła inna sprawa. Otóż – wstawiłem do zasobów Commons 76 fotografii, których nie jestem autorem, a na zamieszczenie których otrzymałem wstępną, ustną zgodę ich autorów. Niestety, do dzisiaj nie dopełniłem formalności. Autorzy zdjęć nie przesłali do dzisiaj formalnej zgody na ich publikację do OTRS, co jest warunkiem niezbędnym. Ponieważ z drugiej strony wycofałem moje poparcie dla projektu Wikipedia i nie będę w dalszym ciągu gwarantował ustnej zgody, o której pisałem, dlatego zamieściłem w opisie tych fotografii szablon z informacją o formalnych brakach. Informacja ta została usunięta, co nie zmienia formalno-prawnej sytuacji tych fotografii. Wobec braku w OTRS zgody na publikację, fotografie te należy niezwłocznie usunąć. Poniżej zamieszczam listę fotografii, których to dotyczy:

Witaj Ludmiła. Mam pytanie odnośnie dodawanych grafik. Otóż ostatnio dodając fotografie zrobione przeze mnie bot przesyła mi wiadomość o braku kategorii z tym, że ładując pliki dodaje kategorie np; foto Przasnysza daję kategorię Przasnysz i nie rozumiem czemu potem nie ma tej kategorii. Nie znam języków obcych żeby go zapytać. Jak byś mogła mój wkład doglądnąć i sprawdzić w czym jest problem, jeżeli to oczywiście możliwe. Pozdrawiam! mariusz (talk) 08:24, 24 September 2009 (UTC)

Witaj Ludmiło, zamieściłem dzisiaj taki sztandar. Niestety miniatura, która wyświetli się również na stronie, nie oddaje kroju liczby "37" zgodnie z oryginałem. Po kliknięciu na miniaturę obraz wyświetlany jest prawidłowy (liczba). Ponieważ zależało mi na czasie, wysłałem drugi plik pod zbliżoną nazwą to ten] i znów to samo.
