Why was deleted de file Lega-Hospi2014.JPG in WikiCommons? The source is this web It was allowed under commons 3.0, as you can see in the web. The other derivated from this image and, if I don't understand, a derivated work can't be hosted in WikiCommons.--Miguelazo84 (talk) 21:21, 11 January 2015 (UTC)

Please see your talkpage. The license of that website is Creative Commons Reconocimiento-NoComercial-SinObraDerivada 3.0 España which is not a free license because it disallows commercial reuse and modification. Wikimedia Commons can only host free content. Restrictions on where or how a file can be used are not acceptable here. See Commons:Project_scope/es#Debe estar bajo licencia libre o en dominio público. --Martin H. (talk) 21:25, 11 January 2015 (UTC)
which is the conmercial use?--Miguelazo84 (talk) 21:34, 11 January 2015 (UTC)
Only "by-sa" (Attribution-ShareAlike), "by" (Attribution), and "sa" (ShareAlike) licenses are permitted. All "nc" (Noncommercial) and "nd" (No Derivatives) licenses are not acceptable. Why commercial reuse must be allowed for inclusion in our free content projects is outlined in Commons:Licensing. Freedom as defined in is the core principle of our projects. --Martin H. Alfred Krauth[edit]

Hallo Martin H.,

--Martin H. (talk) 20:25, 15 January 2015 (UTC)
Sind gelöscht. Gruß --Rosenzweig τ 22:56, 16 January 2015 (UTC)

Response to message[edit]

Thank you for your message, Martin. This is a question I've had for awhile: when I take a photo of a piece of art, do I own the rights to the photograph and/or can I use it on Wikipedia without worry of copyright infringement?

In the U.S. case law denies copyright for faithful reproductions of 2D artworks created by photography or similar processes, see COM:ART. In case there is a copyright on the photo You do own the copyright on the photograph, but the photograph is a derivative work of the painting. The copyright holder of the painting has to agree to any publication. --Martin H. (talk) 20:17, 17 January 2015 (UTC)

Robin Windsor image from Flicker[edit]

Hello Can you explain why the image for Robin has been deleted, it is from Flickr, it has a common licence 2.0 which was referenced and the URL was linked as well? Thanks

The license is unfree, commercial reuse and modification isnt allowed. See Commons:Licensing and Commons:Project scope#Must be freely licensed or public domain. -Martin H. (talk) 19:13, 24 January 2015 (UTC)

. Hello! It is the Hungarian name of the book (Felvidékünk - Honvédségünk / Trianontól-Kassáig), publishers (Vitézi rend Zrinyi csoportjuának kiadása, Budapest, 1939). Free is because it has more than 70 years. I do not know English so please give thee there a source, if not as a reset I will not deal with it. I do not care, more pictures do not photograph well. Thank you!--Luppus (talk) 07:52, 8 February 2015 (UTC)

File:President Joko Widodo in Official Portrait 2014.jpg[edit]

Martin, could you briefly explain why did you tag that file? It seems to comply with the license. Materialscientist (talk) 23:15, 15 February 2015 (UTC)

The publication contains a copyright notice. The copyright tag not applies if "the Copyright is declared to be protected by law or regulation or by statement on the work itself or at the time the work is published". --Martin H. (talk) 18:44, 17 February 2015 (UTC)

Flickr copyright[edit]

hi, I am writing to ask if I go to the site Flickr, and I find a 'image d' era where I know the 'author and I know that has been dead for 70 years, however, the picture belongs to an' other person l 'has loaded, but you could upload that same image, knowing that the 'author died and then the copyright has expired? :) -- 10:12, 16 February 2015 (UTC)

Discussion of image description formatting[edit]

Hello, Martin. There is a proposal for a style guideline for image descriptions at the Village Pump. Previously, you have expressed an opinion about such formatting. Please feel free to join in the discussion! — hike395 (talk) 18:20, 18 February 2015 (UTC)

Pictures deleted[edit]

I have seen you have deleted ALL the pictures. I must think now that I have to re upload those that you mentioned (cat, ribbons?). Those with the AEAColl in their back were also mine. I can reupload them then?

Morover, I would like you to tell me about the Coats of Arms? I am the Representant of the Bourbons of Bhopal in Andorra and I was asked to create the coat of arms. It is my own work. Give me an email and I will show you evidence of that. Same with the Andorran arms.

You erased all the ribbon pictures, even if you said I could keep them as own work, because they ARE! Now I have to go page per page replacing the ribbons!!

File: Amelia Valcarcel.jpg[edit]

Greetings, relative to the image: Amelia Valcarcel.jpg I am the author of this photograph. If has been used on occasion I have rights and it is ok the licensed in Flickr Mujeres en Red referenced in the photography. Not applicable deletion at all. We can talk in Spanish? Thaks!

See answer on your talkpage: I started a deletion discussion, discussion can take place there. --Martin H. (talk) 10:53, 26 February 2015 (UTC)

File tagging File:Morning stretch.jpg[edit]

I was granted written permission from the copyright holder for the use of this photo after i explained the terms of the commons licence. This is the conversation:

[conversation removed]

I always seek permission from the copyright holder before I upload any image to wikipedia (the same is true for all the images I have uploaded and I can provide written authorization for all). Please let me know if you need anything further. --Geneticcuckoo (talk) 23:15, 25 February 2015 (UTC)

Forwarding the copyright holders written permission to COM:OTRS is always required. There is an email template at Commons:Email templates#Declaration of consent for all inquiries. --Martin H. (talk) 10:56, 26 February 2015 (UTC)

Files by Mboix[edit]

Please close the deletion request and explain in detail what Mboix needs to do to prove they took the pics. You should have engaged before opening the deletion request. Those pics are legit, we are going to be doing events in Spain to upload similar high quality pics, and the last thing we need is someone like Mboix who is friendly to free licenses and wishes to upload to Commons to be utterly discouraged by random deletions and silence. I kindly ask you to take responsibility, and lead this new user through this. Thanks --Raystorm (¿Sí?) 00:10, 26 February 2015 (UTC)

The deletion discussion is the perfect place. It is open for comments in any language. Im not able to explain copyrights to a spanish user, particularily here where the user already got a wrong understanding of licensing. For example uploading various photographers works to flickr and using flickr for license laundering. --Martin H. (talk) 10:51, 26 February 2015 (UTC)
It's a horrible way for a new user to figure out how commons works. I am aware of your opinion on the matter, but that is not relevant: what has been asked of you is to please explain how Mboix can prove authorship in a satisfactory manner. If you are unable to do so, please point me to someone who does know so we can all stop wasting our time and energy like this. Raystorm (¿Sí?) 19:29, 26 February 2015 (UTC)
Simple. For self created photos upload the original files. Using flickr for licensing instead of uploading to Commons direclty is worst practice but ok, its an acceptable method. The question here is if the flickr account is a fake account or a photographers account, finding copies of facebook images on flickr doesnt make it look like a photographers account.
For not self-created photos provide written permission to COM:OTRS. Uploading not self-created files to flickr first is not helpful here, it will never make things easier and it is not a way to bypass our processes.
Remember that the user (account) on Commons always is one person. An employee who operates an account for a company always uploads not self-created works. --Martin H. (talk) 20:40, 26 February 2015 (UTC)
Thank you for this. I think photographers find easier uploading pics to flickr than commons. How could mboix prove the flickr account is legit? I will explain in Spanish about uploading the originals here, but perhaps it is far easier to prove that the flickr account it is a photographers account. How do we do so? Raystorm (¿Sí?) 17:29, 27 February 2015 (UTC)
Mboix has uploaded the original, does this serve? --Raystorm (¿Sí?) 22:57, 27 February 2015 (UTC)
For the photo File:Amelia Valcarcel.jpg sure, for the photos with different author information see Commons:OTRS. --Martin H. (talk) 15:54, 28 February 2015 (UTC)
I read otrs has a backlog of 45 days. Will the pics be deleted in the meantime? Any chance of closing the deletion request while the bureaucracy is happening? Raystorm (¿Sí?) 11:57, 1 March 2015 (UTC)
