En el sitio de la Universidad de Chile, propietaria, supongo, del Archivo Fotográfico si bien se dice que los contenidos son libres y gratuitos especifica que el uso de los contenidos para uso comercial no se podrá realizar sin permiso, es decir, son libres y gratuitos para fines educativos o uso personal, dicho sea de paso las legislaciones de propiedad intelectual, entre ellas la chilena, ya suelen permitir el uso de materiales protegidos sin permiso del autor en el ámbito de la enseñanza y es común aceptar que al exponer contenidos en la red se está, de hecho, permitiendo el uso personal de los mismos. Pero ni uno ni otro es el caso de la wikipedia que además de redistribuir los contenidos (uso no personal) no impide su explotación (uso comercial) y bien podría hacerla en el futuro la propia fundación WikiMedia. Son multitud los sitios en las que se dan las mismas restricciones: páginas gubernamentales de muchos países, portales educativos de universidades y centros de enseñanza, asociaciones profesionales, páginas personales, etc...
Yo creo que en tales condiciones no se pueden traer aquí esos contenidos. Es un fastidio, es un engorro, es lo que quieras llamarle, pero es lo que hay y no debe olvidarse el hecho de que wikipedia nació con el ánimo de combatir ésta situación, si nos aplicamos las mismas restricciones la situación no hará mejorado mucho.
De lo que sí estoy seguro es que ninguna ley chilena te permite licenciar un trabajo ajeno, por favor te ruego encarecidamente que no hagas cosas como la que sugieres de colgarle el cartelito {cc-by} u otro similar a ninguna foto que no sea tuya, salvo que lo lleve la original, claro. Si te das cuenta las únicas imágenes que no llevan cartelito de licencia son precisamente las fair use, si wikipedia (o tú) no posees los derechos de reproducción de la imagen dificilmente podrás exigir a nadie cómo debe hacer dicha reproducción. Hi - several of the images you uploaded are listed on Commons:Untagged_images#M, because they have no license info. Please add the appropriate Commons:Copyright tags to the images description pages, as images without license info will have to be deleted. Thanks for uploading Image:Castro Khrushchev.jpg. I notice the image page currently doesn't specify who created the content, so the copyright status is unclear. If you have not created this media yourself then you need to argue that we have the right to use the media on Wikimedia Commons (see copyright tagging below). If you have not created the media yourself then you should also specify where you found it, i.e., in most cases link to the website where you got it, and the terms of use for content from that page. If the content is a derivative of a copyrighted work, you need to supply the names and a licence of the original authors as well.
If the media also doesn't have a copyright tag, then you must also add one. If you created/took the picture, audio, or video then you can use {{self|cc-by-sa-2.5}} to release it under the Creative Commons or {{PD-self}} to release it into the public domain. See Commons:Copyright tags for the full list of copyright tags that you can use.
Note that any unsourced and untagged images will be deleted one week after they have been uploaded, as described on criteria for speedy deletion. If you have uploaded other media, please check that you have specified their source and copyright tagged them, too. You can find all your uploads using the Gallery tool. Thank you. Please help replace this outdated license[edit]
Hello!
Thank you for donating images to the Wikimedia Commons. You have uploaded some images in the past with the license {{PD}}. While this was a license acceptable in the early days of Wikimedia, since January 2006, this license has been deprecated and since October 2008 no new uploads with this license was allowed.
The license on older images should be replaced with a better and more specific license/permissions and you can help by checking the images and adding {{PD-self}} if you are the author or one of the other templates that you can see in the template on the image page.
