Witam ponownie! O tym, czy dany tekst jest utworem czy nie, decydują nie okoliczności jego powstania ani liczba autorów, lecz stopień pierwiastka twórczego i indywidualnego... Oboje się zgadzamy, że tutaj raczej nie ma mowy o twórczości indywidualnej, jednak inni mogą sądzić inaczej. Jeśli Twój ś.p. Ojciec był głównym autorem rezolucji, a inni wnosili drobne poprawki nie znaczące dla treści, to jako jedyna spadkobierczyni masz prawo do dysponowania ewentualnymi prawami autorskimi do tekstu: dla wszelkiej pewności zatem należałoby zmienić szablon licencji na wybrany przez Ciebie (jeśli nie chcesz w żaden sposób ograniczać rozpowszechniania i modyfikacji tekstu, to byłoby to PD, jeśli chcesz np. wymagać uznania autorstwa, to któraś z wersji Creative-Commons oraz GFDL) i potwierdzić to emailem na permissions-pl@wikimedia.org. Jeśli licencja miałaby być inna niż "własność publiczna", to sugeruję podwójną GFDL i Creative Commons, co umożliwi 1) włączenie do Wikiźródeł 2) nieograniczoną dystrybucję, modyfikację i wykorzystanie komercyjne, pod warunkiem podania autora i zachowania tych samych warunków licencji. Co do formatu: sama rezolucja jest czystym tekstem, zatem najwłaściwszy dla niej jest format czysto tekstowy, a właściwym miejscem są Wikiźródła - dyski Fundacji mają jednak prawie nieograniczoną pojemność i PNG mogłoby zostać... Zwróć jednak uwagę, że w takiej formie jest po pierwsze: nieodpowiednie np. dla wygodnego cytowania przez mechanizm kopiuj-wklej, po drugie: nieczytelne dla osób niewidomych. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

  • ale to nie moja wina, ze przypisujesz sobie autorstwo i nadajesz falszywe licencje. Nie wiem czy swiadomie, czy nie, ale reaguje tak samo, jak na kazde inne naruszenie praw autorskich. Bo az mnie zaintrygowaly twoje slowa: Na każdy zesłany mam 500 % zgodę autorów i właścicieli. BTW - posiadanie pracy (lub wystepowanie na niej), nie ma zazwyczaj zadnego zwiazku z prawami dysponowania nia. Tj. ja moge miec czyjs obraz nie oznacza, ze automatycznie nabywam do niego prawa autorskie. Stad zgody wlascicieli nie maja nic do rzeczy. A ladowanie plikow znalezionych w necie albo screenshotów i podpisywanie sie jako ich autor, to zwykla kradziez - tutaj zgody osob przedstawionych na zdjeciu takze nie maja znaczenia. I sadze, ze to tu wlasnie tkwi problem: sadzisz, ze zgoda wlasciciela, albo podmiotu przedstawionego na pracy wystarczy. Otoz nie wystarczy, bo prawa autorskie posiada autor, co wiecej nawet gdyby, to istnieje takze specjalny system "księgowania" zgod, gdzie sie je nadsyla. Czas ustnych zapewnien niestety minal. To, ze ktos jest na zdjeciu lub je posiada, nie ma zadnego znaczenia, jak nie jest jego autorem. Zauwaz, ze dalej moze go uzywac - bez problemu. Ale sprzedac czy czerpac zyski (chyba ze takze lamiac prawo) juz nie moze. Przyrownaj to do sytuacji, ze ja kupuje obraz zyjacego (lub niedawno zmarlego) malarza - czy sadzisz, ze mam prawo robic jego reprodukcje i je sprzedawac? Wiem, ze chcialas sobie uproscic zycie, ale dzielenie sie swoja wiedza (jak na Wiki), czy wolnymi zasobami multimedialnymi (jak na Commons), nie ma polega na upraszczaniu sobie zycia, ale na odpowiedzialnym i uczciwym podejsciu do korzystajacych z tych tresci. Sciaganie zdjec z netu, przypisywanie sobie autorstwa, i nadawania falszywych licencji napewno nie jest uczciwe, mimo ze zapewne kierowalas sie dobra wola i checia. Co do zgod - zapoznaj sie z tekstem (z plwiki, ale to ma zastosowanie takze do zdjec tutaj): na temat zgód i ich przesylania. Zerknij takze na akapicik ponizej. Zapoznaj sie takze z zasadami wolnych licencji, bo to dosc specyficzna sprawa, zupelnie rozna od publikowania w prasie, czy w pracy naukowej, albo ksiazce - gdzie zasady sa inne. Wskaz tez prosze stad, ktore fotki NIE SA twoje, a podpisalas je jako swoje. Powinny one zostac poprawnie opisane (podany autor i zrodlo) i jak ma to zastosowanie, winna byc przeslana zgoda (link wyzej). Tworzenie wolnej encyklopedii to takze pewne obowiazki - szczegolnie wobec samego siebie (uczciwosc obywatelska), ale i wobec czytelnikow. Tak samo jak nie wprowadzamy falszywych informacji w haslach, tak samo nie powinnismy falszywie opisywac plikow (czy przypisywac sobei autorstwa). Trzeba byc odpowiedzialnym, szczegolnie, ze wiekszosc rzeczy da sie zalatwic, tylko nalezy sie spytac co i jak, a nie dzialac w przeswiadczeniu, ze z dobra wolą wszystko bedzie ok.     • No więc tak, po kolei. Na temat zdjęć "Doliny Szwajcarskiej" rozmawiałam z kimś i doszliśmy do consensusu dwa lata temu. Nie wiem więc czego chcesz od Salonu. Grafika ma ze 150 lat mam ją w zbiorach domowych, jest anonimowa, wyskanowałam z zasterzeżeniem autor nieznany prawa autorskie wygasły. O co jeszcze chodzi ? Oczywiście pojawia się ona w innych miejscach w internecie dlatego, że to ja ją wielu osobom udostępniłam.

Jesli chodzi z zdjęcia Pana ATK z Jarkiem i z Bronkiem - te możesz skasować choćby dlatego, że są źle nazwane i nie wyszukuje się ich pod nazwskzmi ani pana Kijowskigo ani Kaczora czy Wildsteina. To akurat zdjęcia zawodowców, którzy dali je w prezencie mówiąc, że można wykorzystywać bez podawania autorstwa i nie trzeba ich podpisywać. Możemy je oczywiści podpisać byle udzielanie zgody nie wymagało od nich zbyt dużo zachodu. Można coś dać, natomiast jak trzeba pisać tyciąc karteczek to się człowiekowi odechciewa, To chyba jasne.

  • czyli to NIE twoje zdjecia. Zatem jak nie chcesz ich podpisac i przesylac zgod, to rzeczywiscie nalezy je skasowac.


Podobna sytuacja jest z Chodorowskim i Wolnia. To prezenty ze zgodą na dowolne wykorzystywanie ( ale tylko w internecie) nie zamieszczam więc ani nawet nie mamy skanu nadającego się do druku w książce czy na jakąś wystawę. Pan Kijowski umieszcz je na wszystkich swoich portalach i chyba ma do tego prawo. Z Wolniak tak jak z fotografami jest zgoda, co musiałabym zrobić by ją uwiarygodnić. A Chodorowski nie żyje. Spadkobiercą praw do tego obrazu jest chyba jego właściciel a nie rodzina. Więc co mam z niego ( Kijowskiego) wydębić ?

Ponadto To prezenty ze zgodą na dowolne wykorzystywanie (ale tylko w internecie) to nie zgoda na dowolny uzytek, zatem nalezalo je skasowac. Co do zdjęć pani Czekierdy już nikt nie pamięta kto które robił. Część pewnie ja, może któreś ktoś inny. To zdjęcia z jej albumu do dowolnego wykrzystywania. W końcu podpisując się jako producent ("Poezja") nie zabieram nikomu własności. Sprzedawać musiałabym jako Wanda Adamska, a tego właśnie nie czynię. Wszyscy autorzy ( w tym ja ) pozwolili pani Czekierdzie udostępnić publicznie te zdjęcia. Sorry, ale nie wiem na jaką przełożyć to licencję. Ta pierwsza moje, zrzeczenie praw i nazwiska - wydawała mi się najbezpieczniejsza i najuczciwsza. Ale może jest jakaś jeszcze bardziej akuratna ?

A jesteś pewna, że wyjaśnia to sytuację prawną tych nagrań? Zgodnie z ustawą:

Art. 12.
1. Jeżeli ustawa lub umowa o pracę nie stanowią inaczej, pracodawca, którego pracownik stworzył utwór w wyniku wykonywania obowiązków ze stosunku pracy, nabywa z chwilą przyjęcia utworu autorskie prawa majątkowe w granicach wynikających z celu umowy o pracę i zgodnego zamiaru stron.

Co do tego, jak to się formalnie załatwia; napisz email do permissions-pl@wikimedia.org z listą plików (możesz ją ustalić np. na tej stronie, ważne żeby wymienić wszystkie z nazwy), z wyjaśnieniem kto jest włąścicielem majątkowych praw autorskich, jaka była umowa zawarta z telewizją (i czy obejmowała odrębnie prawa autorskie) no i wreszcie: na jakiej licencji mają być udostępnione. Biorąc pod uwagę Twoje wcześniejsze problemy z respektowaniem praw autorskich z góry zapowiadam, że zamierzam wyjątkowo skrupulatnie skontrolować co też konkretnie znalazło się w tym emailu i czy wszystkie wątpliwości zostały wyjaśnione. Adres podałem powyżej (permissions-pl@wikimedia.org), szablon: można umieścić gdzie Ci pasuje, ja bym proponował albo na samej górze, albo na samym dole, albo w polu Permission. Do OTRS możesz pisać normalnie po polsku, bez żadnych wzorców zgłoszenia, jak czegoś zabraknie, to operator po prostu się o to dopyta. Powodzenia! A.J. (talk) 13:39, 23 September 2009 (UTC)[reply]

  • Więcej plików: jeśli podstawa jest taka sama, to moim zdaniem wystarczy powoływać się na ten sam numer OTRS (ja bym jednak dla formalności wysyłał, powołując się na już uzyskany "ticket")
  • Logo: trudna sprawa; zwłaszcza jeśli majątek firmy przejął syndyk, komornik albo Skarb Państwa, bo wtedy nie bardzo nawet wiadomo kogo pytać. Ja sam bym nie umiał tego przeprowadzić, więc nawet nie potrafię doradzić, od czego zacząć. Według zasad Commons trudności w ustaleniu właściciela praw autorskich nie są żadnym argumentem a wręcz przeciwnie: przesądzają o usuwaniu materiałów.
