AGREEMENT FOR COLLABORATION

- BULGARIAN ARCHIVES STATE AGENCY (BASA)

- names, ID number, address and function in the Wikipedian community,
- also known as REPRESENTATIVE OF WIKIPEDIA
Taking consideration of the benefits from establishing a mutually favourable collaboration, aimed at the promotion and development of their inherent missions and functions, based on the intention of the BULGARIAN ARCHIVES STATE AGENCY to popularize the archive documents treasured in the Archives, and the intention of WIKIPEDIA to expand and develop the virtual encyclopaedia, the two PARTIES reached the following agreement:
І. BULGARIAN ARCHIVES STATE AGENCY, in its capacity as the institution, which by virtue of the National Archives Act manages the documents from the Bulgarian national archives, grants the REPRESENTATIVE OF WIKIPEDIA access to the archive documents treasured in the Archives while observing the established normative acts and internal regulations for access to and usage of the archive documents.
- 1. BASA commits to provide the REPRESENTATIVE OF WIKIPEDIA with the resources needed for preparation of digital copies (digitization) of archival documents: photographs on paper or other material medium, with the REPRESENTATIVE's own technical equipment (including, scanning, photographing, optical character recognition and/or typesetting).
- 2. BASA provides the REPRESENTATIVE OF WIKIPEDIA with the digitized copies of archival documents, under the provision that get uploaded to the multimedia repository of WIKIPEDIA under the public domain, using the template http://commons.wikimedia.org/wiki/Template:BASA-cooperation and categorized into relevant thematic categories, as well as into the category http://commons.wikimedia.org/wiki/Category:Images_from_the_Bulgarian_Archives_State_Agency, clearly indicating the document source BULGARIAN ARCHIVES STATE AGENCY.
- 3. BASA is not to be held responsible:
- 3.1. for the way of interpreting and using the information, contained in the digitized archival documents;
- 3.2. when the use of the archival documents is in conflict with the stipulations of the Law on Copyright and Neighbouring Rights, or other laws;
- 3.3. for unfair use and abuse of archival documents.
ІІ. THE REPRESENTATIVE OF WIKIPEDIA, in his/her capacity of a volunteer for the development of the electronic encyclopaedia, and in accordance with the WIKIPEDIA's guiding principles, agrees to act in good faith when putting into effect the present agreement.
- 1. THE REPRESENTATIVE OF WIKIPEDIA will perform digitization activity within the working hours of the visitors reading rooms of the BULGARIAN ARCHIVES STATE AGENCY, and he/she commits:
- 1.1. to upload under his/her username ....................... digital copies of archival documents into the multimedia repository of WIKIPEDIA (http://commons.wikimedia.org), attributing the documents with the source BULGARIAN ARCHIVES STATE AGENCY, and precisely recorded document identification data (Fonds signature and title, Inventory number, Archival unit number, Sheet number, Document title), as well as linking to the website of the BULGARIAN ARCHIVES STATE AGENCY (http://www.archives.government.bg);
- 1.2. to publish in the multimedia repository of WIKIPEDIA digital copies of the documents with their technical parameters, which the BULGARIAN ARCHIVES STATE AGENCY publishes in its website (http://www.archives.government.bg);
- 1.3. to provide information about the digitized and uploaded copies of the archival documents to the following emails within one day after the upload: (3 official email addresses)
- with the data of the number and type of digitized copies, with precisely recorded document identification data (Fonds signature and title, Inventory number, Archival unit number, Sheet number, Document title), as well as the URL of the uploaded copy in the multimedia repository of WIKIPEDIA;
- 2. THE REPRESENTATIVE OF WIKIPEDIA agrees not to use the data obtained in the course of this agreement for other purposes before publishing them in the Internet through WIKIPEDIA to popularize BASA and the treasured archive documents which are part of the National archives of Bulgaria.
- 3. After uploading the documents to the multimedia repository of WIKIPEDIA, the REPRESENTATIVE OF WIKIPEDIA is not to be held responsible:
- 3.1. for the ways of interpreting and utilizing the information, contained in the archive documents, by the users of WIKIPEDIA;
- 3.2. when the usage of the archive documents by users of WIKIPEDIA contradicts the Copyright and Related Rights Act, or other laws;
- 3.3. for any bad faith usage and abuse of the archive documents by the users of WIKIPEDIA.
ІІІ. The sides agree that separate elements from the documents may be published with higher resolution, whenever this is necessary to ensure their identification.
ІV. This agreement is signed for a term of 6 months, as of the date of its signing. After the evaluation of its effectiveness and benefit for both sides, and in case of need, the agreement will be renewed. In case of misfeasance of the above clauses of the agreement, each of the sides may disclaim from the agreement, at any moment before the end of the six-month term.
The present agreement, containing three pages, was composed in two identical copies - one for BULGARIAN ARCHIVES STATE AGENCY and one for the representative of WIKIPEDIA, and was signed by both sides.
