Descobrindo o porquê um arquivo foi apagado

Primeiro, veja o registro de eliminação e veja o porquê um arquivo foi apagado. Utilize também o recurso Páginas afluentes para verificar se existe alguma discussão com ligação ao arquivo apagado. Se você é o responsável por carregar o arquivo, procure em sua página de discussão alguma mensagem informando o motivo da eliminação. Em seguida, veja novamente a política de eliminação, o escopo do projeto e a política de licenciamento para verificar o motivo do arquivo pode não ser permitido no Commons.

Caso o motivo dado não seja claro o suficiente ou você deseja contestá-lo, você pode contactar o administrador responsável pela eliminação e pedir maiores esclarecimentos ou fornecer evidências contra o motivo da eliminação. Você também pode contactar qualquer administrador ativo (talvez um deles fale seu idioma)—a maioria se mostrará feliz em ajudar e se um erro foi cometido, corrigir a situação.

Contestando uma eliminação

Eliminações que estejam corretamente baseadas nas políticas de eliminação, escopo do projeto e licenciamento não serão desfeitas. As propostas para mudanças das respectivas políticas deverão ser feitas nas suas páginas de discussão.

Se você acredita que o arquivo em questão não seja uma violação de direitos autorais tampouco esteja fora do escopo do projeto:

Restauro temporário

Os arquivos podem ser "temporariamente" restaurados seja para auxiliar uma discussão de restauro ou para que seja possível a transferência do mesmo para um projeto que permita seu uso através do fair use. Use a predefinição {{Request temporary undeletion}} na respectiva solicitação de restauro e forneça uma justificativa.

  2. se o restauro temporário é para permitir a transferência a algum projeto fair use, informe qual projeto você pretende transferir o arquivo, fornecendo um link para sua declaração de fair use.

Para auxiliar a discussão

Os arquivos podem ser temporariamente restaurados para auxiliar sua discussão, caso seja difícil aos usuários decidir se o pedido de restauro deve ser atendido sem acesso ao arquivo. Quando uma descrição do arquivo ou a citação da página de descrição do arquivo for suficiente, um administrador poderá fornecê-la ao invés de proceder o restauro temporário. Os pedidos podem ser rejeitados caso sua utilidade à discussão seja superada por outros fatores (como o restauro, mesmo temporário, de arquivos onde existam preocupações substanciais relativas a Fotografias de pessoas identificáveis). Arquivos temporariamente restaurados para auxiliar a discussão serão apagados novamente após trinta dias, ou quando o pedido de restauro for encerrado (o que ocorrer primeiro).

Para permitir a transferência do conteúdo fair use para outro projeto

Ao contrário da Wikipédia lusófona e de alguns outros projetos Wikimedia, o Commons não aceita conteúdo protegido com referência as normas de fair use. Se um arquivo eliminado atende aos requisitos de fair use de outro projeto Wikimedia, os usuários podem solicitar o restauro temporário para possibilitar a transferência do arquivo. Normalmente estes pedidos são atendidos rapidamente. Arquivos restaurados com o propósito de transferência serão eliminados novamente após dois dias. Quando solicitar o restauro temporário, por favor informe para qual projeto você pretende transferir o arquivo e informe o link da declaração de fair use do projeto.

Adicionando um pedido

Primeiro, certifique-se de que você tentou descobrir porque o ficheiro foi apagado. Depois, leia as instruções a seguir de como escrever o pedido antes de adicioná-lo:

  • No campo Assunto/cabeçalho: digite um assunto apropriado. Se você está solicitando a restauração de um único ficheiro, um título como [[:Image:DeletedFile.jpg]] é aconselhável. (Lembre-se de colocar os dois pontos ":" no início.)
  • Identifique o(s) ficheiro(s) para os quais você está pedindo a restauração e forneça links para as imagens (veja acima).   • Indique o(s) motivo(s) para a pedido de restauração.

This request has been sitting around for nearly a month now. Pinging the six admins that we have that are native Portuguese speakers (Beria, Dantadd, Darwinius, Érico Júnior Wouters, Teles and Waldir).
If I understand the request correctly, the uploader claims that the coat of arms in question "is for public use and has no known copyright", but this claim seems to be unsubstantiated. It is possible that {{PD-BrazilGov}} applies, but it would need to be demonstrated that the coat of arms was first published prior to 1983. LX (talk, contribs) 15:10, 20 July 2015 (UTC)

You didn't mention a filename. Are you talking about File:Umberto Boccioni arciere BS.JPG? When you uploaded it, you said you didn't know who created it, and that it was created around 1915. It looks like it's a "CC BY 3.0 US" image embedded in a "CC BY-ND 3.0" page, in which case the image itself should be OK. --ghouston (talk) if that is the case can you restore the image. or find an administrator who canJonnymoon96 (talk) 21:48, 27 July 2015 (UTC)

Als Neuling verstand ich das Hochladen von Bildern auf Wikimedia bezüglich Lizenzierung nicht. Hatte mehrere Versuche gemacht, scheiterte aber jedesmal. A skilled automotive customiser has taken a drivable vehicle and replaced the standard body panels with customised ones that make the vehicle look like a cartoon character, but the car remains drivable. Image is not a sculpture but a {{Useful-object-US}} (or whichever country the photo was taken; it looks to be a motorshow in the UK): one cannot remove the customised body from these vehicles and leave nothing in its place without affecting the utilitarian aspects of the motorcar, as these body parts are not merely decorative - they protect the mechanical workings of the car from the elements, just like the standard body panels would have. As such, the deletion of the image is erroneous. Furthermore, the image does qualify for fair use on en.WP as w:Eddie Paul discusses this specific group of automotive customisations, including this specific vehicle. Clearly, en.WP should be hosting these images locally instead of here if the result of upload here is that legitimate content which is in active use is disappearing in this manner. Please undelete this to upload it to en.WP directly, fair use for w:Eddie Paul as an encyclopaedia article which discusses the making of this specific three-dimensional article. Porém, preciso que a foto seja incluída novamente, pois não adiantaria nada eu fazer o upload da mesma e vocês deletarem de novo. Não sou uma usuária ativa, pois criei a conta somente para fazer a página dela.

I think the problem that Hedwig in Washington has highlighted is that unfortunately the template {{Acrofan.com}} does not accurately reflect the contents of OTRS ticket 2012112610002772, as the ticket only authorizes a single photo to be CC-SA-3.0. If his summary of the ticket is accurate (and I have no reason to doubt him as he is highly reliable in these matters), then I think we might have to delete {{Acrofan.com}} and the files that rely upon that template (except for the one photo authorized, which can be changed to use {{cc-by-sa-3.0|attribution=ACROFAN}} and {{PermissionOTRS|2012112610002772}} directly). —RP88 (talk) 04:08, 2 August 2015 (UTC)
Although I personally cannot access OTRS, I think that the "ONE single photo" seems to mean an example of the photos of acrofan.com.

Since you've questioned this, I've posted a request at Commons:OTRS/Noticeboard#Template:Acrofan.com asking an OTRS volunteer to look into whether or not {{Acrofan.com}} accurately reflects the ticket. In normal situations, since it is a photograph focusing on a poster, the photograph is a derivative work of the other photograph on the Madonna poster. In that case, we need a license for both the photograph (which Flickr provides) plus a license for the underlying work (which we do not have). Some countries have freedom of panorama, which can allow photographs of public works. For this case, we would have to be able to apply {{FoP-Sweden}}, which states that A work of art may be depicted if it is permanently placed on or at a public place outdoors. Buildings may be freely depicted. The Madonna photo is a work of art, and it is in a public place outdoors. However, the question here is permanently placed, which usually is not true if there is a time where the work is intended to be removed. I'm not sure the poster qualifies for that (see Commons:Copyright rules by subject matter#Posters). While it is true such posters are made to be seen as much as possible, that does not mean something is free -- similar to Commons:Copyright rules by subject matter#Press_photos, that often does not include permission to make derivative works, use commercially, etc. Carl Lindberg (talk) 15:18, 1 August 2015 (UTC)

It's the fact that it's focusing on the poster in particular, without much other context, which creates the problem. Most copyright laws are OK with incidental inclusion -- so if you are taking an overall photo of Times Square with whatever ads happen to be there, that is generally OK, but if you are focusing on one ad in particular with an interest for that ad's content, then it would become an issue. There was a somewhat similar issue in the s:Ets-Hokin v. Skyy Spirits, Inc. case -- that was about a photo of a vodka bottle, where one of the claims was that the photo was derivative of the label on the bottle. The judge ruled that since the photo was of the entire bottle, the label was incidental -- but also said that photos focusing on the label could be derivative works. Obviously fair use would mean your photo would be legal in a great many circumstances without getting any permission, but when commercial use is involved -- say if you or someone else tried to sell a postcard of your photo -- that situation would probably change (and part of being "free" is also being OK to use commercially). Copyright can have some pretty twisted corners... there was once a case where a photographer had a model wear a particular pair of fancy glasses for a clothing advertising shot -- the glasses turned out to be copyrighted (they weren't normal glasses), and the photographer (since he intentionally included them to enhance his photo) was guilty of infringement. If you took a photo of someone who just happened to be wearing those same glasses then it should have been OK. But this is basically a photograph directly of a copyrighted poster -- and the Commons:Copyright rules by subject matter#Posters link explains the usual policy. Hello, these pictures exist on the arabic commons website so they can't be used in English articles. I have searched on wikipedia about this problem and found that I can download them and re-upload them to English commons website, which I did. I was still in the process of attaching the source website link to the Arabic commons website when all the pictures were subject to speedy deletion. Please help me return them, they are all either licensed by a public domain or creative commons 3.0. Thank you
