Publication info: Per a copy at Heritage Auctions which reads "Granville Stuart 1883, ©L. A. Huffman Post Photo", this is, well, a Post Photo. Various reprints exist, like the halftoned one at Find-a-Grave. I think it's safe to presume wide distribution.

This image is in the public domain because it is a mere mechanical scan or photocopy of a public domain original, or – from the available evidence – is so similar to such a scan or photocopy that no copyright protection can be expected to arise.
