Given that the LOC expects this photo not to be under copyright, and that Leadbelly was a public figure, and that furthermore, the disclaimer goes on to discuss "underlying copyright" on music pieces but that this photo is not music, I think the only relevant sentence on the page is that the LOC believes the photo to be in the public domain. This work is in the public domain because it was published in the United States between 1927 and 1963, and although there may or may not have been a copyright notice, the copyright was not renewed.
