REASONABLE SUSPICION OF BIAS REAL LIKELIHOOD OF BIAS Perspective from which the test is conducted The reasonable and fair-minded layman sitting in court and knowing all the relevant facts. The court, which is considered the personification of the reasonable man. Substantive difference The question, addressed by the court is whether justice was both done and manifestly seen to be done. The question, addressed by the court is whether there was a real danger, in the sense of possibility, of actual bias.
