My POV regarding FOP for Romania[edit]

The effort to respond to FOP cases is too big. I'll not upload the pictures on the local romanian wikipedia because there is the same vicious interpretation of the law from my point of view. I'll accept all the deletion of my pictures regardig my accept that anyone has the right to edit pictures and this right include the pictures deletion. I have argumented elsewere regardig the article invoked by FOP for Romania in wikimedia. I'll not reiterate the arguments.

the Romanian law is similar to Spanish law.
First of all let comare FOP policy for Spain and Romania
  1. Not OK Per the Romanian copyright law of 1996, images of architectural works, of three-dimensional works of art, of photographic works or of works of applied art permanently located in public places may be published only for non-commercial uses or if the work is not the main subject of the image.

Romanian copyright law, §33(1)(h). [The following are permitted] "(h) the reproduction, to the exclusion of any means involving direct contact with the work, circulation or communication to the public of the image of an architectural work, work of three-dimensional art, photographic work or work of applied art permanently located in a public place, except where the image of the work is the principal subject of such reproduction, circulation or communication, and if it is used for commercial purposes;" Note: "Copyright protection expires 70 years after the death of the original author (who is defined as the creator or designer) here. On January 1st of the following year (ie. January 1 of the 71st Year), freely licensed images of the author's 3D works such as sculptures, buildings, bridges or monuments are now free and can be uploaded to Wikimedia Commons. The lack of Freedom of Panorama is no longer relevant here for states with no formal FOP since the author's works are now copyright free." Spain[edit]

The photographical reproduction of this work is covered under the article 35.2 of the Royal Legislative Decree 1/1996 of April 12, 1996, and amended by Law 5/1998 of March 6, 1998, which states that:
Works permanently located in parks or on streets, squares or other public thoroughfares may be freely reproduced, distributed and communicated by painting, drawing, photography and audiovisual processes.

The original Spanish text: El artículo 35 del Real Decreto Legislativo 1/1996 de 12 de abril de 1996, modificado por la ley 5/1998 del 6 de marzo de 1998, establece: 2. Las obras situadas permanentemente en parques, calles, plazas u otras vías públicas pueden ser reproducidas, distribuidas y comunicadas libremente por medio de pinturas, dibujos, fotografías y procedimientos audiovisuales. Artículo 40 bis. "Los artículos del presente capítulo no podrán interpretarse de manera tal que permitan su aplicación de forma que causen un perjuicio injustificado a los intereses legítimos del autor o que vayan en detrimento de la explotación normal de las obras a que se refieran".

In Spain Case the same restriction that in wikicommons is interpreted as ok;is for romanian law as a restriction for commercial use.
The law is permiting [The following are permitted] "(h) the reproduction, to the exclusion of any means involving direct contact with the work, circulation or communication to the public of the image of an architectural work, work of three-dimensional art, photographic work or work of applied art permanently located in a public place,except where the image of the work is the principal subject of such reproduction, circulation or communication, and if it is used for commercial purposes;
The ground for exclusion is last paragraph but in my point of view the romanian law explain what the spanish law does not explain by

"may not be so interpreted that they could be applied in a manner capable of unreasonably prejudicing the legitimate interests of the author or adversely affecting the normal exploitation of the works to which they refer."

This year will be the eighth edition of the annual Wikimedia Commons photo competition, which recognizes exceptional contributions by users on Wikimedia Commons. Wikimedia users are invited to vote for their favorite images featured on Commons during the last year (2013) to produce a single Picture of the Year.

Hundreds of images that have been rated Featured Pictures by the international Wikimedia Commons community in the past year are all entered in this competition. The 2013 Picture of the Year competition has ended and we are pleased to announce the results: We shattered participation records this year — more people voted in Picture of the Year 2013 than ever before. In both rounds, 4070 different people voted for their favorite images. Additionally, there were more image candidates (featured pictures) in the contest than ever before (962 images total).

  • In the first round, 2852 people voted for all 962 files
  • In the second round, 2919 people voted for the 50 finalists (the top 30 overall and top 2 in each category)

We congratulate the winners of the contest and thank them for creating these beautiful images and sharing them as freely licensed content:

  1. 157 people voted for the winner, an image of a lightbulb with the tungsten filament smoking and burning.
  2. In second place, 155 people voted for an image of "Sviati Hory" (Holy Mountains) National Park in Donetsk Oblast, Ukraine.
  3. In third place, 131 people voted for an image of a swallow flying and drinking.

Commons:Photo challenge/2015 - May - Panoramas[edit]

I've removed File:Busteni Adventure Park PANO 20150501 122935.png from the challenge as it doesn't have at least a 2:1 aspect ratio. Hope you can find another image or challenge to take part in. -- Colin (talk) 20:09, 21 May 2015 (UTC) No Problem. I know some people use the word "panorama" to mean a wide-angle view, often made up of several frames that are stitched. But for this challenge, we set the rules to be width:height needs to be 2:1 (or 1:2) or greater (e.g. 3:1). And the above image is 1:1.333. -- Colin (talk) 07:18, 22 May 2015 (UTC) Ok.
