Your uploads[edit]

I notice that you've uploaded quite a few images of work by contemporary artists. Do you actually have permission from all the artists to release these images under free licenses? If so, please see COM:OTRS for the method to document this permission. It's great that you're working with a gallery to get images of recent artworks that we can use. The basic concern is that we want to have verifiable evidence that the photos are okay, in particular that they are released under a truly free license. COM:OTRS describes this process - what you need to do is forward an e-mail from the gallery (or have someone from the gallery directly e-mail) to permissions-commons@wikimedia.org, stating that the artists give permission for images of their work to be uploaded to Commons under a specific license (such as GFDL or CC-BY) (the e-mail should clearly identify what images are being licensed, e.g. the names of the files you've already uploaded). An important point is that they must be under a so-called "free license" - the artsits have to understand and agree that the images are to be useable by anyone, for any purpose (including commercially`); it won't be enough for them to be released just for use on Wikipedia, for example. Once you start this process, you should add {{otrs pending}} to all the images you've uploaded; later, when everything's been checked by an OTRS volunteer, that will be changed to a tag with the ticket information.
A secondary concern is to clean up the authorship and copyright tagging on the files. Right now they all claim that you are the copyright holder and the only person who needs to be credited; most likely that should be changed to credit the artist. --dave pape (talk) 16:04, 8 August 2008 (UTC)

Licensing[edit]

"Fair use" images are not allowed on Commons. Commons only accepts free content, as defined at COM:L. The fair use images you see on Wikipedia have been uploaded directly there, rather than here (the practical difference being that they can only be used in articles on the English Wikipedia, not on any other Wikimedia projects). If you're unable to get the artists to agree to a fully free license (e.g. they want the images to only be used in Wikipedia articles, or for commercial use to be prohibited), then the images would have to be removed from Commons and uploaded instead to the English Wikipedia, with non-free-content tags and justifications (en:WP:NFC).

But if a free license is possible, then the images should be kept here. There are many many licenses possible; the easiest thing is to just stick to suggesting the GFDL (as it's sort of the default Wikimedia license). That license requires that the author always be credited, and requires any other work that makes use of the image to continue to be licensed under the GFDL (that is, someone can't make their own All-rights-reserved work derived from a GFDL photo).

As for credits: when we're dealing with a photo of a sculpture or other 3D object, then legally there are two authors & copyright-holders involved — the creator of the original sculpture, and the photographer (see Commons:Derivative work); if the photo was created by someone at the gallery and they just want the gallery itself credited, then that's okay. For a photo of a 2D painting which aims to exactly reproduce the painting, the photographer is normally assumed to have no copyright (at least in the U.S.), and so only the creator of the painting really needs to be credited as author (the photographer can still be credited as a courtesy; it may also be good to identify them, for completeness in the source information). The "Courtesy of ..." line could be used as the Source value, or as the Author (assuming the artist's name is used). --dave pape (talk) 03:32, 14 August 2008 (UTC)
