[edit]Die großformatigen Zurechtweisungen auf dieser Seite beruhen, was Lizenzen betrifft, auf Unkenntnis der WIKIMEDIA COMMENS-Administratoren. Erst jetzt hat sich unter ihnen herumgesprochen, dass Bildinhalte gemeinfrei seien können, aber nicht die Fotos, die von den Originalen (Objekten) gefertigt wurden.
Viele meiner Fotos sind durch WIKIMEDIA COMMONS-Administratoren zu Treibgut im Netz („gemeinfrei“) deklariert worden. Mein Appell an WIKIMEDIA COMMOMS: Wenn nicht bis 30. April 2012 die widerrechtliche Deklaration „gemeinfrei“ (in dem Sinne, dass ich als Urheber von Objektfotografie nicht genannt werden muss) überall entfernt worden ist, beauftrage ich einen Fachanwalt für Urheberrecht die Löschung sämtlicher Fotos von mir in WIKIMEDIA COMMOMS und in WIKIPEDIA durchzusetzen. Zur Subjektivität der Fotografie
Fotografien verändern mehr oder weniger das Aussehen des abgebildeten Objekts. Selbst wenn graphische Blätter fotografiert werden. Wie auch der Bildschirm ein Foto leicht verändert, wenn er es präsentiert. Der Urheber eines Fotos muss vom Nutzer genannt werden, da der Fotograf (Amateur oder Profi) für den Wahrheitsgehalt seines Fotos einzustehen hat. Analog dem Autor, wenn es um Text und Erkenntnis geht.

Die Zusage der S. Fischer Verlage betrifft Wikipedia, doch kann stillschweigend unterstellt werden, dass sie auch für das Schwesterprojekt Wikimedia Commons gilt, das als Bild-Archiv für Wikipedia genutzt wird.

Werke der Gegenwartskunst sind nur zum kleineren Teil in Museen und staatlichen Sammlungen vertreten. Der größere befindet sich in Privatbesitz. Meist bleiben diese Standorte anonym.
Für Ausstellungs-Kuratoren kann es von Bedeutung sein zu wissen, wo sich welches Werk befindet. In der Vergangenheit war ich schon mehrfach Leihgeber für Ausstellungen. Dass die jeweiligen Arbeiten mir gehörten (z. Zt. mir gehören, denn sie werden mich überleben), war den Ausstellungsmachern eher zufällig bekannt. Als Ruheständler habe ich nun Zeit, meine Kunst-Sammlung im Internet zu katalogisieren und will das auch gern tun, gemäß der Forderung: Eigentum verpflichtet. Eine geheime Privatsammlung ist sozial und gesellschaftlich wertlos.
Ältere Werke konnte ich in den Wikimedia-Portalen Commons und Wikipedia publizieren. Bildzitate von zeitgenössischer Kunst werden aber dort abgelehnt bzw. unterdrückt, obwohl sich eine rechtliche Form dafür finden ließe.
In der Vergangenheit hatte ich mit BT Mediawork bereits drei bibliophile Sammlungsverzeichnisse digital publiziert, darunter einen Atlas der Erstausgaben Thomas Manns. Nun folgt nach der gescheiterten Kooperation mit Wikicommons ein viertes virtuelles Sammlungsverzeichnis, diesmal für Kunstfreunde und als Standortnachweis.

Die nachfolgenden Ermahnungen und Löschungen sind entstanden, weil mir lange niemand erklärt hat, dass Bildzitate in Commons nicht erwünscht sind. Ich war immer vom deutschen Urheberrecht inbezug auf → Bildzitate ausgegangen. Die englischen Abmahnungen erreichen mich nicht, da ich keine Fremdsprachen beherrsche. Dessen geniere ich mich nicht, da im Deutschen sich das Wort mir um so mehr zu Gebote hält.

Gerade sehe ich noch deine Fischer-Erlaubnis. Ich bin beeindruckt. Ich weiß nich, ob du damit bei Wikimedia Erfolg hattest/hast, aber soweit ich weiß, gab es schon ähnliche Dinge, die dann doch nicht gingen, etwa bei der Himmelsscheibe von Nebra. Aber „bei Wikipedia verwenden“ heißt ja, dass jeder alles damit machen darf, alo auch kommerziell, und es ist wohl schwer vorstellbar, dass die Fischer-Umschläge bald für andere Bücher verwendet werden dürfen. Gilt die Erlaubnis nur für Thomas Mann? Etwas ähnliches: Ubisoft hat offenbar die Erlaubnis gegeben, Screenshots ihrer Computerspiele frei zu lizenzieren (siehe Bild rechts). Dafür gibt es auch eine extra Lizenzvorlage. Vielleicht schaffst du das ja auch für alle Umschläge des Fischer-Verlags. :-) --Jarlhelm (talk) 22:07, 10 July 2008 (UTC)
- Hallo Jahrhelm! Ob ich mit der Fischer-Erlaubnis bei Wikipedia Erfolg hatte? Ja und nein. Mal werden die Fotos geduldet, mal werden sie gelöscht. Warum wie entschieden wird, habe ich noch immer nicht kapiert. Es scheint da Ermessensspielräume zu geben. - Denke, dass, wenn ich aus meinem zvab.com-Antiquariatskatalog abbilde, also aus einer Quelle mit meinem Copyright, keine Einwände bestehen dürften. Scheint für die Administratoren schwer beurteilbar zu sein, da ähnliche Fälle bisher noch nicht vorgekommen sind. Oder doch? - Zu Commons: Mit dem Thomas-Mann-Katalog habe ich erst mal eine Pause eingelegt, da ich damit rechnen muss, dass er von einem Ausländer gelöscht wird, wenn er endlich fertig ist. Stelle die Thomas-Mann-Fotos besser in meinen Antiquariats-Katalog. Da sind sie sicher. Bei Commons lade ich vorerst nur die alten Exemplare hoch (Erscheinungsjahr bis 2007). Da wird es sehr bald einen Löschantrag zu geben, daher schonmal vorweg eine Erklärung (etwas laienhaft, aber den Regeln entsprechend): Das Photo ist 1955 aufgenommen worden, es unterliegt also auf jedem Fall noch dem Urheberrecht eines Autors (Photographen), dieses könnte entweder nach 70 Jahren erlöschen wenn der Autor auch nach Recherche anonym ist oder für z.B. eine Agentur gearbeitet hat oder 70 Jahre nach dem Tod des Photographen - bei 1955 ist beides nicht möglich. Auch wenn der Photograph unbekannt ist gilt dieses, Annahmen wie der Photograph wird sein Recht niemals geltend machen zählen nicht (COM:PRP). Der Photograph (unbekannt) hat sein Einverständnis nicht gegeben, dass Jeder das Bild frei Nutzen kann. Du hast dir die Arbeit mit der Digitalisierung gemacht, die Digitalisierung kannst du auch frei lizensieren, allerdings ist das Bild noch Gegenstand des Urheberrechts des Photographen und damit ist das neue Werk (das digitalisierte Bild) nicht frei lizensierbar, siehe hierzu Commons:Bearbeitungen. Den gleichen Fehler hast du in der Vergangenheit schonmal gemacht, zumindest interpretiere ich es als Fehler. Ich kann natürlich auch falsch liegen: Der Autor könnte sein Einverständnis gegeben haben, dann müsstest du das auf der Bildbeschreibungsseite auch darlegen, sonst ist es für keinen Betrachter nachvollziehbar. Bedenke bitte: Commons (gleiches gilt für Wikipedia) ist ein Archiv für freie Bilder, dass bedeuted: Jeder kann die Bilder im Rahmen bestimmter Lizenzbedingungen nutzen zu jedem Zweck, einschließlich kommerzieller Nutzung. Dazu muss der Urheber/Rechteinhaber eines Werkes sein Einverständniss (in Form einer Lizenz) geben und das Bild selber darf nicht Gegenstand eines fremden Urheberrechtes sein. --Martin H. - Es handelt sich bei meinen Bücher-Fotos um keine Scans. Auch nicht um reine Fotos, sondern um aufwendige Bearbeitungen mit Photoshop. Muss wohl zuerst das unbearbeitete Foto hochladen, das dann gemeinfrei wäre und dazu das von mir bearbeitete Foto, für das mir ideelle Urherberrechte zustehen. Billigt mir Commons die Autorenschaft für die bearbeiteten Fotos nicht zu, schmeiße ich den Bettel hin. - Die Bücher, die ich für WIKIPEDIA fotografiere, sind Kulturgut und bibliophile Sammlerstücke, die mit den Jahren Individualität erlangt haben. Urheberrechtlich handelt es sich bei meiner Arbeit um Objektfotografie, kein Scannen von Titelblättern. Die Fotos dürfen unentgeltlich von Dritten als Druckvorlagen verwendet werden. Das Recht, dabei als Urheber mit "Foto H.-P.Haack" genannt zu werden, steht mir zu, obwohl es mir einige übelwollende Administratoren von WIKIPEDIA absprechen wollen. Ich sollte auch als Fotograf genannt werden, um das individuelle Buch zu identifizieren (Sammlung H.-P.Haack). bedeuten soll? Die Ergänzung ist falsch. Unter der Lizenz darf das Foto von Jedem, weltweit, für jeden Zweck, wissenschaftliche wie auch kommerzielle Zwecke, jederzeit in jeder Form und in jedem Medium verwendet und verändert werden solange die Lizenz (§4a des Lizenzvertrags) und der Urheber (§4b des Lizenzvertrags) genannt werden. Das fotografierte Objekt ist aufgrund seines Alters gemeinfrei, aber nicht das Foto. Meine Buchfotografien werden als Objektfotografie anerkannt. Wenigstens das. Die Fotographie von alten graphischen Blättern - mehr Handwerk als Kunst - ist ebenfalls Objektfotografie. Ich wäre nicht eingeschnappt, wenn alle fotografierten Bilder ("zweidimensional") von mir gelöscht würden. Wenn Commons die Bilder behalten will, dann aber nur, wenn die Fotos als Objektfotografie eingestuft werden und ich genannt werde. Vorschlag: "Foto Wikimdeia commons H.-P.Haack" oder noch besser: "Foto Wikimedia H.-P.Haack". Da meine Fotos alle als Druckvorlagen geeignet sind, würde diese Urheberbezeichnung auch der Meinung über Wikipedia in der Öffentlichkeit zugute kommen, wenn in einem Sachbuch die Bildprovenienz mit Wikipedia vermerkt werden muss. Man wird kaum einen anderen Sammler finden, der Fotos seiner Raritäten der Öffentlichkeit kostenlos übergibt. - Mein Anwalt David Nourney, Kanzlei Knigge Nourney Böhm, Leipzig, macht in einem Schriftsatz gegen eine Raubkopie durch den Leipziger Universitätsverlag geltend: "Die von unserem Mandanten erstellten Fotos sind geschützte Werke i.S.v. §§ 2 Abs. 1 Nr. 5 UrhG." "Durch die Übernahme der streitgegenständlichen Fotografien ohne Genehmigung unseres Mandanten und ohne Vermerkung seiner Urheberschaft haben Sie die ihm zustehenden Rechte nach den §§ 13, 16 und 17 UrhG verletzt."

Das Buch ist gedruckt und ausgeliefert, da ist nichts mehr zu machen. - Mir reicht der Schuss vor den Bug, beim Verlag und beim Autor, die ich persönlich beide kenne und die mich kennen. Ich kann das Scheiben vom Anwalt scannen und hochladen. Da hätte Commons ewas Schriftliches zu dieser Rechtsfrage anhand eines Beispiels. Muss aber noch seine Einwilligung einholen. Wenn er bockt, wäre ich bereit, eine schriftliche Rechtsauskunft von ihm für Commons zu bezahlen und hochzuladen. - Ähem, auch wenn ich kein Jurist bin: wenn die Gegenseite darauf eingeht, dann bestätigt das nicht notwendigerweise wirklich die Rechtslage, sondern kann lediglich ein Indiz sein, dass der gegn. Anwalt deinen Anspruch für immerhin nicht unmöglich hält. Es kann aber auch einfach sein, dass man die sicher höheren Kosten eines Sachverständigenprozesses vermeiden will. Dein Angebot ist nett gemeint, aber da wäre ich etwas vorsichtig, denn das kann, wenn es wirklich solide sein soll, doch recht teuer sein. Außerdem meine ich, dass das eher Aufgabe von Wikimedia-de wäre, so etwas zu bezahlen. Wir können aber gerne mal einige juristisch versierte de-Commons-Benutzer ohne Sendungbewußtsein, wie z.B. - Ich werde vom Verlag ein Errate-Blatt fordern, das in die noch nicht verkauften Bücher eingelegt werden muss. Öffnen der Folie, Erratablatt einlegen, neue Folie schweißen. Das macht einige Mühe.Dr. Diesener, der Verlagsleiter, wird das nur machen, wenn er das muss. Und ich bin berechtigt, das zu fordern. Wer die Bilder vertauscht hat, Autor, Sekträterin, Buchgestalterin des Verlags, wird man wohl nie eindeutig klären können. Haftbar bleibt der, der das Buch hergestellt hat. Der könnte nun wieder still und leise sich mit dem Autor einigen, dass der mit seiner Haftpflichtversicherung für den Schaden des Verlags aufkommt. Wenn ich schon die Chance habe dir etwas mitzuteilen: Der Eintrag #Permission publishing house S. Fischer Frankfurt am Main Germany den du auf deiner Diskussionseite ganz oben bewirbst ist keine Freigabe die für Wikimedia Commons gilt. Wikimedia Commons ist - genau wie die anderen Projekte - ein Projekt für freie Inhalte. Eine Freigabe zur "Abbildung [..] in [...] Wikipedia-Beiträgen" ist für die Projekte völlig wertlos da es mit freien Inhalten nichts zu tun hat.

- Das Schreiben vom Fischerverlag ist schon älter. Damals ging es darum, ob ich überhaupt die Bücher in Wikimedia abbilden darf. Inzwischen wird das nicht mehr infrage gestellt. Die Hinweise auf das Schreiben vom Fischerverlag lösche ich. Fange wieder von vorn an. - Jezt ist es in Wikimedia endlich gestattet, als Bildgeber sich nennen zu lassen. - Ich hoffe, dass Du eine Einzelmeinung vertrittst. Wenn mir Commons nicht gestattet, als Foto-Urheber genannt zu werden, klage ich die Löschung sämtlicher Bilder von mir in Wikimedia ein. Zur Zeit gehe ich anwaltlich gegen einen Leipziger Medizinprofessor vor, der zwei Bilder von mir in seinem Buch veröffentlicht hat und als Quelle das Stadtgeschichtliche Museum Leipzig angibt. Der Auftrag ist für RA Nourney, Fachanwalt für Urheberrecht, Kanzlei Knigge, Nourney, Böhm Leipzig, eine Kleinigkeit. Eine Klage wegen hunderten von Bildern wäre für ihn lohnender. Also stimm Die mit anderen Admins ab: Entweder ihr schmeißt mich mit a l l e n meinen Fotos raus oder ihr behaltet mich als namentlich genannten Foto-Urheber. Beides hat für mich seine Vor- und Nachteile, vielleicht ist der Bruch mit Wikimedia die bessere Lösung für mich. ABER OHNE ENTEIGNUNG! - Viele meiner Fotos sind durch WIKIMEDIA COMMONS-Administratoren zu Treibgut im Netz („gemeinfrei“) deklariert worden. Mein Appell an WIKIMEDIA COMMOMS: Wenn nicht bis 30. April 2012 die widerrechtliche Deklaration „gemeinfrei“ (in dem Sinne, dass ich als Urheber von Objektfotografie nicht genannt werden muss) überall entfernt worden ist, beauftrage ich einen Fachanwalt für Urheberrecht die Löschung sämtlicher Fotos von mir in WIKIMEDIA COMMOMS und in WIKIPEDIA durchzusetzen. Mit einer gerichtlichen Auseinandersetzung riskiere ich nichts.
- Der Anwalt wird eine erneute Frist sezten. Das Schreiben des Anwalts ist bereits gebührenpflichtig für den, der im Unrecht ist. Die Anwaltsgebühr richtet sich nach dem Streitwert. - Einmisch: Ich finde es bemerkenswert, mit welchem Eifer Du hier für Qualitativ gute bis mittelmäßige Fotos streitest, die Werke von anderen Künstlern zeigen, und dabei darauf beharrst, unbedingt mit genannt zu werden... Die Regeln hier sollte man eigentlich begreifen BEVOR man irgend was hochläd... Nachdem was Du hier über Deine Person veröffentlicht hast, kann ich mir eigentlich nicht vorstellen, das du das noch nötig hättest, aber ist Deine Entscheidung. Nur Schade das hier immer mehr Menschen, die ehrenamtlich dieses Projekt am laufen halten, Zeit und Nerven investieren müssen, um Deine Forderungen zu bearbeiten. Mal abgesehen davon, ob du hier juristisch im Recht bist oder nicht (Anwälte suchen immer den Konflikt auch wenn sie es besser wissen, das ist nun mal ihr Job), moralisch wirst du dir hier ein zweifelhaftes Denkmal setzen, was wohl eher mit deiner Person verbunden werden wird... ich habe mir Deine Diskussionsseite, Deine Löschanträge und viele Deiner weiteren Beiträge durchgelesen, und glaube verstehen zu können, worum es Dir geht. Zunächst einmal vielen Dank für Deine Arbeit und Mühen. Du möchtest auf den von Dir erstellten Fotografien als Erstellern genannt werden, was ich völlig verstehen kann, doch ist es eben nicht geltendes Recht. Auch ein Einsortierer (Kategorisierer) oder ein Übersetzer in eine andere Sprache könnte dieses Recht dann ebenso einfordern. Die Fotografien würden bald überborden von Rechte-Inhabern. Als Fotograf ist es Dein gutes Recht, genannt zu werden. Das erfolgt hier bisher in der Historie der Dateien. Falls Du mehr möchtest, ist es ebenso Dein gutes Recht, dieses einzuklagen. Bis Du ein gültiges Urteil vorweisen kannst, werde ich aufgrund meiner Administratorenrechte ein Behalten Deiner Fotografien erwirken. Wenn Du ein rechtsgültiges Urteil vorweisen kannst, werden die Dateien eben gelöscht. Und vermutlich in naher Zukunft durch einen anderen Fotografen/Hochlader, der nicht auf diese Rechte besteht, ersetzt. als feedback: ich finde diese Änderung wirklich keine Verbesserung. Rahmen entfernt - d'accord! Aber jetzt ist das Bild ganz unnatürlich grell leuchtend orangegelb geworden. Für ein historisches Dokument nicht angemessen und auch optisch unschön, vergleiche es mal mit diesem Bachschen Autograph.
