Löschungsankündigung - Erläuterung für schnelle Leser[edit]

Leider habe ich gestern meine Erläuterung anscheinend nicht gespeichert, in der ich für externe Bearbeiter versucht habe zu erklären, um was es bei den Bildern geht: Ich habe zwei verschiedene Gruppen von Dateien hochgeladen, die ich zwar alle selbst erstellt habe, bei denen die Rechtsituation jedoch unterschiedlich sind: 1) eine Gruppe von Dateien, in denen das Kürzel HAA vorkommt, das ich unten erläutere (bzw. das unter meiner Wikiseite auch bereits erläutert ist) 2) eine Gruppe von Dateien, in denen das Kürzel HAA _nicht_ vorkommt, und deren Fotograf und Urheber ich selbst bin (wie jeweils angegeben).

Gruppe 1 mit dem Kürzel HAA bezieht sich auf Bilder, deren Rechteinhaber das Hamburgische Architekturarchiv ist. Aus diesen Beständen vom Fotografen Otto Rheinländer (=ORh) habe ich im Rahmen des unter https://de.wikipedia.org/wiki/Benutzer:HuJProj geschilderten Projektes ca. 1200 historische Negative (teils auf Glaspaltten) mit hoher Auflösung als TIFF-Dateien gescannt. Ebenso etwa 1300 Negative vom Fotografen Walter Lüden. Beide Bestände sind durch frühere Ankäufe in der Rechtesituation auf das HAA übergegangen. Um diese Fotos, die alle jeweils Kirchen bzw. Kirchenausstattungen im öffentlichen Raum betreffen, auch der breiteren Wikipedia-Community in einer geringeren Auflösung als JPGs zugänglich zu machen, hat das HAA auch schriftlich per Erlaubnismail am 9.2.2017 an

sein Einverstädnis erklärt. Wobei deshalb keine individuellen Dateifreigaben erfolgt sind, sondern mir auch die Erlaubnis für noch Ausstehende uploads gegeben wurde. - Insgesammt geht es um ca. 80 Kirchgebäude, zu denen ggf. Beiträge zu leisten wären.

In der Gruppe 2 handelt es sich um Fotos, deren Fotograf und Urheber ich selbst bin (wie jeweils angegeben). Wobei bei den dreien, (StNicolaus_Alsterdorf_vor*.jpg), bei denen ich Bilder aus Büchern abfotografiert habe, ich mich bemüht habe, Details zu den Fotografen und ggf. bessere Vorlagen über den Rechtsnachfolger der Alsterdorfer Anstalten zu erhalten. Allerdings kannte die Evangelische Stiftung Alsterdorf nicht einmal die ursprünglichen Publikationen, die 1908 und 1932 publiziert wurden und inzwischen auch jeweils online publiziert sind (allerdings in geringerer Auflösung als meine Fotos).

Ich hatte auf https://de.wikipedia.org/wiki/Benutzer:HuJProj etwas vollmundig angegeben, ich "...möchte Teile unserer Ergebnisse der breiteren Wikipedia-Öffentlichkeit zugänglich machen. Es werden von mir in Zukunft weitere Wikipedia-Beiträge ergänzt oder ggf. neu erstellt werden, die mit dem Projekt und den Kirchbauten zusammenhängen,..." Allerdings bin ich nicht sicher, ob ich bei dieser Absicht bleiben kann und will, wenn für jedes einzelne Foto aus dem HAA-Bestand individuell eine derartige Barriere für das HAA und für mich aufgebaut wird, wie ich sie jetzt wahrnehme.

Der Hinweis auf den Freigabe-Assistenten führt leider nicht zu einem produktiven Vorgang, denn die Logik der Abfragen ist nicht ausgereift, weil sie Ebenen nicht angemessen trennt bzw. die Optionen der Antworten nicht hinreichend sind: - Welche der folgenden Punkte treffen auf die von Ihnen hochgeladene Datei zu? [Ich kann sinnvollerweise nur die 4 Option auswählen, wenn ich weiter will: "Das Foto zeigt ein Kunstwerk oder Denkmal" - Was sachlich richtig ist: die Kirche (und Interieur) befindet sich in einem Gebäude, das unter Denkmalschutz steht.]

Damit beginnt aber das weitere Dilemma - geht es in dem Fall des Bildes aus dem HAA Bestand Otto Rheinländer um das ursprüngliche Foto von ORh als ein zweidimensionales Objekt? - Oder geht es um den dreidimensionalen Innenraum der Kirche mit den Gemälden von Bernhard Hopp? Je nachdem, welche Option man wählt, kommt man in weitere Unklarheiten: & - bei der Option zweidimenional ist allein sprachlich die Erläuterung defekt... - bei dreidimensional kann ich etwa Panoramafreiheit wählen, worüber es für Kirchenräume aber lange Diskussionen gibt... Im Endeffekt kommt eine Mail mit einem teils unsinnigen Text zustande, die ich jetzt mit einer Kommentierung für das eine Bild an Permissions... gesendet habe (das ist die Ziel-Adresse, die vom Assistenten erzeugt wird, aber nicht eine der Mails an https://commons.wikimedia.org/wiki/Commons:OTRS/de). Ich hoffe, es findet sich ein Freiwilliger, der in den Freigabe-Assistenten die entsprechend komplexere Situation einarbeitet. Rechte, Löschungen usw.[edit]

Hallo! Erst einmal danke für deine Beiträge. Bildrechte sind nicht einfach zu verstehen und zu beachten, da kann es am Anfang leicht zu Problemen kommen. Teilen wir das mal auf:

  • Fotos von Otto Rheinländer: Wenn das HAA Rechteinhaber ist, dann kann nur das HAA eine Freigabe genehmigen. Üblicherweise muss sich ein Rechteinhaber direkt an das OTRS-Team (permissions-commons-de@wikimedia.org) wenden, was du oben so auch schreibst. Beim OTRS-Team sitzen auch nur Freiwillige, wie in der Wikipedia, eine Bearbeitung kann daher etwas dauern. Selbst wenn in der Zwischenzeit hier die Dateien gelöscht werden, ist das kein Problem, denn sie können bei Bestätigung der Freigabe wiederhergestellt werden. Du musst sie also nicht neu hochladen. Solche Dateien kannst du mit {{OTRS pending}} auf der Dateibeschreibungsseite kennzeichnen. Die Freigabe muss natürlich nicht für jedes einzelne Bild erfolgen, wenn das vom HAA gleich auch für die Zukunft geregelt ist.
  • Fotos von dir: Die sind üblicherweise kein Problem, wenn die üblichen Regeln wie Panoramafreiheit beachtet worden sind. Das betrifft dann aber natürlich in der Regel nur Außenaufnahmen.
  • Fotos von Fotos in Büchern: Wenn nicht die Rechte an diesen Bildern klar abgelaufen sind, darfst du sie nicht nach Commons hochladen. Eine Fotografie einer Fotografie gilt nicht als „dein Werk“ im üblichen Sinne, das ist nur eine Reproduktion. Bei unklarer Herkunft und unklarem Alter der Fotos gibt es bestimmte pragmatische Regeln, (z.B. bei Fotos, die älter als 100 Jahre sind oder die vor 1923 veröffentlicht worden sind), aber das gilt nur für Bilduploads in der deutschsprachigen Wikipedia, nicht für Commons. Dazu empfehle ich die Seite de:Wikipedia:Bildrechte#Fremde Aufnahmen. Für weitere Fragen bei unklarer Rechtssituation gibt es die Seite de:Wikipedia:Urheberrechtsfragen.

Offen sind ja noch Innenaufnahmen in Kirchen, für die m.E. auch Panorama-Freiheit gelten müsste, denn diese Gebäude sind in der Regel ja für die Öffentlichkeit gedacht und frei zugänglich ebenso wie die Kunstwerke darin. Anknüpfend an den obigen Hinweis muss ich dir leider sagen, dass die Panoramafreiheit in Deutschland nicht in Innenräumen gilt. Dies betrifft, der Beschreibung nach, die folgenden 5 Fotos:

Die englische Seite zu Eva Leo, die zuerst von der Tochter über die Künstlerin Eva Leo (geb. Dittrich) erstellt wurde und dann nachträglich vom Neffen im deutschen Wikipedia erstellt wurde, hatte die Erlaubnis. Ich habe die Aufnahmen selbst gemacht und auch entsprechend schon publiziert. In Wikipedia existieren zahlreiche Fotos von Kunstwerken in Kirchenräumen, die ja explizit zum gottesdienstlichen Gebrauch für die Öffentlichkeit geschaffen werden. - Ich habe aber inzwischen aufgegeben mir Mühe zu geben, darüber zu argumentieren und meine frühere Idee aufgegeben einen Schatz von Fotos zur Verfügung zu stellen... Ich weiß, dass das manchmal nervend erscheint, aber die Gesetze sind halt so. Mir wäre es auch lieber, wenn wir diese Probleme nicht hätten. Ignorieren hilft aber nicht, zumal wir mit dem Bereitstellen auf Commons ja auch Nachnutzern signalisieren, ihr könnt diese Bilder ohne Risiko benutzen, wenn ihr die Lizenzbedingungen einhaltet. Dass in Wikipedia oder anderenorts anscheinend ähnliche Fotos akzeptiert werden, kann im Einzelfall auch daran liegen, dass deren Problem noch niemand aufgefallen ist. Hier werden täglich tausende neue Fotos hochgeladen und die Kontrolle erfolgt durch Freiwillige. Hinzu kommt, dass die Panoramafreiheit in Deutschland Fotos von Werken in Innenräumen ausschließt (de:Panoramafreiheit#Kriterium_.E2.80.9E.C3.B6ffentlich.E2.80.9C), während diese in Österreich (de:Panoramafreiheit#Erfasste_Werke_und_privilegierte_Nutzungen) teils erlaubt sind.
Mit "englische Seite zu Eva Leo" meinst du den Artikel über Eva Leo in der englischsprachigen Wikipedia? Dort sehe ich aber auch keinerlei Anzeichen für eine Genehmigung seitens der Künstlerin oder ihrer Erben. Allerdings liegen die Fotos ja auch auf Commons. Falls sie ursprünglich lokal auf :en hochgeladen wurden, könnte beim Transfer nach Commons der Genehmigungsbaustein verloren gegangen sein, obwohl das ungewöhnlich wäre. --Túrelio (talk) 15:20, 27 August 2017 (UTC)[reply]
