undo restore Nederland_wapen.svg

Het viel me op dat u de de file http://commons.wikimedia.org/wiki/File:Nederland_wapen.svg en Nederland wapen 2.svg hebt gerestored, nadat deze eerst was gedelete. Het tweede bestand is een tekening van het Nederlands wapen die niet vrij is van rechten. Het origineel is een tekening van heraldisch tekenaar Piet Bultsma. het eerste bestand is een extractie van dit wapen. Er is een ander ontwerp van het Nederlands wapen beschikbaar die wel vrij is van rechten. Deze is reeds opgenomen in wikimedia commons. Wederom daarom het verzoek beide bestanden te deleten.

Beste Multichill, User arch geeft aan welke bron hij heeft gebruikt met een link naar de bron. De bron is het wapen welke is geschilderde door Piet Bultsma en waar ngw.nl toestemming heeft om te gebruiken op haar website. Het is echter niet vrij van rechten. User Arch heeft dubbel inbreuk op het beeldrecht van Piet Bultsma. Hij heeft niet alleen zonder toestemming diens wapen gebruikt om er een vector bestand van te maken, maar er ook nog slechts een deel van gebruikt (alleen het wapen zelf en niet de mantel).

Het nederlands wapen is door de hoge raad van de adel beschreven hoe het eruit moet zien. Als je dat wapen tekent is het uiteraard de bedoeling dat het daaraan voldoet. Dan is er dus geen sprake van orginaliteit vanuit de maker, juist omdat het wel een Nederlands Wapen moet zijn. Omdat orginaliteit een eis is om beeldrecht (copyright) te claimen, is dat hier niet te claimen.

Het wapen van het koninkrijk der Nederlanden en Koningen der Nederlanden is vastgesteld bij Koninklijk Besluit van 23 april 1980,nr. 3, Stb. 206. Dit K.B. vervangt de K.B.’s van 1907 en 1909. Bij het K.B. van 1907 is een afbeelding van het wapen gevoegd dat vrij is van rechten. (zoals eerder genoemd en ook op wikipedia te vinden is). Alle andere uitvoeringen zijn een artistieke interpretatie van de tekst van het K.B. Wanneer de gemaakte afbeelding overeen komt met de tekst van het K.B. is het een correcte afbeelding van het wapen, maar de artistieke uitvoering is altijd belast met het intellectueel eigendom van de maker. Stichting Pictoright (voorheen Beeldrecht) heeft al meermaals de belangen van de maker behartigd wegens onrechtmatig gebruik van dit wapen. Wanneer u nog niet overtuigd ben, stel ik voor dat u contact opneemt met de hoge Raad van Adel te Den Haag.

Afb. poppenhuis

Hallo Multichill,

Je zette op 23 januari jl een foto van een poppenhuis op de Commons: File:Overzicht van poppenhuis uit de collectie van het Centraal Museum - Utrecht - 20415950 - RCE.jpg Dit is niet het poppenhuis van Petronella de la Court in het Centraal Museum in Utrecht, zoals er nu bij vermeld staat. Het gaat hier om het poppenhuis van Sara Rothé (1743) in het Frans Halsmuseum te Haarlem. De Rijksdienst voor Cultureel erfgoed heeft inmiddels de foutieve gegevens aangepast: http://beeldbank.cultureelerfgoed.nl/20415950 Jammer, dat de Wikipediagegevens niet meer kloppen! Misschien zou het bestand voor verwijdering moeten worden opgedragen?

"Commonscat tool" reports an error
