Commonwealth Copyrights[edit]

Yes, in fact commons requires that we honour the copyrights of a)the servers (United States), b)uploaders (Canada and Australia respectively), but also of the place where the item originates (i.e. A Danish photograph would have to be free under Danish law) and the place where we obtain the image (i.e. if it's off French servers, it needs to be PD-France as well).

In practice, I understand that only A & B are really necessary. Realistically, almost everything PD-US is PD-Canada anyhow, and it's essentially never worthwhile to sue people here for copyright violation, so even b might be skipped (don't know about your side). But (A) needs to be met. The tricky part is that media produced outside the US is sometimes under their copyright, sometimes ours (maybe sometimes the longer or shorter period). As an example, photographs taken in Canada from 1946-1948 are pulbic domain here but not Stateside, because they were coprighted in Canada on Jan 1, 1996, but I believe photographs taken in Canada are now life+50 in the States because they obey our new copyright laws. Crazy stuff.

Current Commons policy is that an image or other media file must be:
  1. PD in the United States; and
  2. PD in the country in which it was first published; and
  3. PD in the author's country of nationality.

PD-chem / PD-self solution[edit]

I've given the situation some thought. I still maintain that the images in question are ineligible for copyright, however, I also know the community is generally fine with these images being tagged with {{PD-self}} in place of a PD-ineligible tag. To some, this isn't the best practice, but to most, this is acceptable. Before undertaking the task of having my bot apply {{PD-chem}} to simple chemical structure images, I assumed this was a non-controversial issue—what the community wanted, even. This is why I set the bot to convert tags that weren't PD-ineligible to start with, in addition to those that were. I didn't see any difference and thought it would better to be consistent. Since a few of you have stress concern with my actions, I guess I was wrong. I apologize. I am planning to revert any changes my bot made to your images (also Edgar181's and Benjah-bmm27's images along with anyone else who wishes me to do so). I'm not accusing you of any bad faith! But, dispite everybody's best intentions, {{PD-chem}} is a bad template, both legally and practically. I don't think it can be saved, and I certainly don't think it should be. If we can get some clear agreement on the images which are clearly ineligible for copyright, then I'm fine with those remaining as {{PD-ineligible}} but I certainly don't think we should be changing {{PD-self}} tags, which give our users legal protection, for {{PD-chem}} tags which don't. I shall, of course, continue with discussion with all concerned parties to try to convince people that the situation which has worked fine for years on English Wikipedia is preferable to the other suggestions. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").
