Hi! Geo Swan is exacting a slow and tedious revenge on User:Calton for past disagreements. Calton started the deletion discussion for [Cargo]. Before you userify the deleted article, you might want to point out to Geo Swan that the references he has offered on your page are for an entirely different film. It may not deter him but it might at least spare you a long-winded talk page discussion about some imagined slight. By the way, User:Neptune's Trident continued his self-promotion by linking to the trailer for his movie on en:Ron Thompson (actor) and en:Thorsten Quaeschning. Hi Ritchie333, I'm sorry to see that you've been templated here – without even to a pointer to the file in question. We do not know each other but as it happened, I followed some odd link pointing to Giano's talk page and found there by accident your comment about Commons. As I am always somewhat curious when people rant about Commons, I had a look at some of your contributions here. Please allow me to comment on some of them:
  • This deletion request has been closed correctly. Yes, it was your photograph (nobody contested that) but it was a derived work as it depicted a large screen where a still of a live recording of the speaker can be seen. This still is protected by copyright and we cannot keep your photo here at Commons as long as we do not have a free release for the depicted still as well. This may be frustrating but this simply follows copyright law in the United States and elsewhere. Please note that fair use is not accepted at Commons. Unlike other WMF projects (like en:wp) Commons has to be very strict in this regard per this WMF resolution.
  • Going through your deleted contributions, I noticed that you provided a comment for File:Kaz Hawkins.jpg which was subsequently deleted, writing talked to the uploader via email, they confirmed they have emailed with evidence of permission. I've found the corresponding ticket. Unfortunately, there was just a permission but no release under a free license by the copyright holder. Instructions on how to do this properly are to be found at COM:OTRS and COM:ET. Pointers into the right direction were given by the OTRS member who processed that ticket but there was never a f'up.
  • Commons has a very diverse and international community with many people who are not native speakers of English. Some language which is commonplace at en:wp is seen problematic at Commons like in this edit where you claim that Commons is plagued with jerks. Likewise is swearing like just above (Fuck, what is wrong with this place?) not mellow. Please see Commons:Staying mellow for our approach at Commons. And please do not assume bad faith as you did in this edit comment.
  • This comment reflects a misunderstanding of Commons policies. Deletion requests are not closed per majority or even consensus. Whenever an admin is convinced that a deletion is required (for example because of a copyright violation), they have to close with delete. However, a closure should address the concerns and points raised during a discussion and provide a more elaborate rationale in non-trivial decisions. However, fact is that we have to delete c. 3000 files every single day. The natural thing is to ask the closing admin if you do not find a closure convincing.
  • And finally a recommendation for en:wp regarding your question how to protect files uploaded there against an unwanted transfer to Commons. I recommend the use of the {{Do not move to Commons}} template. You could, for example, give a pointer to the corresponding deletion request at Commons in the reason field. However, as you know, fair use cases should be tagged with {{Non-free use rationale}} which likewise protects against a transfer.
Commons can be a great place, even if things are in some aspects run differently than at en:wp. Please feel free to contact me if you think you are at odds with Commons again. @AFBorchert: Hi, and thanks for reaching out. I'm sorry I had a bit of a grump above, but if I'm honest it was basically me concluding that Commons is not for me and I should look elsewhere. I don't dispute your explanations on policy, you've done far more work here than I ever will, so that's kind of a given, but I'm simply looking at this as an outsider. If I put a particular type of article on Commons, it will get deleted; if I put the same image on Facebook or Instagram, it won't get deleted. Therefore, why would I use Commons when I can use Facebook or Instagram?
About OTRS; I don't disagree with your assessment of how policy works; the trouble is that negotiating OTRS tickets is too difficult for certain classes of people. My mother's a retired schoolteacher who by all accounts was excellent at her job (which is what probably kept her in gainful employment against competition 40 years younger than her). She can just about wrap her head around email, and she can take photos on her iPad. OTRS applications are not in her lexicon; again, she can think "Why would I do that? I can just hit 'Upload Photo' on Facebook!"
I stress that I'm not trying to attack Commons or anything it particularly stands for; rather that for certain classes of people, the site is not for them and they should leave with their dignity and good-standing on the project intact. Ritchie333 (talk) (cont) 20:47, 1 July 2019 (UTC)[reply]
Hi Ritchie333, the point is that we at Commons care about reusers of the media uploaded at Commons outside our projects. As longtime OTRS member I'm familiar with a number of cases where people who reused material at Commons in good faith got costly cease and desist letters. And this includes also derived works where the uploader was the photographer. We learnt our hard lessons through the years and try to make sure that photos linked to OTRS tickets can be safely reused and that copyvios are weeded out. Facebook, Flickr and many other social media sites are overwhelmed with copyvios. We systematically collect questionable Flickr accounts and are proud that WMF gets a surprisingly low number of DMCA notices for media stored at Commons.
