Images from Flickr

Hello Tabercil. I am not a native english speaker, and my knowledge about licenses and authorizations is very limited. Images from flckr are often uploaded on Commons, and there is a lot a images of actresses on "flickr" (for example by the user morbisthoughts, here) ; do you know if we can uploaded them too ? Thanks by advance. Yours, Delias 23:57, 24 October 2006 (UTC)

WWE Flickr photos

Just to let you know that I've put the Flickr WWE photos you uploaded up for deletion. The author of those photos has changed the licensing over to All Rights Reserved this week, making it no longer free. --Oakster 19:34, 23 January 2007 (UTC)

I'll drop the author a line. I've a number of emails from him which make his intention clear to have the picture available on Wikipedia; the earliest one I can get my hands on is this one:

Sorry for the delay I have been away. Yes, you can use any image or images you want for your project. If you have time send me a link so I can see what you've done just out of interest. Good luck. In future if you need a quick reply please write to me at: chalk42002@yahoo.co.uk Terry.

Subsequent emails also document some frustration with the process of how you go about changing the license on the pics on Flickr. I suspect he went to change the license on the non-wrestling pics to "All Rights Reserved" and accidentally caught the wrestling ones up in the change. In the interim, I will contest the deletions. Tabercil 20:27, 23 January 2007 (UTC)

And from a further email from the author made at a later date (we switched email accounts partway through the exchange):
I don't know if this will work but if it does please let me know. This is all the photos I shot that night and you can use as many or as few as you want. Best of luck. I will have to find time to look closely at rights on flickr. But right now I haven't got a minute. I hope this will help.
So I'm rather sure this is an accidental mixup on the author's part. Tabercil 23:26, 23 January 2007 (UTC)

  • License applies to all images on lukeford.net. In short, you're wrong. Tabercil 23:20, 15 January 2008 (UTC)

Image James McAvoy and other pix from lukeford.net

Dear Tabercil, I'm sure you didn't do this on purpose but most of the images you have uploaded from lukeford.net are copyrighted by Getty Images, Wire Image, etc. I read the permission from Luke ford that you have posted which says you can use pix photgraphed by him. the problem is the pictures you have taken from that site have been taken by other photographers.

For example, the photo of James McAvoy was taken on December 9,2007 at the Hollywood's Life Magazine's 7th annual breakthrough awards. If you go to the lukeford.net that you provided on the McAvoy page and click on the link "More pics" just under the photo of James Mc Avoy, you'll be taken to page of photos taken by Getty photographers at the event. On that page you'll see the pic of Mc Avoy that you uploaded. ...under that pix the photographer's name is listed, which is Charley Galloy (not Luke Ford).. so regretfully this great pix of McAvoy must be removed as it owned by Getty

You have uploasded so many pix from that site and frankly, I don't have the time to check out the copyright status of all those pix....I leave that task to you.....but the majority of these pix were not taken by Luke Ford and most of them are owned/copyrighted by Getty, Wire Image, and other stock photo companies. THIS IS VERY SERIOUS. Please when you have time correct these errors. sincerely --Danwex 04:00, 18 January 2008 (UTC)--Danwex 04:00, 18 January 2008 (UTC)--Danwex 04:00, 18 January 2008 (UTC)danwex

  • Bullshit. Luke is simply linking to photos taken by other people at the events! Look... here is all the photos taken by Galloy which are on Getty Images of James McAvoy. Long list as it's exactly one image. Here is the full set of photos taken by Luke at the event. If you peruse through all those photographs of Luke, you will see only two images: this one and this one. NEITHER of the images present on lukeford.net matches the image present on Getty Images. Tabercil 05:51, 18 January 2008 (UTC)

Image Jennifer Love Hewitt

Dear Tabercil..it's me again, i.e. danwex... the photo of the lovely Jennifer Love Hewitt that you uploaded was taken by Michael Tran for Getty Images and must be deleted. You have to search around a bit the lukeford.net site to get this info but it's there..On that site go the 7 dresses event..press Jennifer Love Hewitt under Getty pix and you'll find the info that the photo was taken by Michael Tran and is not copyright free... sorry to be the bearer of bad news, sincerely danwex--Danwex 04:17, 18 January 2008 (UTC)--Danwex 04:17, 18 January 2008 (UTC)

  • This is asinine. The reason Luke Ford was able to take those photos was because HE WAS THERE! Look... here's the list of photos taken by Mr. Tran at the 27 Dresses event for Getty. NOWHERE on that list of images are the ones that are present on lukeford.net! If you're going to accuse Luke of plagiarism, you need to point to specific images which are identical! Tabercil 05:50, 18 January 2008 (UTC)

I've emailed Luke about your statement re: Jennifer Love Hewitt. His reply to me in it's entirity:

Well, on some of the events, I have video as well and you can hear my voice. Not on this one in particular because I did not take video of that event. The guy is nuts. Getty Images pics are watermarked...and decidedly better quality than mine. These photo agencies aggressively police their images. If you had been using their images, you would've heard from them.

You can see the complete list of events that Luke did attend in person here. And one such example of where Luke does have video would when he did the red carpet at the Pink Eye premiere, which can be found here.

To put it kindly, you're talking out of your ass. Tabercil 06:14, 18 January 2008 (UTC)

Um, that is not "kindly," please reconsider the tone of your comments. TAnthony 03:30, 18 March 2008 (UTC)

Lorenzo Lamas

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful informations about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.

Odd. Image got deleted although the issue may have been resolvable. When the image was uploaded here, the flickr license was cc-sa. A couple hours later it was changed to cc-nc. I've contacted the flickr user; waiting for a reply. Gimmetrow 11:14, 27 May 2008 (UTC)
I contacted the user about changing the license on the image he had of Cynthia Nixon on his page. Then he emailed me about this image, which we couldn't use. But I spotted a similar image on his page which did have the proper license and uploaded that... let me know what Staneky comes back with. Tabercil 13:14, 27 May 2008 (UTC)
No direct response. The original image was changed to by-nd. The other image (with the border) was originally by-nd, but it is currently just "by". Please check this yourself if you want. Gimmetrow 22:35, 29 May 2008 (UTC)
Well the image that I uploaded was a crop of the larger original in order to focus on Kristen. So if we were to change the source of the image from the borderless image to the bordered one, we'd be completely in the clear, right? Tabercil 00:25, 30 May 2008 (UTC)
The licenses keep changing so who knows. To be safe, though, derivate works could be based on the "by" work, in case the bordered image includes any resampling or other modification. Gimmetrow 21:21, 31 May 2008 (UTC)

Hello Tabercil/Archive 1!

Thank you for providing images to Wikimedia Commons. Please keep in mind that images uploaded to Commons should be useful to all users of Wikimedia projects. This is possible only if the images can be found by other people.

To allow others to find the images you uploaded here, the images should be in some place that can be found by navigating the category structure. This means that you should put the images into appropriate topic pages, categories, optionally galleries, or both of them (see Commons:Categories). To find good categories for your images, the CommonSense tool may help.

You can find a convenient overview of your uploaded files in this gallery.

The important point is that the images should be placed in the general structure somewhere. There are a large number of completely unsorted images on Commons right now. If you would like to help to place some of those images where they can be found, please do!

Thank you. BotMultichill (talk) 13:05, 26 June 2008 (UTC)

No probs... I'm finally starting to get some details behind the "why". Now all I need to is drag out more details about who was making the complaint; once I get that then I can advise on whether there's any substance to it. Tabercil (talk) 05:53, 28 June 2008 (UTC)
I wish I could provide you with more info, but to be honest, there's not really anything on OTRS accept for some vague accusations that the images from Luke Ford's site(s) are not his. No site emailed OTRS about false licensing, AFAIK. From what I can gather it was one person's speculation (who could be right) and the only "OTRS" suggestions on OTRS were to put the whole collection up for deletion and not allow future uploads under that ticket until it can be verified—both of which are perfectly acceptable actions and are what should have been done (a deletion req., not a behind-the-scenes speedy deletion). Anyway, I'll encourage those involved to come forward and help us solve the issue. Rocket000 (talk) 06:03, 28 June 2008 (UTC)

Luke Ford thing

Thanks for helping sort this all out.

Following your lead, I had uploaded many additional Mika Tan pics from Luke Ford (and spent considerable time getting her wikipedia page in shape as well).

In any case, I see that most (all?) of the files in the Category:Mika_Tan have been restored, so I'm going to start fixing pages that linked there - unless you tell me not to (e.g. some script will be taking care of it).

Chewyrunt (talk) 16:45, 29 June 2008 (UTC)

I'd advise holding off on replacing any missing pictures. Let's see if they can restore the remaining ones before we go and overwrite things. Tabercil (talk) 16:48, 29 June 2008 (UTC)
I meant pages that linked to the commons, not the commons itself. But I'll give it a few days - Chewyrunt (talk) 21:31, 29 June 2008 (UTC)
And from the noises that are being made it looks like everything's been cleared up. Tabercil (talk) 06:33, 30 June 2008 (UTC)
And so it has! I got pretty worked up there for a bit but things worked out OK in the end - faith in humanity restored etc. Chewyrunt (talk) 03:03, 1 July 2008 (UTC)

My apologies

I'd like to apologize to you personally for deleting the majority of the lukeisback images, seeing as you uploaded a lot of them. It was my mistake and I accept the fact that I deleted the images without prior on-wiki discussion. Hopefully everything can be cleared up in the next few days. — Mønobi 05:21, 30 June 2008 (UTC)

Thank you for that. Tabercil (talk) 06:32, 30 June 2008 (UTC)

Warning sign
This media may be deleted.

Thanks for uploading Image:Mason_Marconi_in_corset.jpg. I notice the image page currently doesn't specify who created the content, so the copyright status is unclear. If you have not created this media yourself then you need to argue that we have the right to use the media on Wikimedia Commons (see copyright tagging below). If you have not created the media yourself then you should also specify where you found it, i.e., in most cases link to the website where you got it, and the terms of use for content from that page. If the content is a derivative of a copyrighted work, you need to supply the names and a licence of the original authors as well.

If the media also doesn't have a copyright tag, then you must also add one. If you created/took the picture, audio, or video then you can use GFDL to release it under the multilicense GFDL plus Creative Commons Attribution-ShareAlike All-version license or PD-self to release it into the public domain. See Commons:Copyright tags for the full list of copyright tags that you can use.

Note that any unsourced and untagged images will be deleted one week after they have been uploaded, as described on criteria for speedy deletion. If you have uploaded other media, please check that you have specified their source and copyright tagged them, too. You can find all your uploads using the Gallery tool. Thank you. Nudity?

Would it be possible to replace some of the photos you uploaded int the 'striptease' section with versions that blur out slightly some of the nudity. It would still be identifiable as to what a striptease really is but just make it a bit more child/family friendly.

Tabercil, congratulations! You now have the rights of administrator on Commons. Please take a moment to read the Commons:Administrators page and watchlist related pages (in particular Commons:Administrators' noticeboard and Commons:Deletion requests), before launching yourself into page deletions, page protections, account blockings or modifications of protected pages. The majority of the actions of administrators can be reversed by the other admins, except for history merges which must thus be treated with particular care.

Please feel free to join us on IRC: #wikimedia-commons on irc.freenode.net. There is also a channel for Commons admins, which may be useful for more sensitive topics, or coordination among administrators: #wikimedia-commons-admin.

Also consider joining #wikimedia-admin, the cross-wiki coordination channel for Wikimedia administrators. Ask any channel operator for an invite exemption (or anyone in the channel may /invite you in temporarily). All admins from all projects are welcome.

You may find Commons:Guide to adminship to be useful reading.

I know who is Guzzzz, I called Arthur Nunes even have an account here> Arthur Nunes, which I remember the password, all the pictures I put in the Gym Flicker for you prove, I can send you more photos of the same camera on the same site with my photo including: [1]

Ah... well the Flickr images are probably the easiest to fix if you are indeed the copyright holder... just change the license on them. Tabercil (talk) 02:33, 7 January 2009 (UTC)

The photos are mine, which I define where I want to leave the post, agree? Uberlândia Sockpuppets

Dear Tabercil, Please take a look at the images uploaded by Guzzzz (talk · contributions · Number of edits:), Baddin (talk · contributions · Number of edits:), Scoobydoo (talk · contributions · Number of edits:) and Augusto Penatti (talk · contributions · Number of edits:). Most of the images they upload are copyrighted. Now, the user has reuploaded some of these images on Flickr with an "attribution license", but in fact the images are not even his! I believe it's an old case of sock puppetry: [3], [4], [5], [6], [7] and [8]. The users Guzzzz (talk · contributions · Number of edits:), Baddin (talk · contributions · Number of edits:), Scoobydoo (talk · contributions · Number of edits:) and Augusto Penatti (talk · contributions · Number of edits:) cannot be trusted. Could you do something about it? I'm tired of looking for their copyrighted images over and over again. Best regards, --Juninho01 (talk) 08:10, 8 January 2009 (UTC)

Joan Allen/Joely Richardson image

Hello Tabercil, I only ask you this because I see that you have worked on this image and I'm not sure what to do.

File:Joan Allen at the Bourne 3 premiere.jpg is named as a picture of the actress en:Joan Allen however an editor has noted that it is not her, but en:Joely Richardson, and I think that is true. I'm not sure how to fix it. Should it just be uploaded again with a different file name and have the incorrect file name deleted? Is it ok to do this and just copy the licensing/confirmation information from the first image to the second. I've never seen this sort of mistake before. If you can point me in the right direction, I would appreciate it. Thanks Rossrs (talk) 11:03, 8 January 2009 (UTC)

Yup, that's her. I checked against Getty Images to see if Joely was there and if so, what she was wearing (and no, we don't seem to have a copyvio here). What I've done is swapped out the usage on the other sites for a known image of Joan, and tagged File:Joan Allen at the Bourne 3 premiere.jpg for renaming. Tabercil (talk) 23:58, 8 January 2009 (UTC)
Thank you for looking at this. If it ever happens again, at least I'll know what to do. Rossrs (talk) 06:37, 9 January 2009 (UTC)sitio

Defaultsort fouled up filing

Hello! Sorry for not leaving this at enWP but I do not use that project. You added a DEFAULTSORT to 3 images I uploaded: Ewa Fröling, Eva Bysing and Berit Carlberg. The thumbnails then began to appear misfiled on our category page at Category:Southerly Clubs Image Archives. I don't know why that happened, but I had to remove your last input on each image page to get them back in the alphabetical order I want them in there. Any ideas as to what went wrong? EmilEikS (talk) 03:24, 2 February 2009 (UTC)

Defaultsort applies the sort order to all the categories in question for the picture. I was working on sorting out the pictures in the Category:Actresses from Sweden and hadn't realized that the Southerly Clubs Image Archive had their own sort order. I'll place the sort order as being only for all the other categories. Tabercil (talk) 03:35, 2 February 2009 (UTC)

In cases of clear copyright violation, use of the copyvio tag is justified.

Edit: lol I just noticed you're an admin. Still, I think it meets the requirements for Speedy Deletion. Morgan Phoenix (talk) 23:32, 3 February 2009 (UTC)

Oh I quite agree it's probably a copyvio... but I decided to nominate it just in case it turns out to be the author uploading. If it's speedied, often there's not much feedback to the uploader. In all likelihood though, I expect the image will be gone by this point tomorrow... Tabercil (talk) 23:56, 3 February 2009 (UTC)
yeah I'm a production artist; I have to have at least a basic understanding of copyright law. In fact, I pulled out my copy of the AP Stylebook for Commons:Deletion_requests/File:About_archive.jpg. Barack Obama (comic character) Obamavariant.jpg

Could you explain or elaborate on how the Barack Obama comicbook cover does not fall under Fair Use. The nature of the subject would seem to dictate that some example of the comic is necessary, especially when attribution is fully disclosed. Did you look at the context for the image you deleted? Basically, any free use media is allowable here. This does not mean any old image you may stumble across on the Internet! What it means is it an image which has been placed in the public domain by the author. For instance, this image on my Flickr account has been placed in the public domain by me, as you can tell by the information in the "Additional Information" section. Also, pretty much any image that was created by an employee of the United States government during the duties of their job is in the public domain - that's why we have so many images that were taken by the U.S. Armed Forces (such as File:GuadLungaCleanup.jpg). What I would suggest you do is to read through Commons:Licensing for further details and a more thorough explanation than I can give. Tabercil (talk) 14:37, 28 February 2009 (UTC)

The original source for the Harper and Obama pics is here the Prime Ministers Office has posted them there, so anyone can take them and use them, including news organizations or Wikinews, which is where it is being used by me. • Which specific image are you referring to? The bulk of the images which you have uploaded have been of Colts players, and they've all been sourced back to other places. Tabercil (talk) 21:31, 9 March 2009 (UTC)
    • Reply to Tabercil: no, smart ass! i'm talkin about a photo i took with my own camera during a paramore concert! i'll upload it again and see what happens!—Preceding unsigned comment added by Coltsfan (talk • contribs) 12:03, 10 March 2009 (UTC)
      • I assume you're referring to File:Taylor1.jpg. I looked back and found your original upload - File:Taylor.jpg. That was no my deletion - instead it was tagged by a different person as source missing and deleted on that basis. The problem is, you have only yourself to blame for that. All you other prior uploads of copyrighted material were tagged as "Own work". For example, File:Vinatieri.jpg had a source of "own work" but was found to be from here. Another example: File:Peyton-manning-orchestrates.jpg was found to be from here but you said it was "Own work by uploader". So I guess those admins no longer believed you when you said that Taylor1.jpg was your own work... after all, you lied at least twice about where an image came from. Tabercil (talk) 21:43, 10 March 2009 (UTC)

          • Nah... I reckon you've realized how seriously we take copyright here - pretty damn much so. If you're willing to work within the rules, then all I can say is "good luck". Tabercil (talk) 00:38, 11 March 2009 (UTC)

Hello, Tabercil!

Tip: Add categories to your images

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

Uploadwizard-categories.png

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations"). Pro-tip: The CommonSense tool can help you find the best category for your image.

Thanks again for your uploads! More information about categorization can be found in Commons:Categories, and don't hesitate to leave a note on the help desk.

Polatstern—Preceding unsigned comment added by Polarstern (talk • contribs) 08:51, May 29, 2009 (UTC)

  • It's simple. I deleted the photos as I felt they were out of scope for Wikimedia Commons. As it says there: "Examples of files that are not realistically useful for an educational purpose: Files that add nothing educationally distinct to the collection of images we already hold covering the same subject, especially if they are of poor or mediocre quality." (emphasis mine). Since they were quite blurry, I felt it was a no-brainer. Tabercil (talk) 22:12, 29 May 2009 (UTC)

Right on the source page, under "Photo reuse", where it should be. --GRuban (talk) 13:15, 14 June 2009 (UTC)
In fact, you're not getting away as easily as an apology and removal of your tag! :-) As penance (and so this doesn't happen again), I would appreciate it if you would go down the following list of PicasaWeb images I've recently uploaded, check that they are, in fact, licensed the way I say they are, and stamp them with the official template:Flickrreview Trusted User Seal of Approval, so the next Flickr-experienced-but-PicasaWeb-unknowing admin doesn't tag them the way you just did. The link to the Creative Commons license is on the right hand side, under "Photo reuse", with the text reading "some rights reserved" and much the same Creative Commons icons as Flickr uses.

Thanks. --GRuban (talk) 13:47, 14 June 2009 (UTC)

Erm... my apologies for the tag; as you pointed out, I'm more used to dealing with images coming from Flickr. As for acting with the Flickrreview tag, that's appropriate for Flickr-sourced images... I don't know if we have similar for Picasa-sourced. Tabercil (talk) 14:56, 14 June 2009 (UTC)
We don't. We probably should; I can start that, I guess. But I'm not as much worried about the actual template as I want an "admin or trusted user" to vouch for the licenses of these files, in a way that others can also check. The Flickrreview template is a lot better than nothing. If you could be so kind. It's not as if there were a hundred of them after all. --GRuban (talk) 11:52, 15 June 2009 (UTC)
There is such a thing! Template:LicenseReview.--GRuban (talk) 11:58, 17 June 2009 (UTC)

Hi Tabercil. Thanks for catching the Flickr washed file. I'm feeling a bit awkward to have uploaded one, but I guess there is a first time for everything. Good work. --Kanonkas // talk // CCD // 09:54, 28 June 2009 (UTC)

No problems. I'm always a shade suspicious of files from Flickr, especially when they're of the "too good to be true" sort. So when an account has a great photo, and only two images present, I'll do the digging needed to prove or disprove it as being a copyvio. Believe me, I'd've love to have had my suspicions disproven and the photo turn out to be legitimate. Tabercil (talk) 18:49, 28 June 2009 (UTC)

Hello!!

I saw the image i uploaded it was deleted... In that case, what license i should choose for this type of image, here in Wikimedia Commons?!?

Best regards and thanks for you help. Lightwarrior2 (talk) 06:38, 4 July 2009 (UTC)

proper deletion requeast procedure

hi;

i don't agree with your point of view re: anatomical photography, but if you're going to nom things for deletion, you should at least follow the rules & tag every item properly.

you're an admin, it makes a joke of the rules & procedures if you violate them like this.

i'm sorry, but you should know better, & if you don't, then you shouldn't be an admin

Lx 121 (talk) 07:45, 10 July 2009 (UTC)

in reading deeper, i note that you also sent the uploader (User:Longnh) a message asking them to "respect the rules"; all the more reason that you need to do the same.

Lx 121 (talk) 07:58, 10 July 2009 (UTC)

3rd point, in re-reading your deletion rationale:

where exactly in commons rules & policy do you find the authority to "speedy penis-pics"? i seen to have missed that in my reading, please direct me to the proper place in the rules for that admin action.

Lx 121 (talk) 08:05, 10 July 2009 (UTC)

I'm looking at Commons:Project_scope#Censorship which says
"Photographs of nudity and male and female genitalia are sometimes uploaded for non-educational motives, and such images are not exempt from the requirement to comply with the rules on scope. Often (but not always) such images add nothing educationally distinct to the stock of such images we hold already, and hence fail the test of being realistically useful for an educational purpose.
"A balance has to be struck between on the one hand accepting legitimate new high-quality educational content that some may find offensive, and on the other allowing Commons servers to become swamped with large quantities of quasi-pornographic images created for recreational rather than educational purposes. The latter would harm the reputation of Commons as a good faith provider of educational content."
That's official policy. If I can look at an image and say "that's an image we can't make use of" specifically regarding a photo of male or female genetalia, then I feel I can speedily remove the image. We are not a photo host - if you want to put your picture of your junk on the net, use Flickr. We are a photo host of educational material - there is a difference. A cookie is a way that a web site keeps information on a web browser, in this case your wikimedia user login status. Your web browser seems to be set up not to accept cookies, so wikimedia can't log you in.
Different makes and versions of web browsers have different places to control whether cookies are accepted. One version of Firefox, has a Preferences dialog under the Edit menu, where, under the Privacy tab, you need to make sure "accept cookies from sites" is selected. (Or you can try to just accept cookies from wikimedia and wikipedia sites, but that can be complicated.) On one version of Internet Explorer, you can find something similar under the Tools menu, Internet Options dialog, Privacy tab. Other makes and versions of web browsers should have something similar somewhere, but you may have to poke around a bit in menus and dialogs to find it. --GRuban (talk) 14:13, 30 July 2009 (UTC)

File:Mario Bros..png

Can you explain how that image violates copyright? That image was released into the public domain by the erector.--Launchballer (talk) 08:28, 5 September 2009 (UTC)

The image itself may have been released by the artist, but the contents of the image feature copyrighted characters which belong to Nintendo. As a result, barring a clear statement of release from Nintendo, I felt it was best to remove the image. Tabercil (talk) 12:16, 5 September 2009 (UTC)
Oh, right. I thought that because it was released, I could use it. The thing is though, I'm drafting some talk bubbles on my userpage, and I'd like to use that as the second example image, so I ask politely that it be restored.--Launchballer (talk) 17:34, 5 September 2009 (UTC)
As I said, if you can show clear consent from Nintendo, then I'll restore it. If you disagree with my decision, you can always appeal to Commons:Undeletion requests. Tabercil (talk) 17:40, 5 September 2009 (UTC)
How on earth am I supposed to get that?--Launchballer (talk) 21:08, 5 September 2009 (UTC)
If you mean Nintendo's consent, that's your responsibility. If you feel you don't need it, then by all means try the undelete process. Tabercil (talk) 22:46, 5 September 2009 (UTC)
Right. FYI, I found the image here--Launchballer (talk) 07:37, 6 September 2009 (UTC)
Okay, looking there for the source for the image takes me to this page, where it can be found at the bottom. Comparing that to the American box cover image found at the very top of the page makes it very clear that the image in question is nothing more than the box cover artwork minus all the extraneous artwork, so that only the characters remain. Since the original box cover is definately a copyrighted image, the Mario Bros.png image is equally a copyrighted image. So there's almost no chance of this being undeleted. Sorry dude... Tabercil (talk) 12:54, 6 September 2009 (UTC)
Is it just here that that would not be allowed, but on just Wikipedia, would I get away with it on just that site?--Launchballer (talk) 13:45, 6 September 2009 (UTC)
On the main Wikipedia? Yes you would be able to upload it, but only for use in an article. And you definitely wouldn't be able to put it on your userpage, as only free-use images are allowed there (per here). Tabercil (talk) 17:11, 6 September 2009 (UTC)

Flickr TIFF09

Dear Tabercil, you've recently uploaded images of the tiff09 event from Flickr. Could u just please when naming file use the preexisting scheme? ("Name" "Film" "TIFF09") ? Cause it happens a lot that the same actor/ress stars in two different films at TIFF09 whereby the naming of the Film would help. Thank you and please if you have some time try to convince more people on flickr to release their tiff09 images as CC-by-sa or CC-by, it's not hard I succeeded in convincing 4 to release their tiff images.--Diaa abdelmoneim (talk) 01:10, 15 September 2009 (UTC)

Umm... that's news to me - that we have an existing scheme. Considering how most files here tend to get named any which way... I mean, take a look at any category featuring a celebrity. The reason I uploaded the files using the names I did was so that I knew that it would be most unlikely that there would be any conflict with an existing image. It also helps that I use Magnus' Flickr bot (which I find works much faster) because it will rename the upload if there is a conflict. Lastly, I think I've had a history of success with getting uploads to Commons. <G> Tabercil (talk) 03:15, 15 September 2009 (UTC)
There isn't an existing scheme. I just wanted the same actors to be next to each other in the TIFF09 Category that's all. Feel free to rename or name them as you want... Great work on those released images, should have seen that before asking about that. Nice finding more people who try to get image releases :) --Diaa abdelmoneim (talk) 12:59, 30 September 2009 (UTC)

Commons:Deletion requests/Waffen-SS Sinimäed

Thanks Tabercil for taking care of this. There is still one problem I can see remaining, the image description you chose seems unfortunately misleading: "including Estonian Waffen-SS members" implies like there is/were Estonians who were members of the Waffen-SS - condemned as a criminal organization. Unlike the reqular Waffen-SS that consisted of volunteers, the Estonians who got conscripted into German military forces by the end of the war and were put by the Germans under the Waffen-SS umbrella only because 'racially not pure foreigners' were not allowed to wear the Wehrmacht Uniforms were by no means any 'members' of the Waffen-SS but conscripts drafted during the general mobilization call by the Germans in occupied Estonia. I do think that the vets who were put under the Waffen-SS command against thier will would find it highly offensive to get labeled as the "members of the Waffen-SS". Therefore I'd suggest clarification on the image description: Instead of "including Estonian Waffen-SS members" lets say "former Estonian conscripts in the W:20th Waffen Grenadier Division of the SS (1st Estonian). Thanks!--Termer (talk) 01:37, 23 September 2009 (UTC)

Hmm... I can see where you're intending to say, but that's going a bit too detailed for a description. I'll change it to "including members of the W:20th Waffen Grenadier Division of the SS (1st Estonian)", and the link will provide further details regarding the unit and details around the conscription. Tabercil (talk) 03:18, 23 September 2009 (UTC)

Batch uploading from flickr

Since you upload from flickr a lot I would like to point you to the flickr section on Commons:Batch uploading where batches can be uploaded easily. You could even help by batch uploading yourself since that isn't hard anymore through Flickrripper which easily uploads images through sets or photostreams.--Diaa abdelmoneim (talk) 13:02, 30 September 2009 (UTC)

Huh. Thanks for the heads-up. By and large I don't believe in wholesale uploads of Flickr photos to Commons... however I do have one set of photos which I've already grabbed some photos from and which I'll point that that bot to in order to grab the balance. Scusa. Credevo che potessero essere inserite immagini di sesso con me come protagonista. .--Maxy1992 (talk) 14:22, 24 October 2009

The problem is the images are already out there on the 'net already, and as a result it's difficult to establish authorship. I decided to err on the side of caution in speedily deleting the images. If you have clear evidence that you own the images in question, let me know then. Tabercil (talk) 12:31, 24 October 2009 (UTC)

Escudos NBA

¿Porque eliminas las imagenes de los escudos de la NBA? son de contenido libre como muestra la pagina de flickr de donde las he cogido. Además, el bot flickreview las ha aceptado como válidas. ¿A que se debe? 2pac (User talk:2pac) 15:32, 4 November 2009 (UTC)

Just because an image is on Flickr as having a Wiki-friendly license does not mean that it is usable on Wikipedia - see COM:FLICKRWASHING. The NBA logos are all copyrighted images owned either by the team itself, or by the NBA. As a result the only circumstance we would be able to have the logos on site is if we had a clear release from the copyright owners. Tabercil (talk) 01:27, 5 November 2009 (UTC)

Movie Poster for No one's normal when you're near

Hello, you've erased the file De_cerca_nadie_es_normal_poster_english.jpg wich I uploaded, saying that it was an infringement, because it was a movie poster.

The thing is that I made that poster myself, and that's why I stated that it had that license. I understand that you might not believe this, but I really don't know in which way I may prove this to you.

Please let me know if there is any way, or if just by writting to you, it's ok. —Preceding unsigned comment added by Andiaro (talk • contribs) 17:34, November 10, 2009 (UTC)

(Copy of the answer I left at the User's page): My apologies. When you see so many people uploading clearly copyrighted material and saying "I created it", you grow jaded at the claims...  :/
What I've done is restored the poster, and added an OTRS-pending tag to it. What I would suggest you do is to read the instructions at OTRS to make sure what you need to say. When you send the email, state in it that you are the person who created the poster and as such you have the ability to put the poster in the public domain. (Note: I'd suggest making sure this is okay with the people at NoMade Films first). Once that email is received, then an OTRS volunteer will tidy the image page up and you shouldn't have any future problems with deletions.
If you have further questions, let me know and I'll more than happy to help out. Tabercil (talk) 23:23, 10 November 2009 (UTC)

HollyMarieCombs02.jpg

I just uploaded this image a few minutes ago. Apparently, you deleted it for copyright violation. There was no copyright violation as this was plainly uploaded under Creative Commons attribution 2.0. Since there was no other explanation, I've come to you because you are listed as the one who deleted this image. Please undelete the image, or inform me as to why you cannot. Then I shall reupload the image barring any further evidence of copyright infringement. Thank you very much.
Paine Ellsworth (talk) 01:59, 23 December 2009 (UTC)

If you take a look at the page for the file, you'll see my rationale for the deletion - Flickrwashing. A quick search via the TinEye website shows that the image can be found on 28 other websites, and that's just the ones that TinEye indexes. Given the high number of hits, I would say that the image was not taken by the Flickr user named Math Luis and as such he does not have the authority to issue the image under the Creative Commons license. In fact, I think the image is a publicity photo from the Charmed TV series and that copyright lies with the producers of the show, who are most certainly not Math Luis. Tabercil (talk) 04:54, 23 December 2009 (UTC)
Thank you, Tabercil, I shall try to be more careful from now on. Happy Times!

Heart Truth Flickr account

Hi there. I'll pass your request for action to the person who maintains THT Flickr account. I believe she updated licenses for the 4 new images from Feb. 2010 that figure into The Heart Truth Wiki page. If images are licensed on Flickr in way acceptable by the Commons, and I have copies of exact same images but in higher resolution, is it a problem if I upload my copies instead of what's on Flickr?

Thank you, Andrei.

Offhand, I doubt it. I think it'd be best to wait until the Flickr licenses are resolved first that way there's less of a problem down the road. Tabercil (talk) 14:10, 27 February 2010 (UTC)

On the behalf of the Wikiproject medicine at the en.wikipedia, I am inviting you to be a part of the discussion going on the project's talk page about Patient images, The discussion started after I obtained a permission to more than 23000 dermatology related images, and about 1500 radiology images. As some editors of the Wikiproject medicine have some concerns regarding the policy of using patient images on wikipedia, and regarding patient consents. I see you deleted the four images I put up as OTRS permission missing. I have sent a follow-up email to OTRS on the 13th which should resolve the outstanding issues, subject was "Ticket 2010010310016751 resolution?". Can you please process it ASAP? Tabercil (talk) 22:50, 22 March 2010 (UTC)

I can't find that email, I'm afraid. Stifle (talk) 09:41, 23 March 2010 (UTC)

2010 Olympic Winter Games

Why did you remove the "in + country" entering? I know it all was in Canada, but it's still related to the year in the country. J 1982 (talk) 15:01, 28 March 2010 (UTC)

I personally take the "Year in Country" as referring to events that happen in that country, not about events that relate to that country and by doing that we help keep focus on what the category is about; otherwise it would get rather diffuse in a hurry. I mean, by your reasoning, if we have someone from a different country in a sporting event, then we would need to add the "Year in Country" to that sporting event. So, no. Tabercil (talk) 15:18, 28 March 2010 (UTC)
Wikipedia has related events in those categories. J 1982 (talk) 15:32, 28 March 2010 (UTC)
I assume you mean the English language Wikipedia. But in any case, that's there and not here. Remember, it's events in that country, not events about that country. Tabercil (talk) 15:34, 28 March 2010 (UTC)
So does even th Swedish language Wikipedia. But I don't know if there's any policy here how to do with related events. J 1982 (talk) 16:10, 28 March 2010 (UTC)
Perhaps a category called "Year about Country"? Mind you, whether it'd survive review by other admins is uncertain given how likely such a category would sprawl ... Tabercil (talk) 16:48, 28 March 2010 (UTC)
They are called "in", both in English and Swedish. J 1982 (talk) 18:33, 28 March 2010 (UTC)

Deleted Pm_members.jpg ->Press Kit picture

The picture "Pm_members.jpg" is part of Pagan's Mind's Press Kit for free distribution. See also http://pagansmind.com/mainsite/index.php?option=com_content&task=view&id=36&Itemid=58 for license info. Please put it back up, thank you!—Preceding unsigned comment added by Triryche777 (talk • contribs) 06:43, April 17, 2010 (UTC)

  • Well I wasn't the person who deleted it as a copyright violation, but if you look at the bottom of the source page, you'll see it says "Copyright 20©09 - All Rights Reserved - Pagan's Mind". As such we cannot use the photo without explicit written permission from Pagan's Mind by which they consent to licensing the photo as free use (see COM:L) - thus the tag which I placed on the photo. If you can provide such permission, I will be happy to restore the image. Tabercil (talk) 19:25, 17 April 2010 (UTC)

So what you're saying is that I need to put the link of where I got the images from??--EvaGranados (talk) 18:27, 29 March 2010 (UTC)

That is exactly what I am saying. We have to verify what the license is on each of the individual images on the collages. I'll cheerfully do what legwork I can for that, but I need to know those sources first. Tabercil (talk) 21:33, 29 March 2010 (UTC)

I found the images in websites such as madonnashots and madonnalicious—Preceding unsigned comment added by EvaGranados (talk • contribs) 19:22, March 29, 2010 (UTC)

Ah. Those site are pretty much magnets for images from wherever, and frequently those images will have originally come copyrighted sources. Additionally, the madonnalicious.com site states that "All logos, images and pictures on this site are the property of their respective owners.", so the images are not available under a Wiki-friendly license. So, sorry but those three images you uploaded will have to be deleted. They can be hosted elsewhere (say Flickr) but not on Commons. Tabercil (talk) 11:50, 30 March 2010 (UTC)
I have received emails into OTRS from this user claiming to be the copyright holder of the three images. I am declining the requests to undelete the images as she does not appear to have the required rights. Stifle (talk) 10:53, 14 April 2010 (UTC)

File:Aerobics Oz Style - Clip 13.jpg delition

Will you explain whose copyright was violated in the File:Aerobics Oz Style - Clip 13.jpg, please? Shustov (talk) 04:05, 23 April 2010 (UTC)

Simple. It's the people who originally created the workout show. If you take a look at the YouTube video, you can see there's a blurb at the bottom saying "Aurora". I see that as being a station ID mark, which indicates it's from a broadcast TV show. Since the overwhelming majority of recent TV shows are copyrighted, it's safe to say this clip is copyrighted. Tabercil (talk) 04:45, 23 April 2010 (UTC)
I see the mark "Aurora" there but I have made a proper attribution to the original source in the file, namely: http://www.youtube.com/watch?v=Lb-0prF_4KU&feature=related. No copyright infringement, sorry. Shustov (talk) 06:59, 23 April 2010 (UTC)
No, no, no. The YouTube site is the copyright infringement - you're simply perpetuating it by taking a screenshot from it. It originally aired on Network Ten in Australia and was produced by Zero1Zero, so written permission would be needed from the latter before we could host material from the show. Hello Mr.Tabercil, Possible application : How do I upload pictures other license Look EmmaRoberts08TIFF.jpg, And see JohnCReillyJune09.jpg, And other licenses How ? Good Luck . --DC Comics (talk) 01:08, 19 June 2010 (UTC)

You'll need to write to the person whose Flickr account it is and ask them to change the license. Most of the times they'll do the license change on the Flickr page itself - for instance look at this image. You'll see that it has a Wiki-friendly license on the Flickr page; in contrast, the image immediately before it in that set (here) does not have such a license. Other times they'll agree to the use of the image, but won't change the license on the Flickr page. For instance, this image is still tagged as copyrighted, but the user emailed me a statement saying we could use it under our terms. So it's viewable on Wikipedia as File:Anna Wallner.jpg. But there's no guarantee they'll agree to use on Wikipedia - I get a success rate of about 1 in 3 when I email folks asking for the license change. If you're going to email folks, read this essay first for some pointers. Tabercil (talk) 14:20, 19 June 2010 (UTC)

Uploading earlier versions of OTRS images

I noticed that you had uploaded an earlier version of an image with OTRS permission. I'm not sure if this is OK or not, and I've asked here to get confirmation of what the permission was for, and am notifying you in case you want to follow what happens, or want to comment there. Carcharoth (Commons) (talk) 07:28, 31 July 2010 (UTC)

No idea. I had assumed the OTRS consent was for the original image, and I thought the original was interesting enough by itself that it should be available for use (which meant that it would be its own file). If the OTRS is for the head shot only, so be it. Tabercil (talk) 13:47, 31 July 2010 (UTC)

I think I'd better add that the copyright being violated is that of the creator of the waxwork. In many countries people have the right to make 2 dimensional representations (such as photos) of public sculpture, but not in the USA. The photographer released the image under a free license, which would have been great if only they had the right to do so. --Simonxag (talk) 20:49, 13 September 2010 (UTC)

Hello, why has the image been marked as a copyright violation for? Here is the link for the picture from flickr: http://www.flickr.com/photos/43533426@N04/4008413868/ as you will see it is Some rights reserved CC-BY-SA. Turco85 (talk) 10:10, 15 October 2010 (UTC)

Because the image can be found elsewhere online - a TinEye search for the image comes up with two results elsewhere. As a result I don't think the person who's account it it has the rights to put the image up with the CC-By-SA tags, and that's called FlickrWashing. Tabercil (talk) 12:34, 15 October 2010 (UTC)
Oh ok, well how am I meant to know for sure? Maybe the other online image is taken from Flickr and not the other way round, right? Anyway, I just messaged you the first time because you said I should pay attention to copyright which I did. Have a good day.Turco85 (talk) 19:43, 15 October 2010 (UTC)

Obama and Snooki images

Which is why I check which articles use a given photo prior to altering it. If I find it being used by articles in which the altered version would be inapplicable, then indeed I will upload the altered version separately. This was not the case with the Obama or Snooki photos, which are only being used in articles where the cropped versions are of better use. This is why I don't see why the considerations you point out apply to those two, nor why you and he decline to answer my quite reasonable question: If uploaded new versions over the old ones is not desired, why does every image file's page present a tool for doing so as an option? Using a tool whose link is on the same page as the image is far easier than one on a different page, and as long as that option is there, I'm disinclined to create new pages for each version of an image, particularly given the number of images I alter (most of which ones I take for use in specific articles). Nightscream (talk) 19:35, 30 October 2010 (UTC)

Well of course the Snookie image wasn't used in the terms I had described, but that kind of illustrates my philosophy. In terms of overwriting versus creating a new image, my personal philosophy is that an image should only be overwritten when the changes made are "minor". Now minor is one of those YMMV terms but I see it as more as a non-destructive clean-up (e.g., adjusting the exposure or some noise reduction). Cropping is a more significant change in that it removes data from the image and thus alters where the focus of an image is. I don't make use of the overwrite function given - I use instead the "derivitive version" upload bot for all the stuff which I create. Tabercil (talk) 23:20, 30 October 2010 (UTC)

File:Personal snapshot Janet at movie premiere.jpg

Very good work, spent already some minutes on that to find it. That kind of contribution - grabbing a press photo and uploading it with some innocent information like 'personal' 'snapshot' (and repeating it 3 times) etc is evil vandalism. I will never find out what the purpose is to add such images to a free content project, but for sure en:Janet Jackson is now on my watchlist. Thanks for your finding. --Martin H. (talk) 16:08, 22 November 2010 (UTC)

Thanks for the kind words - stuff like that is why I stood for adminship in the first place. As the saying goes, "if it looks too good to be true..." and it just smelled of it being from someplace like WireImage or such. Tabercil (talk) 20:50, 22 November 2010 (UTC)

Sockmaster Shinas/Anwar Sadaat

Thanks for helping me.:-) This is the SPI report in en.wiki - en:Wikipedia:Sockpuppet investigations/Shinas/Archive. en:User:Anwar saadat is the sockmaster. These are his image uploads in en wiki. Once he was banned he opened the User:Haizum account and uploaded his last two uploads in en wiki to commons. He also opened an account in Tamil Wikipedia. He is currently following me around and disrupting my contributions because i filed the SPI report. He is using open proxies to avoid the block and messing up my uploads and articles created by me. --Sodabottle (talk) 15:00, 15 December 2010 (UTC)
Hi, An IP, (whom i suspect is the above sockmaster) is currently vandalising a file i uploaded by removing categories and changing the source link to something else and leaving deceptive edit summaries.--Sodabottle (talk) 07:34, 16 December 2010 (UTC)
In this instance, you'd be best served by putting a notice on the [[Commons:Administrators' noticeboard (as you did) or more ideally the Commons:Administrators' noticeboard/Vandalism boards - they'd be able to act a lot faster than I would be able to. Tabercil (talk) 00:13, 1 January 2011 (UTC)

FYI

Your name has been abused by Sockpuppets of Fark for an upload File:Mason Moore.jpg and maybe others, see the uploads of recent sockpuppets Special:RecentChangesLinked/Category:Sockpuppets_of_Fark. The pattern of edits is uploading unfree files with wrong source claims (e.g. derivaitve of a Commons file while it is not derivative of that file) or stating false author names of other users who also contributed similar (but free) images in the same scope. I write you in case any of such bad uploads in future will hit the attention of someone and will end in an question against you. Another user whos name was abused is Toglenn, but I will not bother him with this wiki internal problems. Example File:Sunny Leone69.jpg, I assume that you also watch his talkpage, so if problems occur you can help maybe. --Martin H. (talk) 17:07, 10 January 2011 (UTC)

Well, I guess I'll take that as flattering, in that I contributed enough that someone's trying to sneak an item in by using my name. Still doesn't mean I don't wanna throttle the dirty rotten copyvio monster. <G> And yes, I do watch Toglenn's page. I've even traded emails with him offwiki so if need be I can chat with him via that channel. Tabercil (talk) 02:35, 11 January 2011 (UTC)

Pirelli_Cal_2010_Backstage_RosieHuntington

What's wrong with the source Flickr account? I checked COM:QFI, and http://www.flickr.com/people/plushev/ isn't on it. The account itself is marked as a professional account, which I thought explained what he was doing backstage at a photo shoot, and the image is large size, and has full camera EXIF data, which isn't usually the case for images just downloaded from somewhere. What makes you think Plushev didn't take the photo? --GRuban (talk) 23:51, 12 January 2011 (UTC)

Ah, sorry. Dug around. You are quite right, Plushev is a professional journalist, but says he got the photos from someone else here http://echo.msk.ru/blog/plushev/636341-echo/ Could you please also delete File:Pirelli Cal 2010 Backstage Eniko Mihalik.jpg and File:Enikő Mihalik.jpg for the same reason? File:SST Dino 01.jpg

Hello Tabercil. Sorry to bother you, but you left the "no permission"-badge on the picture mentioned above. I'm a total newbie in Wikimedia Commons and I didn't know who to ask. The picture was taken by a professional photographer commissioned by Family Trümmel (the girls on the picture are Sandra, Susanne and Tanja Trümmel ... a german band of the late 80's called SST) or their music company. Mr. and Mrs. Trümmel assured me, that they are the rights owners and also send this information via mail to permissions-commons-de@wikimedia.org on 04/07/11. But the permission problem still seems to exist. Did I forgot something? Thanks in advance & best regards, --Doc Strangepork (talk) 17:31, 11 April 2011 (UTC)

There's no problem with the image. It's just that they haven't gotten to the permission statement yet in the OTRS queue. I've pulled the "no permission" tag on the image and replaced it with an OTRS Pending one - once they get to it, they can fix it up then. Tabercil (talk) 22:00, 11 April 2011 (UTC)
Thanks a lot. --Doc Strangepork (talk) 23:22, 11 April 2011 (UTC)

The image was deleted as a probable copyright violation as it could be found elsewhere online, such as here. Indeed, when you compare the image at that site with what you uploaded, there are almost bit for bit identical except for one small difference: the pic at Flixster has a small watermark at the bottom right whereas there is a clear edit made to the same location in yours where presumably that watermark was erased. Copyright violation

you just marked my picture with a copyright violation.. what is the violation? how do i fix this? Whyisyouhollerin (talk) 15:04, 22 April 2011 (UTC)

We need proof that you are indeed the photographer of the picture - easiest thing to do is to follow the instructions here. It'll also be easiest if you were to upload the photo by itself rather than the final CD cover - that way we don't have to contend with issues about whether we need the permission of the graphic artist who designed the cover. Tabercil (talk) 15:13, 22 April 2011 (UTC)

i just uploaded the original picture without the album cover design is this acceptable?Whyisyouhollerin (talk) 15:19, 22 April 2011 (UTC)

You'll still need to follow the instructions on the OTRS webpage I linked to above... but I've tagged the image with OTRS pending so it won't be deleted while the email is being processed. Tabercil (talk) 15:23, 22 April 2011 (UTC)

File:Flickr - nicogenin - 66ème Festival de Venise (Mostra) (92).jpg

Did you type in a flickr review pass for this image file on December 25, 2009 according to the file history? Just asking as I notice the flickr author either hid the image or deleted it today. But you marked it 1 day after upload in December 2009. Maybe something went wrong that you can fix. Regards, --Leoboudv (talk) 09:58, 27 April 2011 (UTC)

Y'know, I can't remember - it's just far enough back. I wish I'd noticed the malformed Flickr review tag on the image page at that time... Tabercil (talk) 12:15, 27 April 2011 (UTC)
  • Pictogram voting comment.svg Comment : The question is Are you Zil? He seems to be some kind of Commons reviewer. Then there is this clear evidence from this Venice festival all taken from the same camera in September 2009 Festival du Cinéma de Venise#page=0 here and all licensed as "cc by sa generic." It seems possible that nicolas genin hid that particular image after he saw it being used on Commons. Secondly, if you are Zil, then you could backdate a flickrpass to your name to December 25 2009 and save everyone from some difficulty. (after all you saw that image 1 day after upload--if it had an uancceptable license, you might have failed it) If not, just say in the image talkpage that you did not flickrpass that image on December 25, 2009...which would mean the uploader typed in a fake flickrpass. Personally, I don't know the Commons uploader that well but I have marked a few images by him and he generally knows the licenses. Well, its your decision. Best regards, --Leoboudv (talk) 20:29, 27 April 2011 (UTC)
Sorry, not Zil. I'm quite sure though the image was on Flickr...
  • OK. From the December reply, I thought you typed in a flickrpass in Zil's name. Apparently he is a reviewer of some kind. But if the image is deleted, then so be it. --Leoboudv (talk) 23:53, 27 April 2011 (UTC)
Well hold on for a bit... I've sent an email to the Flickr account holder hoping to establish that this was indeed one of his photos. Let's see what becomes of that first. Tabercil (talk) 00:12, 28 April 2011 (UTC)
  • OK. Lets see what the flickr owner says then. I saved many images in the past this way...but I'm afraid I'm very busy with my studies to flickrmail people now. Regards from Metro Vancouver --Leoboudv (talk) 02:04, 28 April 2011 (UTC)

You are Zil and here is the evidence

Dear Admin Tabercil,

You are most certainly Zil and you flickrpassed 2 other images from the same flickr account here:

Tabercil is Zil.

The same flickr owner has also hidden/deleted those images now. So can you please just type in a backdated flickrpass for the last photo below to December 25, 2009 and remove the npd tag...as you Typed in a flickr pass for it too. It just didn't show up since there was no closing bracket. I gave you evidence that you passed 2 other images from the same flickr account and that the flickr account owner licenses his photos from his Venice 2009 set as "cc by sa generic." Is that not clear evidence enough. Plus your typed in flickrpass dated to December 25, 2009. If you want, you can cite the evidence I listed above but please save this picture below.

Only you can do that as you marked marked this photo 1 day after upload. Best Regards, --Leoboudv 23:24, 29 April 2011 (UTC)

Ask for removing watermark

Hello Tabercil I have seen that you have removed watermark on my images. So can you continue doing it again for the remaing images. Below is the list of them File:Bella Thorne 2010.jpg File:Mitchel Musso 2010 cropped.jpg File:Tiffany Thornton 2010 (cropped).jpg File:Jason Dolley, Bridgit Mendler and Bradley Steven Perry 2010 (cropped).jpg File:Emma Roberts 2011.jpg File:Miley Cyrus 2011.jpg By the way I want you to explain to User Adrignola why my OTRS images (File:Cole Sprouse 2010.jpg, File:Dylan Sprouse 2010.jpg and File:Dylan Sprouse 2010 2.jpg can't be confirmed although I has sent permission email to OTRS--Hoangquan hientrang 09:56, 30 April 2011 (UTC)

I'll do those additional Music4Mix images when I have a chance. As for the OTRS snafu, I can't answer that as I'm not of the folks who handle the queue. You'd be better off asking one of the folks listed on Category:Commons OTRS volunteers about that. Tabercil 13:14, 30 April 2011 (UTC)

OTRS for images

Clearly I have permission email for all images I have upload like File:Robert Pattinson 2009 Oscars.jpg File:Penélope Cruz 2009.jpg But User Rosenzweig told me that they must be deleted and said this

That may be, but I cannot be sure about it, as anyone can add an OTRS pending tag, even if no OTRS permission was sent at all (yes, it has happened). If a permission was indeed sent, an OTRS person will decide, and any admin looking at the file will ask OTRS before deleting anything. Until then, those are images marked as all rights reserved on Flickr. The tags serve as a reminder to not forget the matter. Regards

Please explain to that user--Hoangquan hientrang (talk) 12:55, 1 May 2011 (UTC)

Rosenzweig is right in that there's no OTRS statement backing the use of the image up. In general, with images from Flickr I prefer to get the account holder to change the license at their end - avoids the hassle that you're encountering now. If you can't get that license change on Flickr, then you need to pass along the statement of consent to OTRS and in this case, you say you haven't yet. And Rosenzweig is right that the tags do need to stay there as reminders that OTRS clearance is still outstanding. Tabercil (talk) 15:26, 1 May 2011 (UTC)

2 flagged items

Hello Tabercil:

You flagged two mug shots I submitted to Wikimedia Commons. I'm new to Commons.

Could you explain how to resolve the issue you noted? Both of the images are publicly available and are free.

Please advise.

Thank you.—Preceding unsigned comment added by Clickrubyshoes (talk • contribs) 13:24, May 23, 2011 (UTC)

The problem with the two files I tagged was that you simply stated that the source for the images were "Hamilton County Jail" - we prefer to have a direct link to the exact page(s) from where the images were taken so we can verify where the material came from and what license it is present under. Tabercil (talk) 17:34, 23 May 2011 (UTC)

Thank you. I just called the Hamilton County Jail to confirm my previous understanding and their proceedure is for the individual requesting the mug shot to call in give the name of the former inmate and they e-mail you the mug-shot. They just don't post them on their website (they said they weren't technically set-up that way because of cost).

I want to follow the rules -- How would I properly cite this?

Thank you for the guidance.—Preceding unsigned comment added by Clickrubyshoes (talk • contribs) 14:15, May 23, 2011 (UTC)

If they have to email the mug shot to you, the best thing for you do then is to follow the instructions here... though you'll probably have to make sure that the mug shot is public domain first as your earlier uploads were deleted by a different admin with this for the rationale: "alleged source doesn't show the image and anyway is a state (not federal) facility and claims "© 2010, Hamilton County, Indiana - all rights reserved" Tabercil (talk) 17:10, 26 May 2011 (UTC)

Hi Tabercil, I'm new to commons. You've flagged the photos that I've just uploaded about June 4. I took these censored photos (captured from my video) in Beijing on June 4, 1989 and it's not published in any media (TV/Newspaper/books/web). What else do you need to confirm my photos are OK? —Preceding unsigned comment added by Reportermanlong (talk • contribs) 11:06, June 5, 2011 (UTC)

If it's your own material, then it's safe to upload... we just need to get verification on that count. I would suggest sending an email to the folks at OTRS (you can find the address here) stating who you are, the circumstances behind the video and giving permission to license the stills under the Creative Commons. User:Sejdikurosaki

Hello Tabercil, I've unblocked User:Sejdikurosaki upon his compromise to not uploading copyvios again. I believe this is not a controversial unblock, so I skipped the pass of consulting with you before, hope you don't mind. Cheers, --- Darwin Ahoy! 13:22, 26 June 2011 (UTC)

That's fine with me... looks like blocking got his attention when all those warnings didn't. Tabercil (talk) 14:32, 26 June 2011 (UTC)
Yes... I'm watching him, in case he does something wrong again, but I believe that he is genuinely interested in cooperate. Thanks, --- Darwin Ahoy! 15:01, 26 June 2011 (UTC)

User:Editor2205

Greetings, back on June 14 you issued a final warning to User:Editor2205 regarding multiple copyvios. While it it put a temporary stop, the problem has started again with at least 3 copyvios in the last week. As the user has never used an edit summary either on Commons or English Wikipedia, or responded to any warnings except to delete them from the user page, I suggest a block may be necessary. Cheers, GcSwRhIc (talk) 15:16, 18 July 2011 (UTC)

I think the user in question is trying to do well, given that at Commons:Deletion requests/File:Jennifer Aniston in 2009.jpg he/she agreed that the image uploaded was a copyvio. I think they just need some more seasoning in terms of being able to judge what are self-made images and what are copyvios. Tabercil (talk) 15:21, 18 July 2011 (UTC)

Mbrosko

Since you're both an admin and familiar with subjects related to porn, could you check on the photo uploaded by Mbrosko (talk · contribs)? Something gives me the feeling that they aren't actually the copyright holder of the image that they've uploaded. Thanks, Dismas (talk) 17:40, 22 July 2011 (UTC)

Yup. Killed. Tabercil (talk) 20:55, 22 July 2011 (UTC)

your assistance please...

Back in February you wrote that the owner of the flickr-id from which Obiwolf images were downloaded wrote to you to request the deletion of those images.

Could you please clarify -- how did they write to you? Do you also have a flickr-id, explicitly tied to your Commons-id? Did they write to you using the WMF software's "email" button? Or do you have your real world email published in the clear somewhere?

It has seemed to me that many of the claims to be the subject of a biographical article, requesting deletion, or claims to be the photographer who initially took an image, and requesting deletion, are spoofs, hoaxes. I suspect that some significant portions of the messages sent to the OTRS team, confirming permission for external images are also spoofs, hoaxes.

Many attempts to delete the Obiwolf images have been initiated since you initiated yours. Most or all of those deletion attempts have an IP address claiming to be the initial flickr uploader, claiming he didn't get the right permissions from his models, so the images should be deleted.

Because we are vulnerable to being spoofed I think all claims that a real world individual is weighing in in our discussion should be confirmed through OTRS. I think any claims not confirmed through a thorough OTRS test should be ignored. I think they should be THOROUGHLY confirmed, because apparently some OTRS team members are clueless about how easy it is to create a webmail ID, and have accepted email from joe.blow@gmail.org, or joe.blow@yahoo.com, as confirmation that they were contacted by the real world Joe Blow.

Although this IP address has had six months to confirm their real world identity through the OTRS team, I don't see any evidence they have tried to do so. I suspect the IP address who keeps claiming to be the flickr uploader is actually a regular Commons contributor, a rogue one, willing to use dirty tricks to win arguments. I plan to initiate a check user request on this IP address.

So, would you please indicate how the flickr person first contacted you?

Thanks! Geo Swan (talk) 14:33, 1 August 2011 (UTC)

I do have a Flickr account (http://www.flickr.com/photos/44775455@N00/), which is used both to hold my own photographs and also as a means to contact others to ask for license changes for Wikipedia. What I did back in February was wrote to the Flickr account of the original uploader asking for clarification. As far as I know you can't forward the internal Flickr mail conversation to another account that's outside of Flickr, but my Flickr account there is set up that it forwards any Flickr mail I receive to one of my personal email accounts as a heads-up. I sent that forwarding message along to OTRS back in February but I don't think I got a reply back with a ticket # at that time... if you drop me an email, I can kick what I can along to you. Tabercil (talk) 14:52, 1 August 2011 (UTC)
Thanks. I sent that email. Cheers! Geo Swan (talk) 15:06, 1 August 2011 (UTC)

You Lost Me picture

Sorry to bother you, I see that you deleted a file I uploaded: File:Christina Aguilera You Lost Me American Idol.jpg. I was just wondering what was wrong with it? It had a Creative Commons license and it was the same that was featured on this picture; File:Christina Aguilera Sanremo.jpg. Thanks in advance :) --Spiceitup08 (talk) 20:00, 11 August 2011 (UTC)

It's not your fault that it got deleted - it's just that the image originally came from the American Idol website at http://www.americanidol.com/photos/season_9/finale/finale_performances/47485/ (photo #33). The person who put it on the Flickr account had no right to use that particular license - it's called Flickrwashing. Tabercil (talk) 22:38, 11 August 2011 (UTC)
Ohhh, thanks for removing it then I guess!! :) --Spiceitup08 (talk) 23:04, 11 August 2011 (UTC)

Hello Tabercil

As you said here, you have 2 images from Getty Images. So how can you get the permission? Could you, please let me know that. Thank you very much. Best regards--Hoangquan hientrang (talk) 12:56, 29 August 2011 (UTC)

I didn't. What happened was the subject of the photos was in communication with Getty and got explicit clearance from them for the pics. What I suspect (but can't prove) is that Chanel bought the images from Getty. Tabercil (talk) 16:36, 29 August 2011 (UTC)

Hello Tabercil, Can Upload the following images that have been deleted. D23, D23, Can I do that ? Thanks Tabercil. --MyCanon (talk) 22:53, 29 August 2011 (UTC)

Neither of those two image can be uploaded. The Flickr account doesn't have the rights to make that license change, and I've advised them to roll it back. Tabercil (talk) 23:17, 29 August 2011 (UTC)

OK, But delete the photos again Such a picture and other Robert Downey, Jr. 2011.jpg. --MyCanon (talk) 23:30, 29 August 2011 (UTC)

Wow -- that's bizarre timing that I would have uploaded it 40 minutes before you. I do a search almost everyday on Flickr for Toronto images, so it came up in my search. How funny. When there are duplicates, I always delete the one that came second (which in 98% of the cases is the one I just uploaded). I'm sorry I did not know the circumstances here, otherwise I would have switched my usual practice. I'll add a notation to the image. --Skeezix1000 (talk) 23:19, 29 August 2011 (UTC)

File:Taylor Momsen - Warped Tour Kickoff.jpg

Hi. I am wondering if you can help me with a permissions issue. I notice that you uploaded the above file from Flikr. An image I have loaded from the same source at File:JasonBonham2010b.jpg has had a question raised over its permission status, essentially that the licence is valid, but the account is chickswithguns, while the photographer is Karen Curley (in this case with both on a copyright watermark). My question is, when you downloaded this file did you obtain any further clarification over permission? Failing that it would really help if you had any insight into relevant permissions or status of cwg images on Flickr. You may not be able to help, but I thought it was probably worth a shot. Thanks.--Sabrebd (talk) 16:17, 5 October 2011 (UTC)

Image check please

Could you check this image? It's the user's only upload and their contributions on En have only been to one article. They insist that they own the rights to the image and I can't find it on Tineye. I'm guessing that the editor is some how affiliated with the subject, Katie Kox. Thanks, Dismas (talk) 22:02, 16 March 2012 (UTC)

It is suspicious, especially given what the EXIF data looks like compared to a proper image and the fact that the uploader had an earlier image of Katie deleted. He associated an email address with the account - I'll kick 'em a line to see if I can get any additional info from them that way. Tabercil (talk) 23:11, 16 March 2012 (UTC)

You need to set an account on TUSC, but I would instead suggest you use this upload bot instead as it only asks for your Commons user name. Tabercil (talk) 22:26, 29 June 2012 (UTC)

UserAlf54354353 Hello Tabercil I have registered there but still can not upload gives me error you give me your user write it then allows me to upload a photo of flickr and gives me this is what gives me The image on Flickr is not licensed under a sufficiently free license—Preceding unsigned comment added by Alf54354353 (talk • contribs) 18:52, June 29, 2012‎ (UTC)

That means the license on the image is not one that is suitable for Commons. It has to say one of the following: "Attribution, Share Alike", "Attribution" or "Share Alike". Any other license won't work. Tabercil (talk) 02:13, 30 June 2012 (UTC)

  • Looks like it - I can find it here where it says "Autor: Text und Fotos: Markus Wallmeier". File:Daniela Bobadilla.jpg

Hi Tabercil, the EXIF data for this image expressedly request the credit/by-line "© Richard Sandoval". I therefore wonder whether the offfering Flickr user really has the rights over this image. Could you please contact the Flickr user and ask him about that. --Túrelio (talk) 20:14, 10 September 2012 (UTC)

Hmm... it looks like all the images present on the Hispanic Lifestyle account on Flickr have that copyright satetment, not just the celebrity ones. For instance, if you check this image of a penguin at a zoo, you'll see the same copyright statement on it. Additionally, from what random checking I did, all the images present have the same Olympus E-510 camera model used on it. I'll check just to be certain. Tabercil (talk) 20:22, 10 September 2012 (UTC)
Nevertheless, as for CC-BY-licensed image the credit content is legally binding for any use, it might still make sense to ask the alleged licensor to what credit exactly he/they agreed with the actual photographer. --Túrelio (talk) 20:25, 10 September 2012 (UTC)
I went to reply to the Flickr email that gave the consent and saw the full entirety of the original message:
Yes, you have permission.
Richard Sandoval
If you want I can forward the echo of that Flick email to OTRS. In the interim, since the photographer is the account user case closed IMO. Tabercil (talk) 20:28, 10 September 2012 (UTC)
If you have uploaded or seen more uploads from that Flickr account, it might indeed make sense (and save from further inquiries) to forward it to OTRS and ask them to issue a ticket which records the identity of "Richard Sandoval" and the Flickr account. Thanks. --Túrelio (talk) 21:11, 10 September 2012 (UTC)
I've uploaded about a half-dozen images so far and I'll certainly be going back and trying for more in a day or two. He's got a nice selection of shots of celebs, including some of them at the ALMA awards with the actual award in hand (e.g., this one of Jessica Alba) which I think would be just lovely for Wikipedia to use. I just first want to get a sense of what there is & prioritze... but I'll take your suggestion and kick that email along to OTRS. Tabercil (talk) 22:20, 10 September 2012 (UTC)

File:It's Alright.jpg album cover

The owner of the company, Willie Buck/William Crawford has already had a member of his staff issue the picture to commons OTRS for approval with a shareAlike 3.0 license. The email was sent 2 days ago from my understanding. Also, under the same notion, Delmark Record has done the same for the album covers File:DE805.jpg and File:DE825.jpg. These files were uploaded as File:The Life I Love.jpg and File: Cell Phone Man.jpg accordingly. If you could vet this for me and remove the block on the files I would greatly appreciate it. I am waiting for Blues R Us Productions to send their release. They are on tour in Argentina at the moment but I am confident they will be more than willing to release the cover as well. —Preceding unsigned comment added by Monorail11261 (talk • contribs) 02:08, October 3, 2012‎ (UTC)

Ah, there was nothing present on the image page which indicated that an OTRS submission had been made. We get a lot of people trying to add CD covers to Commons so they pretty much get cleaned out on sight. I'll undelete the image and tag it as OTRS pending - that should keep it around long enough for the permission to get sorted out. Tabercil (talk) 04:15, 4 October 2012 (UTC)

Thank you for vetting the file It's Alright.jpg for me. I also had the same problem with the files Willie Buck and Dave Meyers (aka chi-od25.jpg). The copyright holder has sent in a request through OTRS and the file has yet to be restored. The other chi-od24.jpg has been verified yet the latter did not get restored. If you could, please look into this for me. I greatly appreciate it.Monorail11261 (talk) 07:05, 15 October 2012 (UTC)

Hey Tabercil! I've uploaded a PETA ad image but I'm not sure if I've done it correctly. Will you please have a look at it. http://commons.wikimedia.org/wiki/File:Imran_Khan_PETA.jpg —Preceding unsigned comment added by GleekVampire (talk • contribs) 23:20, April 10, 2013‎ (UTC)

Well I can see one immediate issue with the upload - it's not truly Public Domain. If you check the copyright policy on the PETA India website, you'll see that it says
PETA encourages visitors to its websites to spread the animal rights message by copying and downloading website content for personal, non-commercial use. f you wish to use any materials found on PETA's websites (text, videos, photographs, etc.) for any other purpose, you must submit this form and obtain express written consent before using the materials.
You'll need to contact PETA and get that consent, then you can re-upload the image. Tabercil (talk) 21:34, 12 April 2013 (UTC)

Hello, You nominated for deletion my upload File:Hello Venus on Sep 28, 2013.jpg, but I found the CC-BY icon at the bottom of posted article(저작자표시 YES 상업적이용 YES 컨텐츠변경 YES). Can you reconsider this deletion? If you don't understand korean language, you can ask help user:hym411. --Puramyun31 (talk) 05:31, 20 December 2013 (UTC)

저작자표시 means Attributions, 상업적 이용 means Commercial use, and 컨텐츠변경 means Derivate works. So, that license seems to be CC-BY. --레비Revi 07:36, 20 December 2013 (UTC)
