Bonjour @Yann: Ok, pas de problème. C'est juste que j'avais vu des admins qui reprévenaient les personnes quand ils supprimaient un fichier copyvio, du coup ça faisait un peu des messages en double. Et je pensais que c'était une pratique courante et que donc ça serait un peu superflu de laisser un message. Mais pas de soucis, je le ferai quand même maintenant. Bonjour @SophieDelDegan: (je crois que vous parlez français ? =))
Vous avez pris l'image à partir d'un site internet. Cependant, ce site (et tout son contenu) est protégé par le droit d'auteur (c'est marqué tout en bas : « © 2016 Bell Média - Tous droits réservés »). Commons et Wikipédia ne peuvent héberger que des fichiers sous licence libre. Or, rien n'indique que cette photo a été publiée sous licence libre par son photographe (il n'y a rien de précisé concernant sa licence).
Cela pose un problème légal, car tout ce qui est publié sur Wikipédia se retrouve automatiquement placé sous licence libre, ce qui veut dire que tout le monde pourrait réutiliser, modifier voire utiliser dans un but commercial cette photo sans demander l'autorisation de son photographe. Cela ne pose pas de problème si ce dernier a donné explicitement son autorisation en plaçant sa photo sous licence libre. Mais ici, cela n'a pas l'air d'être le cas, rien n'est marqué.
Il faut donc soit contacter le photographe (ou l'ayant-droit) et lui demander s'il accepte de placer sa photo sous licence libre (et il faudra alors qu'il envoie un courriel d'autorisation, voir pour cela cette page Aide:Republication/Courriel Image), soit trouver une photo vraiment libre de droit, soit malheureusement s'abstenir.

P.S : Vous avez aussi mis que l'auteur de la photo était Karl Hardy, mais il me semble qu'il n'est que l'auteur de l'article, pas le photographe.

@SophieDelDegan: Non, désolé, les photos publiées sur Instagram sont malheureusement elles aussi protégées par le droit d'auteur (même sur un compte public). Il faut vraiment que la licence soit explicitement mentionnée comme étant libre par le photographe. Si rien n'est précisé, la photo est considérée comme étant automatiquement protégée par le droit d'auteur.
Sur la page suivante, vous avez un tableau à droite résumant le nom des licences acceptés ici et leurs pictogrammes (utilisés sur certains sites comme Flickr) : Commons:Flickr files. Il s'agit principalement des licences appelées CC-BY et CC-BY-SA, ainsi que les photos mises dans le domaine public.
Sinon, si vous réussissez à contacter le photographe d'une photo qui vous intéresse, vous pouvez aussi lui demander d'envoyer un courriel d'autorisation à Wikipédia (voir le lien que j'ai donné dans mon précédent message).
Je sais que c'est très contraignant et frustrant, c'est pour ça qu'il y a beaucoup d'articles sans illustration. Mais c'est la seule façon pour Wikipédia de respecter la loi tout en étant libre (= son contenu pouvant être réutilisé par tout le monde). Hi @Mont Viso: it is still written in the exif (the infos at the bottom of the page) : "Copyright by Hukseflux Thermal Sensors". I don't know if those are the remaining infos of the former picture. permission & deletion

Hi, thank you for your messages. Christian Lu sent a first permission concerning the first 9 pictures to COM:OTRS a few days ago, and Arthur Crbz has validated them. Afterwards, Christian Lu sent a second permission for all remaining pictures. However, the authorized pictures have been deleted from the main page https://zh.wikipedia.org/wiki/%E9%99%86%E6%B0%B8%E5%AE%89. Could you please restore them ? Many thanks for your help. @HSUN: Hi. When this file is restored, just go to the Chinese page, click on the "history" button (I believe it is "查看历史" in chinese) and click on "撤销" ("undo") on my very last edit. It is when I had removed this file from the page, since it wasn't yet visible. By undoing my last edit, you'll restore the file on the page (but wait until it is restored on Commons as well, otherwise you will just see a red link). For the 3 pictures which were deleted, yes, the photographer should send a new email, because there must have been a problem with the validity of the authorization sent before ("No permission since 12 June 2017" says the deletion comment). Photo - Violation de droits d'auteur

Bonjour, Nous avons téléchargé une photo de la Paris Healthcare Week 2017 (photo Paris Healthcare Week 2017.png) pour l'utiliser sur notre page Wikipedia (en construction). Cette photo a été supprimée pour violation de droits d'auteurs, car elle a été retrouvée sur un site web qui n'était pas le nôtre. Effectivement, elle a déjà été utilisée, mais cette photo est bien la nôtre. Comment peut-on faire pour utiliser cette photo dans la page Wikipedia ? Hi, could you help me with something? I tried to upload an album cover art image and I thought I entered all the required info for wiki to justify the use but when it uploaded all the information was in the description and none of it went to the 'Author', 'Date' etc sections like I thought it would and I don't know what to do to fix it. I don't want a strike for doing something wrong and I've been at my wits end trying to figure out how to properly upload an image and get all the details right only for this to happen. I'm really sorry, I can't delete it for you. Only an administrator of the English Wikipedia can do that, which I am not (also I'm not very active on this part of Wikipedia). It is really close to the real cover though, I wonder if it can't be considered as a "derivative work". Also, I wonder what's the point of creating a fake book cover then? We can't use it on articles, what if the author / publisher notices it? They may ask for us to remove the fake cover, since we're pretending it's the real one (is it legal?). It doesn't seem like a good idea to me, book covers aren't usually free, but creating a fake book cover doesn't seem like a viable alternative. --Titlutin (talk) 18:53, 21 February 2019 (UTC)[reply]

Hi would like to use a photo in a documetary for broadcast TV, however I am confused by the terms.

We can credit you at the end of the programme however I do not understand providing a link to the license? As it's end credits for TV show it cannot be a link. Can anyone explain?

Hi. If you're talking about the pics of Bernard Arnault similar to this one, File:Bernard Arnault (2) - 2017 (cropped).jpg, you shouldn't credit me, because I am not the author. I uploaded them from Flickr. The name of the author is written in the file's description under the pic, it's Jérémy Barande.

Photos of Kamanda Sywor Kamanda

The images where you added the template:No permission since have been provided by fr:User:Christiane.melancon with the authorisation of Kamanda Sywor Kamanda himself. If I remember correctly what happened in 2006, Kamanda and Christiane.melancon wrote en:Kama Sywor Kamanda and fr:Kama Sywor Kamanda and provided a bunch of photos of Kamanda. I moved those images from the English and the French Wikipedia, so yes obviously I’m not the author. But the author put them on Wikipedia in the first place. I don’t care enough to follow through with this. I’ve mostly clearly indicated who the author or where those pictures came from but users adding metadata didn’t seem to notice. I don’t have time to clean this up. Y avait-il eu une autorisation OTRS d'envoyée ? Car je n'ai rien vu de tel sur les fichiers. Or, dire « J'ai l'autorisation de l'auteur », comme ce que cette contributrice a écrit sur certains fichiers, ne suffit pas (car comme vous le savez, n'importe qui peut se cacher derrière un pseudo), il faut le prouver en envoyant une autorisation (fr:Aide:Republication/Image).
En outre, plusieurs photos ne donnent pas le nom du photographe, et il y a juste écrit « Picture provided by Mr. Kamanda himself ». Cela est problématique, car ce n'est pas l'autorisation du sujet de la photo qui importe (en tout cas, pas seulement), mais aussi celle du photographe pour des questions de droit d'auteur.
Désolé pour les messages, ils s'envoient automatiquement à la personne ayant téléversé le fichier quand on dépose le modèle. Christiane.melancon~commonswiki en a reçu quelques-uns également, elle devrait être au courant, mais je vais aller la prévenir sur son compte fr:WP. Concernant le délai d'une semaine, ce n'est pas moi qui l'ai décidé, mais c'est le délai standard de cette procédure. De toute façon, même si les fichiers sont supprimés, ils pourront être restaurés quand le/les photographe(s) auront envoyé les autorisations nécessaires. Merci pour l'info sur OTRS. Elle ne précise malheureusement pas si elle a envoyé l'autorisation uniquement pour File:Kamanda wiki.png ou pour toute les autres photos. J'ai remarqué que de nombreuses photos du photographe Globetrotteur17 présentes sur flickr sont téléchargées dans wiki. J'aimerais connaitre la procédure que vous avez utilisée car sur flickr il est indiqué que la photo de William Lebghil est Tous droits réservés. Bonjour Isacre !
Le fichier original n'a pas été importé par moi, j'ai juste fait un recadrage. L'orignal est File:William Lebghil 2016.jpg, il a été importé par l'utilisateur Judor92.
Cependant, je vois en effet que l'image est désormais protégée sur Flickr. Mais sur Commons, un relecteur avait confirmé en 2016 que la photo était bien sous licence libre en apposant le modèle {{Flickrreview}}. Globetrotteur17 a donc dû changer la licence de ses photos depuis. Ce qui fait que les anciennes importées alors qu'elles étaient libres peuvent rester sur Commons, mais importer de nouvelles photos désormais protégées n'est en revanche plus possible, elles seraient rapidement supprimées. Vous vous adressez à la mauvaise personne : je n'ai pas supprimé ce fichier (et je n'aurais pas pu le faire de toute façon, car que je ne suis pas administrateur). Comme précisé dans ses informations de suppression, ce fichier a été supprimé par l'administrateur JuTa, avec comme raison « No OTRS permission since 13 April 2021 ». Je vous conseille de le contacter directement sur sa page.

Bonjour Titlutin, je vous contacte car je crois que vous faites erreur en désignant cette photo pour une suppression. Il me semble assez évident que c'est son auteur lui-même qu'il l'a téléversée sur Wikimédia, et ce, pour plusieurs raisons : les données EXIF sont présentes, la photo est de bonne qualité, sa taille n'est pas suspecte et le nom de l'utilisateur l'ayant publiée est Oussbiad, ce qui correspond clairement à Oussama Biad, le nom du photographe indiqué dans l'EXIF. De plus, la photo ne contient aucun filigrane alors que, d'habitude, ce photographe tague toutes les photos qu'il publie sur Facebook avec son logo ou simplement son nom. Par ailleurs, et sans me faire l'avocat d'Oussama Biad, je constate que même lorsque ce dernier téléverse une photo qui n'est pas la sienne, il l'indique explicitement dans la description sans se rendre compte qu'il commet une faute, ce qui trahit une certaine méconnaissance du fonctionnement de Wikimédia mais témoigne également de la bonne foi de ce contributeur. Je parle en l'occurrence de cette photo, qui mériterait pour le coup d'être supprimée tant elle coche toutes les cases : pas d'EXIF, qualité basse, taille très petite, format PNG donc probable capture d'écran et, surtout, aucune autorisation alors qu'elle est tirée de la page Facebook d'un club de football. Voilà, j'espère vous avoir convaincu car je trouve qu'il serait vraiment dommage, étant donné la rareté des photos sur le football algérien, d'en supprimer une tout à fait valable. Bonjour Aziouez et merci pour votre message. Je vous accorde que plusieurs indices font penser que l'utilisateur ayant importé cette photo est bien le photographe. Si vous souhaitez retirer la demande d'autorisation vous-même, je ne m'y opposerai pas. Je trouve qu'il aurait quand même été préférable que User:Oussbiad envoie une autorisation en bonne et due forme, car en soit, rien ne nous prouve que derrière le pseudo Oussbiad, il y a "Oussama Biad Photography" qui détient les droits sur cette photo (une usurpation d'identité est toujours possible).
Par contre, je vais proposer à la suppression File:Houssem Mrizegue.png, qui en effet n'entre pas dans les clous.

Bonjour Titlutin, You nominated a number of pictures that I uploaded today. Some indeed had some erratic licencing data, and I have attempted to correct these. But the nomination of the last two pictures, Statue Thomas Sankara 2019.jpg and Statue Thomas Sankara 2019(cropped).jpg, I don't understand, as I am the photographer and I think to have followed the standard procedure of the Uploadwizzard. Hello Chescargot! Yes of course I can explain (and sorry for all the messages that added automatically on your talk page).
The photos are indeed placed under a free licence (by you, the photographer), but when taking a picture of an artwork, you have to take into consideration the artwork's own copyright.
This statue of Thomas Sankara was inaugurated in 2019 (as part of the Mémorial Thomas Sankara). It is therefore still protected by copyright according to Burkina Faso's copyright laws. The statue will become public domain 70 years after the artist's death or 70 years after it's creation in the case of an anonymous work (Commons:Copyright rules by territory/Burkina Faso). So unfortunately, it is still protected for now and pictures of this statue cannot be used on Commons.
Now, some countries authorized pictures of artwork situated permanently in public places, which is called Freedom of panorama. However, Burkina Faso's freedom of panorama is limited only to noncommercial purposes, which is incompatible with Commons:Licensing. See COM:FOP Burkina Faso.

Thanks for clarifying! Learning now about that Freedom of panorama, the restrictions and freedoms of which apparently change from one country to another. However, in COM:FOP Burkina Faso, I read the exception "... a photo that only incidentally includes architecture or sculpture should be fine". Thus, particularly the picture Statue Thomas Sankara 2019 (3).jpg I took seems to meet that requirement as it is shown in context, thus making the object rather 'incidental'. @Chescargot: Yes, I saw this exception. But the examples shown in Commons:De minimis#Guidelines seem quite different to me. Also, Commons:De minimis works if the artwork isn't the main subject and only appear incidentally, but in the picture you took, the memorial (statue included) seem to be the main point of your photo, and not an incidental aspect of you trying to take a picture of something else. Without mentioning the graffiti / mural we see on the side (next to Héros de la nation). There are 2 copyrights to consider here: the copyright of the original photo on which the art was based + the copyright of the artist who did the artwork.
We can transform this « speedy deletion » demand into a regular « Deletion requests » so we can discuss it more further and other users can give their opinion if they wish. What do you think? --Titlutin (talk) 16:40, 26 November 2023 (UTC)[reply]
