How is that possible? I was in contact with the author and he said that he not agreed to commercial reuse but only allowed reuse in wikipedia for non-commercial purposes. And that he will never agree to commercial reuse beause he cant allow this for contract reasons. --Martin H. (talk) 18:57, 2 January 2012 (UTC)[reply]

Hi Martin H. I noticed a ticket in OTRS (#2011121010015501) and I read that the uploader of Flickr gave permission to use it. He only asked for a link to his Flickr page. Of course this isn't sufficient and I wanted to send an email asking permission for a more specific license (by mistake I added the "PermissionOTRS" template instead of "OTRS received"). Did you email with the uploader himself or the one who uploaded it on Commons? I'll await your response before I reply on the uploader. The uploader first uploaded some files from http://www.moolf.com/animals/black-mamba-snake.html with own work claims (deleted) - reuploaded with the claim that some Peter Hutch is the author (File:Zoo-black-mamba.jpg) AND that this Peter Hutch gave permission - deleted with evidence that Hutch isnt the author as claimed - again reuploaded now with true author (File:D.polylepis wide.jpg). Given that the uploader first claimed that a non-author and non-copyright holder gave permission I found it unlikely that so quickly the true copyright holder agreed to free reuse of all(!) files from his flickr.
I conacted the author/copyright holder via flickr and he confirmed me that he gave permission to reuse the specific pictures (not all as claimed by the uploader) for non-commercial purposes in Wikipedia and that he is not okay with his work beeing reused under free content conditions including commercial reuse because for various legal reasons he cant grant commercial reuse under a free license. So indeed the uploader asked the copyright holder - given File:Zoo-black-mamba.jpg I had doubt if he truly asked him - but he not got and never will get a free license. And most likely he not correctly asked for a free licensing but only for reuse in Wikipedia. --Martin H. (talk) 19:18, 2 January 2012 (UTC)[reply]
I just came by this single ticket. I searched in the archive and now I see 11 tickets of the uploader (User:Sebastian80). I'll delete the pictures I restored and some more he uploaded and I'll specifically request permission of the uploaders themselves (some email addresses are given) before I provide onwiki permission. Update: I answered all emails he send to the queue permissions-commons. Initially I added "PermissionOTRS" for File:D-polylepis-in-defense.jpg as the permission of the original uploader (Bill Love) was given under the appropriate license, though I didn't trust the timestamps, see #2011121010011907 and #2011121010012817. I deleted all other files for which the uploader didn't give permission under the correct license. The uploader uploaded more images and now three images of snakes are left (File:Copperhead snake.jpg, File:Crotalus viridis 02.jpg and File:Dendroaspis viridis 001.jpg). For all three I couldn't find the corresponding OTRS tickets in the system, so I presume those will be deleted too in the near future. Thanks for giving some background. Dear Americophile. Imo this image should've never been renamed (could be a request of the uploader, but that wasn't a valid reason to rename in this case). Plus I still don't like to see renames of pages of cities in Iran to their Persian names. That's something which should've been discussed first before you renamed them. You pointed to Commons:Gallery#Naming conventions, but there are not many Persian galleries on Commons and imo a request for permission would've been better than just rename them. Especially because all articles already existed for years. I started a thread about it on Commons:Administrators' noticeboard‎ to ask for the opinion of other administrators. Black mamba photo

I deleted File:D-polylepis-in-defense.jpg, because I didn't trust the timestamps in the emails. You said he uploaded it himself; I found the file: File:Dendroaspis polylepis by Bill Love.jpg. In that case I think the permission was indeed arranged. I'll add the OTRS ticket numbers (#2011121010011907 and #2011121010012817) to it. Okay, I have been getting quite a few permissions to use snake photos from Flickr users, problem is I don't know how they should send a letter of granting me permission. Is there a format of some kind? I keep telling them to just make a username and upload it themselves, which they have been doing for the most part and I have been most humbly appreciative. Some have even asked me do to it on their behalf (make a username with their name and credit the photo to them). You got to help me out here, what kind of letter is required? What if they allow me to use any picture I want from their image sets? What then? I have had at least 2 make accounts and upload pictures which I asked for. First, this one File:Naja_nigricollis_Sunset_09_Warren_Klein.jpg, then two Chinese cobra pictures File:Cobra with tongue from rob ferguson Naja atra (Chinese cobra).jpg & File:Cobra from rob ferguson Naja atra (Chinese cobra).jpg. BTW, can I re-upload the black mamba pic that Bill Love uploaded, only rotated to the other side. Like the first one with the mamba facing the left side. It looks much better on the article? Hi Bastian. A lot of questions. I'll try to reply on each one of them (My apologies for the late reply btw; I was busy):
1) Yes, there is a standard letter. See Commons:OTRS for an explanation and an example of a letter to give permission.
2) I would recommend you to still request permission from the people who uploaded a picture for you (send it to OTRS by using the example letter and give a link to the file).
3) I also recommend you to request permission for each file you would like to upload. That's easier for both you, the person who has the image and us (the OTRS volunteers). They can't just say that you can use every image they have on their website. And again, please use the letter on Commons:OTRS.
4) Yes, you can reupload a file. Please use this form.

Request for one more otrs validation?

Hi Trijnstel, thank you so much for the extremely quick OTRS response on the Kate Upton photo I uploaded earlier today. I understand there may be a backlog at OTRS, but I was wondering if I could request verification for File:Sara Paxton at Mother Goose Parade, 2007.jpg, which has not been identified by the OTRS team for a while now. Op de Engelstalige wikipedia: Blommaert Philip AMVC 070506.gif en hier: Blommaert.jpg. Wanneer ik Blommaert.jpg wil moven naar Philip Blommaert of een andere naam, krijg ik dit. Anderzijds begrijp ik niet waarom de afbeelding Blommaert Philip AMVC 070506.gif dan weer niet in publiek domein is. Ik zou die file dus op Commons zetten met een betere beschrijving: "Philip Blommaert by Charles Baugniet.jpg". Op de afbeelding zie ik AMVC Letterkunde. Hoe gaat zoiets in zijn werk? Hoi Lotje! Welke foutmelding je exact hebt gekregen, kan ik niet zien. De link werkt niet bij mij (logisch, want dit soort wijzigingen zijn altijd tijdelijk). In principe zou je de afbeelding gewoon moeten kunnen verplaatsen. Waarom dat niet lukt, weet ik zo een, twee, drie ook niet. Zou je anders misschien de foutmelding door kunnen geven aan mij? en:File:Blommaert Philip AMVC 070506.gif is destijds (2007) gewoon lokaal geüpload op de Engelstalige Wikipedia. Toen was het nog niet zo normaal dat de afbeeldingen op Commons terechtkwamen. Ik zou met behulp van CommonsHelper de afbeelding kunnen overzetten naar Commons. Picture Permission

Hello there! I noticed that you answered my topic regarding the permission for file : CherishBlondAmbition telling me the permission couldn't be verified yet?? Dear VernitaG. Since the image was posted on the fan site Madonnaunderground.nl, I'd like to see a confirmation mail of the owner of that site (see here for his email address). I'm not sure who send the image now, but I can't confirm it's of the owner. It could be of the photographer himself (which is good), but the owner should confirm it. Sorry, but because of privacy I can't give you the email address of the person who send the email. Though I'd prefer an email of both the photographer and the owner of the website. verwijderde foto van Qadria Yazdanparast

Dag Trijnstel,

ik zie dat je naast de NL wikipedia ook OTRS-dingen doet op Commons. Ik wil je graag het volgende voorleggen: Begin dit jaar heb ik het artikel nl:Qadria Yazdanparast opgeknapt dat door een debutant was aangemaakt en op de verwijderlijst was terechtgekomen. Deze politica en vrouwenrechtenvoorvechtster heeft een tijd als asielzoeker in Nederland gewoond (maar kon weer terug naar Afghanistan toen het Talibanbewind was afgezet) en spreekt daardoor Nederlands. Ik wilde het artikel wat mooier maken door er een paar foto's van haar op te zetten. Ik heb haar per email benaderd en heb haar gevraagd om zelf een paar foto's te uploaden, omdat het bewerkelijk is qua rechten als ik het namens haar zou moeten doen. Ik heb haar precies uitgelegd hoe ze het moest doen en kreeg prompt een mail dat ze drie foto's had geplaatst. Twee ervan heb ik op haar Wikipediapagina gebruikt. Op haar verzoek heb ik vervolgens ook het artikel in het Engels vertaald (en:Qadria Yazdanparast)

Tot mijn verbazing zie ik nu dat de foto's die mevrouw Yazdanparast geupload heeft, verwijderd zijn door Morning Sunshine: 'No permission'. Ik heb die Morning Sunshine benaderd op zijn/haar OP maar krijg geen duidelijkheid wat er nou in zijn ogen mis gegaan is met de permission. Omdat communiceren in NL mij makkelijker af gaat, is mijn verzoek om voor me na te gaan wat mevrouw Yazdanparast verkeerd zou kunnen hebben gedaan, en uiteraard wat we moeten doen om de foto's terug te krijgen. Ik heb niet zo'n zin om deze drukke politica en hoogleraar, van wie ik al heel blij ben dat ze mijn mails zo welwillend heeft beantwoord, lastig te gaan vallen met een ingewikkeld OTRS-verhaal.

Dag Erik! De combinatie van Commons en OTRS kan inderdaad vrij ingewikkeld zijn. Ik zal je helpen. De toestemming die mevrouw Yazdanparast geeft is goed, maar helaas niet volledig. Ze zal de volgende verklaring in moeten vullen voor alledrie de afbeeldingen (bij 'afbeelding' kan ze ook meerdere afbeeldingen invullen uiteraard): nl:Wikipedia:OTRS/Mijn eigen afbeelding. Voor de originele Engelse verklaring verwijs ik je naar Commons:Email templates. Het mailtje moet verstuurd worden naar permissions-commons@wikimedia.org. Als je weet dat ze het heeft gemaild, dan is het handig om mij even te informeren aangezien we een gigantische achterstand hebben. Dan zoek ik het mailtje op, plaats ik de afbeeldingen terug en kun jij ze weer in het artikel plaatsen. Hopelijk weet je zo voldoende. Mocht je alsnog vragen hebben, dan hoor ik het graag. Dus als ik het goed begrijp heb ik puur geluk gehad dat de meer dan 100 foto's die ik heb gemaakt en die ik op Commons heb gezet, nooit verwijderd zijn door iemand die twijfelde of ik ze wel zelf gemaakt heb. Want ik heb ze altijd gewoon geplaatst op deze pagina zonder daar achterheen een mail te sturen aan bovengenoemd mailadres. Op die pagina staat dat dat alleen zou moeten als het geen eigen werk is. Maar de foto's die mevrouw Yazdanparast heeft ge-upload zijn gewoon haar eigen foto's waarover ze dus zelf de rechten heeft.
Of is het misschien zo dat foto's waarop iemand zelf staat, per definitie verdacht zijn omdat er dan een ander is geweest die op het knopje van de camera heeft gedrukt? Ik vermoed dat het dat is.

Dag Erik. Nou ja, het gaat er meer om of het wel of niet overduidelijk jouw eigengemaakte foto's zijn. En niet dat de door jouw geüploade foto's slecht zijn, integendeel, maar je kunt zien dat ze door een particulier gemaakt zijn. Dat is bij de foto's van haar niet het geval. Dankjewel voor de medewerking. Ik heb K3A een mail gestuurd en wacht op antwoord. In commons how many no . of contributions required for requesting file mover rights?, my request denied because of Not enough experience (i don't understand which one is not enough (edits, file uploads, or renaming requests )). Abuse Filter #69

Dear Trijnstel. I getting to you because you have last modified Special:AbuseFilter/69 which is tagging edits for "OTRS permission by non-OTRS member". The filter obviuosly is only applied to edits, but does not catch uploads that are done by a non-OTRS member directly with (invalid) OTRS tag included. Could you please modify the filter that it matches at action=upload, too? (As there is no old_wikitext in this case, there possibly has to be a major modification.) No special advise. I only have some overall doubts: if you take the above linked image, 1) it carries a watermark "(C) CloudMade ..." (is that somebody or did they want to say cloud-made? I doubt that such "clouds" can own copyright.), 2) uploader Parimucha says "own work" (= "I am the author"), 3) the author entry say "Tripomatic.com", 4) it is self-licensed (i.e., by the uploader). Question about CommonsDelinker

Thanks for granting me file mover rights, I have one question though. I have requested moves of over 40 files and they all have been moved except that the file name was not changed on the English Wikipedia. Is that because the person that moved the file didn't change it? I'm not sure what you have to do to replace the file name on other Wikipedias. Hi Astros4477. If you click on the green "rename and replace" button (I thought that's what it says), then the file will be renamed and a rename request will be placed on User talk:CommonsDelinker/commands‎. (Unless you're an admin, then it will be added to User:CommonsDelinker/commands‎.) Once someone picks those requests up and adds them to the 'main' page, nothing will happen. Then CommonsDelinker will process them and perform them. Usually within an hour IIRC. See CAT:RENAME for more information. Hope this helps. If not, feel free to ask any of your questions. Good luck! Hello again, I've grown more comfortable with moving files but File:Cedar Fair Fast Lane availibility icon.svg was renamed to File:Cedar Fair Fast Lane availability icon.svg and CommonsDelinker renamed some of the files on Wikipedia but it didn't rename all of them. Daarom zie je op de pagina op de Engelstalige Wikipedia (en:Natanz) geen afbeelding maar een rode link naar Wikimedia Commons. Ik stel inderdaad voor dat je die link daar weghaalt, aangezien de afbeelding ofwel auteursrechtenschending ofwel fair use is en beiden op Wikimedia Commons niet toegestaan is.   • Oh, nee hoor, dat zeker niet. Fair use is namelijk wel toegestaan op andere projecten, zoals de Engelstalige Wikipedia. Maar op de Nederlandstalige Wikipedia is dat bijvoorbeeld weer niet toegestaan. Alleen wanneer afbeeldingen lokaal geupload zijn, kun je ze niet gebruiken op andere projecten. Je zou ze kunnen overzetten met behulp van CommonsHelper, maar dat mag dus niet altijd (copyvio moet eigenlijk altijd verwijderd worden en fair use is hier niet toegestaan).
Nou ja, overal dezelfde regelgeving zou het natuurlijk een stuk makkelijker maken. Wanneer ik hieromtrent met een vraag zit kan ik bij jouw terecht (hoop ik) ?

copyright vio regarding pictures

I noticed User:11JORN uploaded these pictures and I also noticed that the OTRS permission indicates there isn't enough evidence. This is correct as I emailed Hans Schaft the owner of the website those pix are from and he confirmed he didn't sent the permission for those, files. The user who uploaded those pictures committed a violation. he either send those permission emails himself or from another email address. The webmaster of MadonnaUnderground Didn't send those emails.

Renaming

Hi Trijnstel, I have a doubt in renaming. As you know i am involved in TWMC cleanup, there are many files which has transliterated Tamil names. For example Tamil meaning of grains is தானியங்கள் (which is transliterated as dhaniyankal in englishFile:Dhaniyangal.jpg). Now the problem is, In what lang. the renaming should be done? Hi Shanmugamp7. COM:RENAME states "Remember, Commons is a multilingual project, so there's no reason to favor English over other languages". This means you may of course use the original Tamil name. See Jesus, the page name is not in English! But, there are at least 15 widely spoken languages in India, and not everyone will not be able to read the file name in Tamil). For example, if you search images of Rajatava Dutta in Commons (a Bengali film actor), will you search it by search query "Rajatava Dutta" or you will type in Bengali "রজতাভ দত্ত"? Of course you will search in English. So, if the file is named in Tamil, I think it is very important to add a detailed description in English, so that it can be found in search in English too! Here the problem is, the file name not in English (that name is transliteration) and also not in Tamil script. The transliteration may vary person to person (For example:grains may be written as dhaniyankal or thaniyankal or daniyankal or dhaniyangal.....). If a person don't know Tamil means, he can't identify the subject. If it is in Tamil script means he/she can use any translation tools. (I'm asking you because, this doesn't match with any renaming criteria :) ). The description part also written like this. I think the person uploaded don't know, how to type in Tamil (I will correct description part later). Now the question is, whether should i rename it or not?. Okay, first, I promise, this will be my last post in this thread (unless I am directly addressed). Has anyone requested rename? If not, why you want to rename the file? If you want Tamil script, add in description, you can also add Teleugu, Malayalam or any other language you want (multii language description is really helpful sometimes)! And, as you have said, transliteration may vary from person to person, you can add all those in the description (eg. dhaniyankal or thaniyankal or daniyankal or dhaniyangal.....)! There will not be any problem in searching! According to his SUL he has three projects where a has a lot of edits: the German Wikipedia (>35,000 edits), Wikimedia Commons (>35,000 edits) and the German Wikisource (>28,000 edits). Hi Trijnstel — these are very good answers, thanks very much for handling those three tickets, and for bringing this to me.

As far as I know, the OTRS queues for WLM were not visible to all agents until a while ago, so that's why you might have not noticed them before. In the future, feel free to move any WLM-related e-mail to those queues; I have an e-mail notification set up for e-mails coming to the general (English) queue, so I can handle them.

Hi Geo Swan. Sure you can. I'll explain it. The Wikimedia projects suffer from a lot of spam lately. You can roughly divide them in three groups: the Chinese spambots, the comment spam and the Russian comment spam. The Chinese spambots are single-purpose accounts which create user pages with spam on it; the underlying IP addresses always geolocate to China. The comment spam contain messages like "I'm very happy to see your article (etc)" and are added by open proxies and webproxies on file, template or category talk pages. The Russian comment spam are similar to the 'normal' comment spam, but then written in Russian. The page you mentioned was from the second group, comment spam. He created more nonsense pages and I blocked the IP address, 108.171.207.228 (talk · contribs), for 1 month locally and globally (what I always do with these webproxies as they never stop). I know that's listed there and the authors name should indeed be mentioned (which isn't the case here). I also miss a source and explicit permission. The first sentence is "Version of Pp clock.gif on PNG-8 format." So I went looking at Image:Pp clock.gif and that one is deleted because of the following: "The source given by the uploader is incorrect - it is not a Nuvola icon, and is not PD-self. It's from everaldo.com. Very nearly an exact duplicate of File:Crystal clock.png, which is in a more appropriate format." So the info as mentioned there won't help either. File:Crystal clock.png gives http://www.kde-look.org/content/show.php?content=8341 as source ("All Crystal icons were posted by the author as LGPL on kde-look"). Geen enkele vraag is dom. :) Je kunt hier een uitleg van de licentie cc-by-sa-3.0 vinden. En daar staat o.a.: "Share Alike — If you alter, transform, or build upon this work, you may distribute the resulting work only under the same or similar license to this one." Dus dat betekent dat je de afbeelding mag veranderen mits je het resultaat ook vrijgeeft onder de cc-by-sa licentie. Verder heb ik andere vrijwilligers even om advies gevraagd en zij zeggen dat het wel belangrijk is dat je de afbeelding kunt herkennen als losstaand product. In een boek is dat vrij gemakkelijk (vergeet niet de auteurs te vermelden!), maar met een collage bijvoorbeeld zou het wat lastiger worden. OTRS-received dates

Hi Trijnstel. You recently added a lot of dates to OTRS-received boxes set by me. Please let me know if this is necessary, so I would do this myself next time. As far as I know there was a bot taking care of this, and additionally I'm not sure if this date is needed at all. To my opinion it is not necessary to utilise daily categories but the list of transclusions of the OTRS-received template should be sufficient. Please advise. Hi Krd. Yes, I think it's useful, tbh. The PermissionOTRS gadget automatically adds a date to it when you click on "OTRS received" and add an OTRS number. It's very useful to have a date on it, because in that case you see for which files it's long ago when we send an email to the copyright holder and we didn't receive a reply in the mean time. To track the no response issues I created Commons:OTRS/received which is sorted by last file page edit and grouped by ticket number. I think this scaled much better than categories. Hi Jafeluv. Nope, no insufficient imho, but I added {{OTRS received}} to prevent it from being deleted soon. Apparantly it didn't help. The related OTRS ticket is ticket:2012101710010531 and was initially send to the queue permissions-commons. As it was written in Finnish, a language I don't speak, I added that template and moved it to permissions-fi. Ok, thanks for the info. I was about to respond to the ticket, but noticed that it had been deleted (probably because of the OTRS received tag which says that the "permission was insufficient"). I think the template is intended only for cases where we need additional information from the copyright holder, otherwise {{OTRS pending}} is probably more appropriate. IP block

Simply my 0.02. I tend to escalate blocks (and one reason I may place a small block is as a marker for the future). However I do not recall ever blocking an IP for more than a year - the internet is a transient place. Oddly or otherwise I have very very rarely found myself reblocking open proxies for example - odd but true. Either way further blocks can always be placed and I prefer to use short blocks to start with at least.
This IP is obviously a comment bot source IP (To Trijnstel - a global block looks sensible!).
Google is your friend (sometimes) so check this search. Assuming you get the same answer as me this is a highly abused IP. Personally I would block for a year (my max for an IP).
