Blocked[edit]

I have blocked this user for three days because of the following e-mail and the fact that he has blanked at least one file page:

"Go on and delete it! I am so fed up with the SILLINESS with Wiki.
I enjoy taking photos and sharing them with others. I really enjoyed adding my photos to articles.
I disagree with so many of your rules. Regardless of who painted it, built it, crafted it, when they put it in the public, ANY photo taken belongs to the photographer!
The photo is what is being uploaded to Wiki, not the item!
So go on and delte it! I am in the process of deleting all my photos from this joke of a site!

I'm sorry you are angry about something -- you didn't say what, but I'll guess it is File:Downtown_Tavares.jpg.

As you certainly know, creative works have copyrights. Your photos have copyrights. That means that someone can't make a copy of one of your photos without your permission. That's true even if you post one of your photos in public, even if it were mural size. That's also true of other creative works -- sculpture, paintings, murals, and so forth. So the Tavares mural has a copyright and your photo is a derivative work of it, which means we would need permission from the mural artist to keep your photo of it here. I see that we have the same problem with File:Beacon_of_Faith.jpg.

You're certainly right that this can be frustrating. In some countries, notably Germany, there are special rules which allow an exception to copyright for works that are permanently in public view. We call these rules Freedom of Panorama, which is a rough translation of the German term.

In the USA, though, the Freedom of Panorama exception applies only to architecture. Even that is something of a blessing for us -- Commons cannot host images of recent buildings from France, Russia, and many other places because they would infringe the architect's copyright.

Commons didn't make these rules -- Congress did, for the USA -- but we enforce them in order to keep Commons images free for broad use.

I hope that you will understand all of this and continue to provide Commons with images -- you certainly aren't our biggest contributor or our best, but a number of your images are in use in Wikipedia and I'd hate to lose you over an issue which affects only one image.
