This image was uploaded by an account that possibly represents the Te Pae Convention Centre owners. However, the image metadata suggests copyright is owned by photographer Dennis Radermacher. It is possible he took this photo as a hired photographer for Te Pae.

I think we should at least check with the photographer whether the copyright is held by him or Te Pae, and whether he has released it for use on Commons. Cloventt (talk) 22:44, 1 May 2024 (UTC)[reply]

I emailed the photographer with this message:

Kia ora, my name is David, and I'm a volunteer editor at Wikipedia.

An image was recently uploaded to Wikimedia Commons of Te Pae Convention Centre: https://en.wikipedia.org/wiki/User_talk:Tepaechristchurch. The image was uploaded by an account we believe is owned by staff at Te Pae. However, the image metadata suggests you are the photographer and own the copyright.

To go on Wikipedia a photo has to be freely reproducible by anyone for any purpose; in practice this means old photos that are out of copyright, or ones released by the creator under a Creative Commons licence. In this case it is not clear to us who owns the copyright or whether it has been released under a compatible license.

Are you still the copyright holder of this image of Te Pae, or is the copyright now owned by the organisation?

If you do still own the copyright, and you're comfortable with releasing the image for use on Wikipedia, I'd be more than happy to help with that process. If you do not want to release it under an open license, I can also get the ball rolling on removing your copyrighted material from the platform.

they replied:

Hi David

Thanks so much for reaching out. I must admit, I’m surprised that someone follows this up. Good on you 😊

I’m the copyright holder for this image, Te Pae is a licensee of my images. They do not have the right to redistribute to third parties.

I’m totally happy for Wikimedia to use the images on Wikipedia. Please just note that this licence isn’t transferable. People downloading the image off of Wikipedia will have no rights to use it commercially. I will follow up any infringements with my copyright enforcement agency.

But yes, totally happy for you guys to use it. Thanks for your hard work!

All the best Dennis

Sounds like they do not want this image to be under an open license, so it needs to be removed. Cloventt (talk) 23:17, 1 May 2024 (UTC)[reply]
