The problem is that the image description clearly states that "The AWM, however, requires that the AWM watermark is not removed and that permission be sought for commercial use." I guess the original assumption is that it may be kept on Commons as long as the watermark is intact. On the other hand, my interpretation of http://www.awm.gov.au/website/copyright.htm is that it may be too restrictive for use on Commons and may have to be deleted.
