[1]Here is a photo of the subject while he was the president of supreme court of China (1954-1959), by comparision we can see the subject is about the same age in both of the photos. And that seems to be true after different ones from different periods.
[2]Here is one that claim to be taken in 1939 and the subject on the right does look similar to the one we got.
[3]Here is the source of the photo (the only one I found on the web and I am not the original uploader), it is likely that it was on offical publication from the look of it and which I believe can be the photo published when he became the president of supreme court thus gives us a date more than 50 years ago (<1954) and should be able to qualified for no copyright.
Unfortunately I was unable to find anything about this photo, like most of the old Chinese photos. But I believe the photo was published before 50 years ago from my observations. Sorry about this.
