Copyright violation?

While lurking around the NASA image gallery, I found an image of STS-120 launch, and that is suspiciously similar to STS120LaunchHiRes-edit1.jpg. The image I found from the gallery is ARR copyrighted by Scott Andrews, so not a PD-NASA image as we might expect.
