According to Nelson Beebe (former TeX User Group president) the TeX logo trademark is abandoned by the American Mathematical Society, AMS, so the image of the logo can be used freely.

Originally, the American Mathematical Society held the copyright on the TeX logo, and Addison Wesley that of METAFONT (see the inside cover of The TeXbook). However, a search at the US Patent Office Trademark Electronic Search System (TESS) shows that the TeX logo trademark was abandoned by the AMS on 7-May-1985.
