Images of snacks on unskewed version

My unskewed version of this image was reverted with a statement that it was violation of Commons:Derivative works because it contains "images of snacks with copyrighted Commons:Packaging."

Fair enough, but the original image -- with a public domain license -- contains the same images of the copyrighted packaging as in my version, though they are skewed due to the perspective of the photograph. So how does the original image not also violate the snack image copyright issue?

I believe this arises as follows:

  • The original image became public domain because it was created by an employee of the U.S. federal government as part of that person's official duties ("PD-USGov-Military-Marine Corps"). This condition enabled the image to enter the public domain.
  • My derivative version of the image contains images of copyrighted characters in public domain works.

Any derivative versions of the original image would need to mask out all "embedded elements" in the image containing snack images in order to remain public domain. Such versions would fundamentally degrade the artistic merit of the image, IMHO. SteveChervitzTrutane (留言) 19:04, 30 November 2021 (UTC)[回覆]
