he first year of the war.On Fel)ruary 14, 1862, according to the proclamation of Presi-dent Lincoln, the custody of all prisoners of state was trans-ferred from the Department of State to that of War, and onlythe latter department was thereafter authorized to make ar-rests. Secretary Stanton, on the same day, issued an orderdirecting that all political prisoners or state prisoners nowlield in military custody be released on their subscribing a pa-role engaging them to render no aid or comfort to tlie enemiesin hostility to the United States. The Secretary of War will,however, in his discretion except . . . others whose release atthe present moment may be deemed incompatilile witli the pub-lic safety. . . . Extraordinary arrests will hereafter be madeunder the direction of the military authorities alone. CO JOHN MINOR BOTTS AND HIS FAMILY—1863 A peaceful scene for Culpeper County, Virginia, whose fair acres were ploughed with shot and sliell, andwhose soil was retldened with the blood of its sons, during the year 1863. The firm chin and close-set mouthof John Minor Botts stamp him a man of determination. He disbelieved in the right of secession and loudlyproclaimed his disbelief until he landed in a Richmond jail. When he was finally convinced that he wouldnot be allowed to attack the Confederacy, verbally or otherwise, in the city of Richmond, he betook himselfand his family to Culpeper County, where he talked pretty nuich as he pleased. Even in Richmond hisdetention was only temporary. Though it was evident that under war conditions many sudden arrestsmust be made, a resolution authorizing the President to suspend the writ of habeas corpus was not passeduntil February 27, 186-2.
