A statementof the case is made by City Attorney Beach as follows : The common council by resolution forfeited the rights,privileges and authorities of the Consolidated Street Rail-way Company in our streets, pursuant to an ordinance ofthe city which provided that the company was to relay itstracks on Michigan avenue, Hamilton, Cleveland and Madi-son streets, within a certain time.
