The uploader evidently contacted the flickr account owner for permission. But the license was not changed, however. Not sure if this image can be kept if the license is changed.   • Note: The flickr license must be either 'Attribution Creative Commons'...as it is called on flickr {{Cc-by-2.0}} or "Attribution-ShareAlike Creative Commons": {{Cc-by-sa-2.0}}
  • France has no Freedom of Panorama for modern sculptures or buildings unless the artist/architect has been dead for 70 years. On the 71st year, images of the sculpture of or building becomes copyright free. That is why pictures of the Eiffel Tower were not copyright free until 1994 since Gustav Eiffel only died in 1923. I don't know if this sculpture is old enough that it would not be affected by French FOP laws. The sculpture or building is not affected by copyright only if it is of plain design such as a concrete rectangular block building. This is a sculpture. However, this sculpture's design shows little originality and appears rather generic so I am not certain if French copyright law does cover it. I think it is OK.
