- Article L131-3-1 Pertaining to works authored by a state employee: The rights of a work created by a state employee for the accomplishment of a public service or a mission are, from the moment of creation, transferred to the State.
- Article L523-12 Archaeological material resulting from preventive archaeology operations is entrusted, under the control of the State services, to the preventive archaeology operator for the time necessary to draft the operation report. This period cannot exceed two years. The provisions of article L. 523-14 are then applied. Drawings of an archaeological excavation survey: if this original map (therefore protected by copyright) is made in the context of an archaeological excavation site, the Heritage Code sets a time limit during which the researcher is the only one who can study the archaeological material, with a view to writing the operation report. This period of study is limited to two years but can be extended by 3 additional years, in the case of preventive archaeological excavations, that is to say when archaeological remains are discovered during a construction site (Ccode du Patrimoine, art. L.523-12). At the end of this five-year period, the excavation report, including the documentation and in particular the field surveys, must be submitted to the State (to the regional archaeology department): this document will be available for consultation by all.
- Article L.531-11 and L.531-16 As far as programmed archaeology is concerned (excavations undertaken in the case of fortuitous discoveries, or excavations carried out by the State with the aim of carrying out archaeological research, and not on the occasion of a preventive excavation site), the time limit for the study of exhumed archaeological material is fixed at 5 years (Code du Patrimoine, art. L.531-11 and L.531-16).
