Governor Deval Patrick has signed a bill into law designating the Nashua Road Bridge on Route 4 over the Concord River in Billerica as the John F. Leary Bridge. The designation honors Leary, a Billerica resident who served for nearly 47 years as legal counsel for the Massachusetts Highway Department. Leary joined the Highway Department in 1958 and passed away in 2005. Leary's work included legal and right of way issues related to construction and expansion of such major transportation projects as I-95, Route 128, and I-495. He is credited with drafting a significant portion of the state's transportation laws, many of which exist to this day. "John Leary's work is stamped on transportation law and important projects all across the Commonwealth," said MassDOT Secretary and CEO Jeff Mullan. "I had the privilege of working with and learning from John as a young lawyer. In dedicating 47 years of his life to public service, he was a role model for hundreds of co-workers while leaving a fabulous legacy. It is a tribute to the many contributions he left us and to the person he was that we honor him in this permanent way." MassDOT will post a marker and sign on the Route 4 Bridge noting the designation as the John F. LearyBridge. |

Definition of "public record"
Public records are defined in A Guide to the Massachusetts Public Records Law, Published by William Francis Galvin, Secretary of the Commonwealth Division of Public Records, (Updated January 2017) at https://www.mass.gov/files/2017-06/Public%20Records%20Law.pdf on page 40, under M. Limitations of template usage
This is consistent with the statement at http://www.sec.state.ma.us/ARC/arcres/residx.htm:
Note: Works that are considered "public records" but were not created by a state or municipal government agency may be copyrighted by their author; the Supremacy Clause of the United States Constitution prevents state law from overriding the author's right to copyright protection that is granted by federal law. For example, a state agency may post images online of the final appearance of a building under construction; while the images may be "public records", their creator (eg. architecture/construction firm) retains copyright rights to the image unless the contract with the agency says otherwise. See: Government-in-the-Sunshine Manual: To what extent does federal law preempt state law regarding public inspection of records?. |
