Description
Norsk bokmål: Karl-Hans Herman Klinge (1908–46), saksbehandler ved Gestapo i Oslo, ble i lagmannsretten enstemmig dømt til døden for tortur mot fanger. Da anken kom til behandling i Høyesterett 27. februar 1946 hevdet hans forsvarer, høyesterettsadvokat Adam Hiorth (1879–1961), at Klinge var uriktig domfelt etter krigsforbryteranordningen av 4. mai 1945 i stedet for straffeloven av 22. mai 1902. Anordningen stred dessuten, etter Hiorths syn, mot bestemmelsene i Grunnlovens §§ 96 og 97 om at ingen kunne dømmes uten etter lov, og at lover ikke måtte gis tilbakevirkende kraft.
