English: Photo by United Press International (UPI) of Martin Luther King Jr. in a jail cell on June 11, 1964, following his arrest on trespassing charges connected to the St. Augustine movement in St. Augustine, Florida. The caption reads: "SAP061201–6/12/62–ST. AUGUSTINE, FLA.: Dr. Martin Luther King peers between the bars of his jail cell at the St. John's County jail here 6/11 shortly after he and other integration demonstrators were arrested on trespassing charges at a local motel. According to a 2011 article in the St. Augustine Record, the St. Johns County Jail building in which King was held is now the county's Detention Center Annex for work release inmates.

English: No permission is required. The photograph entered the public domain because it was published prior to 1978 without a valid copyright notice. The pre-1989 requirements for copyright notice were highly formalistic and, other than a few enumerated exceptions, required these three elements:
  1. "The symbol © or the word 'Copyright' or the abbreviation 'Copr.' or an acceptable variant such as "(c)";
  2. "The year of first publication for the work"; and
  3. "The name of the copyright owner, or an abbreviation by which the name can be recognized, or a generally known alternative designation of the owner."
Credits like "UNITED PRESS INTERNATIONAL TELEPHOTO" do not meet these requirements. Additionally, the date provided by UPI is two years off.
