根據民國105年11月30日的中華民國著作權法第四節,第二分節,著作財產權之存續期間第三十條 (著作財產權之存續期間) 著作財產權,除本法另有規定外,存續於著作人之生存期間及其死亡後五十年。 著作於著作人死亡後四十年至五十年間首次公開發表者,著作財產權之期間,自公開發表時起存續十年。原作者死於1851年,距今現在已有一百七十六年,其作品在臺灣地區已經屬於公有領域
