Copyright status of the depicted "Allow Me" sculpture[edit]

The sculpture depicted in this image was installed in a public location in the United States (i.e. "published" for purposes of U.S. copyright law) in 1983. Under U.S. law applicable to that year, works published without a copyright notice are deemed to be in the public domain if they were not subsequently registered with the U.S. Copyright Office within 5 years.

On 17 November 2009, User:Werewombat examined the sculpture and did not find a copyright notice (although the complex topology of the sculpture could have hidden a notice in a spot not immediately evident). A review of the U.S. Copyright Office catalog (at http://cocatalog.loc.gov) did not yield a record of registration for the sculpture. (Search terms included Title="Allow Me"; Name="Johnson J Seward" and variations; and Claimant="Schwartz Harry" and variations, "Johnson J Seward" and variations, "City of Portland", and "Pioneer Courthouse Square".)

Unless contrary evidence is produced, I suggest Commons should assume that the sculpture neither bears a copyright notice nor was registered within the specified time and is, therefore, in the public domain. —Werewombat (talk) 18:49, 19 November 2009 (UTC)[reply]
