The Wikimedia Foundation has taken an official view that it considers reproductions of all PD-art works to be PD themselves. This is a political position, not one based on legal evidence, and a position which expressly and voluntarily ignores that the laws of many nations - Iceland in this example - explicitly creates new copyrights to anyone using a camera, regardless of what the camera actually photographs. This legal situation means that Commons potentially places many re-users of Commons material in legal jeopardy, provided that these people don't live under U.S. or German jurisdiction. The slippery slope only began when the Wikimedia Foundation expressly overturned its own previous decision to respect local laws as well as U.S. law.
