Benin and Nauru[編集]

According to Amnesty International, Benin and Nauru have abolished the death penalty. Their map does not reflect this change yet, but their website does.[1] I think this map should reflect the most up-to-date facts, even if amnesty's does not (especially as amnesty is the source for the update). US by state (fixed errors)[編集]

The map showed some parts of the US as having the death penalty, and others not having it, with no correlation to actual law. So Guam, N.Marianas, Puerto Rico, USVI were blue, despite the law there being equivalent to e.g. Washington, Wisconsin, New York,, and Am.Samoa was red, despite not having enforced the penalty in so long that some sources think it's been abolished. I broke the US up by state, with a red border on all states to reflect federal enforcement. That red border belongs on the US territories as well. All but Am.Samoa have a district attorney to request the death penalty for local federal cases, but I believe federal law applies to Am.Samoa as well. I think the US is the only death-penalty country like this. Certainly in the more authoritarian ones, the states/provinces don't have this kind of autonomy, and in India I can't find any evidence of local variation. Cyprus[編集]

The picture shows two dots in Cyprus, indicating two jurisdictions, one indicating abolitionism in law (dark green) and the other indicating abolitionism-in-law and in practice regarding exceptional circumstances (light green). These are presumably the Sovereign Base Areas of Akrotiri, the Republic of Cyprus, with the former being the dark green and the latter being light green. In the SBAs, the criminal code mirrors that of Cyprus. Nevertheless, it was amended to remove the death penalty for murder in 1966 (https://sbaadministration.org/home/legislation/01_02_09_04_INCON/C/20200630_AGLA_CriminalCode_Cap154_CONSOL.pdf), before Cyprus did so in 1983 (http://www.cylaw.org/nomoi/arith/1983_1_086.pdf). Afterwards, Cyprus retained the death penalty for premeditated murder, high treason, piracy jure gentium and capital offences under military law (article 7 paragraph b of the Constitution, https://www.constituteproject.org/constitution/Cyprus_2013.pdf?lang=en). The constitution, unlike the penal code, is not mirrored in any way by (disputed) SBA law and hence this mention of capital punishment does not apply, and hence the SBAs became abolitionist in 1966. The tenth amendment to the Constitution removed all mentions of the death penalty (including article 7 paragraph b) and hence Cyprus too became an abolitionist in law jurisdiction in 2016. The amendment passed with 49 votes in favour, none against and 2 abstaining, out of 56. It is evident from the discussion of the adoption of the amendment that the references to the death penalty were left in the Constitution by accident. The death penalty is mentioned thrice in articles which cannot be amended, but these are just a mentions of its existence, not any use of it. Seeing as there are currently no provisions on the use of the death penalty in any law of the Republic of Cyprus, it should be changed to a dark green colour. It has been, since the entry into force of the tenth amendment to the constitution of Cyprus, an abolitionist jurisdiction. Note the laws of the SBA are considered invalid by Cyprus (http://www2.parliament.cy/parliamentgr/008_05b/008_05_1543.htm) ("The British bases operate largely on the basis of decrees of the commander of the British bases according to the colonial model, without decisions containing the legal validity of either the British or the Cypriot parliament. This leads to the invalidity of the decisions of the courts of the British bases, since the court decisions cannot be based on decrees and acts of an administrative nature.").

Lastly, I am unsure if the light green map is meant to denote the (unrecognised) Turkish Republic of Northern Cyprus, or the Republic of Cyprus with a dot bing added to enhance the visibility of the RoC map due to its size. If the former is true (which is unlikely, because other breakaway states such as Transnistria are not shown on the map), then Northern (“occupied”) Cyprus should remain light green based on the article from before. Map with US states[編集]

@Qqq1000: This is the companion map of the article Capital punishment by country, where a country is said to have a abolished capital punishment in practice if there is a moratorium AND they haven’t used it for at least 10 years. These countries are shown in brown in the map. If either of these requirements isn’t met, the country is said to maintain the death penalty in both law and practice, and is shown in red.

In the United States, the death penalty was last used at the federal level in 2021 (less than 2 years ago), therefore it must be coloured red regardless of the moratorium.

I agree with Brainiac242's comments. The death penalty applies throughout the United States, so just including the death-penalty at the state level is misleading. It suggests that there are parts of the US where there is no death penalty. For example, Massachusetts is shown as having no death penalty, but Dzhokhar Tsarnaev is on death row for his role in killing people at the Boston Marathon in 2013. I agree with Brainiac242 and Mr Serjeant Buzfuz. There is currently three people on federal death row for crimes committed in states that had no death penalty, and two others who committed crimes in states that have now abolished the death penalty.
