Evidence to support public domain status of this image
[edit]This painting is in public domain if it was "first published" before January 1, 1923. The date of its creation is not important. I have so far been able to discover these:

- Evidence that it was published, probably in the early 20th century, but no date given: http://www.thepostcard.com/walt/hist/hist.htm
- Evidence that it or an engraving of it has been published: http://books.google.com/books?id=u3IBAAAAMAAJ&pgis=1 (publication date 1927)
- Ebay searches for "Yohn Oriskany postcard" often yield results for old postcards, although no reliable dates will be found this way
- Derivative (or copy of) work was placed on a United States stamp in 1977: http://www.arago.si.edu/index.asp?con=1&cmd=1&tid=2039176
This painting may well have been painted around the same time that Yohn did other work for Henry Cabot Lodge's Story of the Revolution, published in 1903. It does not appear in that work; Yohn did paint a different battle scene of Oriskany for it.
Yohn did some work providing illustrations for Scribner's Magazine; a copy of this painting may have been published there.
According to commons:Commons:Licensing#United_States, stamps released prior to 1978 are in the public domain. This leads me to believe this image is in the public domain, as the image on the stamp is not obviously modified to any notable degree.
