{{PD-Australia}}[编辑]

I have again removed the {{PD-Australia}} as there is no indication that any of the criteria are meet and any claim that the creator died before 1955 is pure speculation. Please provide proof of meeting the criteria before re-adding. LGA talkedits 07:17, 12 November 2013 (UTC)[回复]

And it is purely speculation on your part that PD-Australia does not apply, you have absolutely no evidence whatsoever that it doesn't and 3 other users all believe it does apply. Instead of threatening me, perhaps you should effort yourself in finding proof it doesn't. If you can not prove that by the time this file is kept from that overzealous DR (which it will be), I will ask an admin to forcibly return the license. Fry1989 eh? 18:34, 12 November 2013 (UTC)[回复]
I agree absent proof of death, any claim to the date of death of the rights holder in this image is speculation. However the burden of proof lies with you as the person wishing to claim a licence applies to prove it. I have shown with the stats you provided that one in four males aged 15 in 1901 would have lived to 1962, given the small changes over time in life expectancy very close to one in four 22 yo's in 1901 would have been alive in 1955, that is a significant number. The irony here is overwhelming. You complain that using the PD-Australia license without 100% proof of the author's time of death is speculation, yet your entire claim that he may have lived longer is in itself speculation, and that based without any evidence. At least the theory he died earlier than 1955 is backed by some form of statistical records, you haven't provided anything to the contrary other than your own opinion. Then of course, there's also the problem of you trying to attach a standard of proof to the precautionary principle that simply does not exist. You are also claiming Wikipedia policies, which do not have effect on Commons, as the basis of your removal. If you can't quote a relevant Commons policy, then your removal is invalid. You're being completely irrational and unreasonable regarding this, and I will not argue with you about it any more. When this file is kept, I will ask an admin to re-add the license and if you remove it again they can deal with you. Fry1989 eh? 20:34, 12 November 2013 (UTC)[回复]
