PD-art, PD-old, or not PD ?

Hello, a french wikipedian had posted this remark on the talk page :

Le tableau est connu depuis moins de 30 ans, pas dans le domaine public.Philippe Nusbaumer (d) 14 avril 2009 à 23:40 (CEST)

Translation : "This painting has been discovered less than 30 years ago, (therefore) not public domain" I think he's telling that because the painting was not published before, there are some rights attached to the reproduction.
Is this right, or is this case covered by Commons:Reuse of PD-Art photographs ?
