You were correct. The photo you include in the first link below is public 
domain. This photo is a studio head shot taken by a NIST employee.

 The description of the copyright on this page is not as clear as it 
should be.

The photos in Dr. Phillips lab were taken by a commercial photographer 
hired by NIST. These photos are copyrighted by the photographer and a photo 
credit that reads, Copyright Robert Rathe, is required to appear with them. 
However, they can be used for free in materials that also explicitly 
mention the National Institute of Standards and Technology in accompanying 
text or a caption. These photo cannot be used as stock art -- i.e. without 
reference to NIST --without permission from the photographer and payment of 
a use fee.
