Description
Nederlands: De financiële toezichthouders AFM en DNB gebruiken de bestuurlijke boetes voor zwaardere overtredingen dan bedoeld. Hierdoor heeft de boete zich ontwikkeld tot een gelijkwaardig alternatief voor het strafrecht stelt Arnt Mein, onderzoeker Verwey-Jonker Instituut, in zijn proefschrift "De boete uit balans. Het gebruik van de bestuurlijke boete in de praktijk van het financieel toezicht" aan de Erasmus Universiteit. De financiële toezichthouders moeten duidelijker beleid formuleren; onder elke omstandigheden kan een boete wel of niet gegeven worden. Daarnaast moet in het boetebesluit een betere onderbouwing komen waarom de boete in dat concrete geval gerechtvaardigd is.
