Baltimore Dec 2nd 1837.
My Dear Sir,
On my arrival at Baltimore I ascertained that the original papers in the case of the Fair America, with regard to which I conversed with the Secretary of State, are now lodged in the Department of State among the papers offered to the Commissioners under the Convention with France. I had been led to expect to find them in the hands of a gentleman in Baltimore. Under these circumstances, allow me, my dear Sir, to trespass further upon that kindness which you have so liberally extended to me, by asking you to pro- [p. 2] cure for me copies of all the papers in this case, authenticated by the Secretary in such way as to give them the most acceptable credence. The papers were presented to the French Commissioners, & the claim founded upon them was rejected. If possible, I would like an authenticated copy of the record of rejection. I have mentioned that the papers relate to the Fair America. She was owned in Boston, & rendered services to the French man of war Foudroyant in 1806. The proper fees to the department I shall be happy to forward.
I have ventured to trouble you in this way, because I am ignorant of the [p. 3] proper course to take in order to obtain the copies in the shortest time, & my day of sailing (Dec. 8th) is so near at hand that I feel unwilling to expose myself to the risk of delay. If you could be so good as to put this letter into the hands of the proper clerk in the Department, & personally request him to prepare the copies in season to reach me at the Astor House in New York previous to Dec. 8th, you would confer upon me an obligation, for which I can only thank you, but which it will be my study to repay. If there are fees to be advanced, please give yr assurance to the clerk, & at once [p. 4] advise me of the amount; & it shall be remitted.
The liberty which I have ventured to take by this letter can hardly be justified by any rules of civility; & I must throw myself upon your generosity, hoping that at some time you will afford me an opportunity of reciprocating your kindness.
