Die Verfassung der Bundesrepublik Deutschland teilt die Gesetzgebungsgewalt zwischen Bundestag und Bundesrat. Das ist der SPD ein Dorn im Auge. Denn die SPD stellt zwar die stärkste Fraktion im Bundestag, im Bundesrat aber hat die Union die Mehrheit. Das bremst den totalen Machtanspruch der Sozialisten.
