Adoption in the Czech Republic[编辑]

Should there be perhaps additional colour, which would allow to distinguish countries, where adoption by a single gay person is legal (also when in registered partnership), only joint adoption by a gay couple is illegal? I reverted the map to the old version till we have a reliable source on this issue. That article on tportal.hr doesn't even mention same-sex couples (istospolna zajednica), but unmarried heterosexual couples (izvanbračna zajednica). There's a caveat, the court gave parliament until December of this year to pass the law. Until then, LGBT couples can't adopt jointly. Knowing the politics of Austria and the current government, they'll probably run the clock down on that too. Chase1493 (留言) 08:25, 23 April 2015 (UTC)[回复]

  1. The situation in Croatia is ambiguous. It's not certain the parliament legalized stepparent adoptions. Partner-guardianship is probably not the same as second-parent adoption.
  2. You have removed the Middle East because it is not in Europe. But you have added Greenland that is not in Europe.
  3. In most countries that permit adoptions by singles the legal status of LGBT adoption is unclear. No ban on LGBT adoption doesn't mean LGBT individuals are explicitly allowed to adopt. In many countries courts allow single-parent adoptions only in certain circumstances and because of anti-LGBT attitudes it's unlikely the judges have permited LGBT adoptions. Moreover, transsexualism is considered as a mental disorder. Therefore, we should limit the legend to the legal status of adoption by same-sex couples. HumRC (留言) 20:26, 2 June 2015 (UTC)[回复]
Ok, I can agree with you on the first and third point, well said. However, one the second I find it reasonable to add Greenland and remove the Middle East. Greenland has relevance in the European sphere because of its relationship with Denmark, as does Cyprus and its inclusion in the EU. The Middle Eastern countries have no such relationship with Europe, nor do the North African countries. The only country I would let remain is Morocco because it gives contrast to the Spanish autonomous cities located on its coast. Thoughts? Chase1493 (留言) 23:43, 8 June 2015 (UTC)[回复]

UPDATE: Portugal, same-sex adoption since 2016[编辑]

Since today, 20th November 2015, joint adoption by same-sex couples is legal in Portugal after parliament decision: ABC News - ‘Portugal Allows Same-Sex Adoption, Artificial Insemination’; Yahoo! News - ‘Portugal Allows Same-Sex Adoption, Artificial Insemination’; Pink News - Portugal just equalised its adoption laws for gay couples. Also, since 2013, adoption by a stepparent in a same-sex couple was already possible: Portuguese American Journal - ‘LGBT: Portuguese parliament approves right to adoption – Portugal’; Reuters - ‘Gay couples in Portugal win limited adoption rights’. In a decision published on 22 June 2016, the Italian Court of Cassation admitted stepchild adoption in same-sex couples.

The 2012 referendum in Slovenia did not repeal step-child adoption, it rejected the new Family Code, which, if passed, would not have changed the legal status of step-child adoption for same-sex couples. The right to step-child adoption was recognized by the Ministry of Labour, Family, Social Affairs and Equal Opportunities in 2011 after an appeal by the female partner of a child's biological mother on the basis of the old, 1976 law, which is still in force to this day. Step-child same-sex adoption in Slovenia is legal as it is considered single parent adoption from a legal standpoint, on which there are no restrictions in terms of sexual orientation. There are restrictions on joint adoptions, which are only possible if the couple is married. A legislative proposal for same-sex marriage was rejected in a 2015 referendum, effectively prohibiting same-sex couples from joint adoption. However, step-child adoption is possible. In Switzerland the referendum on step-parent adoption got not engough votes. Step-child adoption will become now legal in Switzerland.

On 30 June 2017, Germany allowed same-sex marriages by parliament. Also Same-sex adoptions become allowed in Germany.
