Though this image is licensed properly, I'm not very comfortable with the upload (aka publication) of this image on Commons. We don't know when this image was taken, i.e. if this child is alive or already matured and may see her/his image published, while the doctor who took it eventually said to take it for a medical audience only. --Túrelio (talk) 12:24, 16 June 2008 (UTC)[reply]

I can understand your doubts, but we can't assume, that the authors of this article broke medical ethics principles and got the permission from the parents of this child without informing them, that this image will be free-licensed and so globally available. We can certainly mail editors of OJRD or the authors directly; personally, I don't think that it's necessary. Paragraph 3 of BioMedCentral license says, that

3. the article contains nothing that is unlawful, libellous, or which would, if published, constitute a breach of contract or of confidence or of commitment given to secrecy

Filip, my doubts are not against you, but - honestly - I've some prejudice in regard to the recognition of copyright and personality rights by people from that area. But my strongest reservation is not based on written law (though there are laws for that) but on respecting human dignity. I've actually sent an email to the first author. If he doesn't reply, I'll write to the editor, until I get a positive confirmation that permission of the parents was obtained. As I've written already on the Commons:Village pump#Images of sick children, a black bar over the eyes isn't a real option as it would probably heavily diminish the educational value of the images. --Túrelio (talk) 21:16, 16 June 2008 (UTC)[reply]
